Regulatory Rules for Family Funds

Chapter 1: Preliminary Provisions

Article 1

  • The following words and phrases – wherever they appear in these regulations – shall have the meanings specified next to each of them:

    • 1- Law: The Law of Associations and Non-Profit Institutions.

    • 2- Center: The National Center for Non-Profit Sector Development.

    • 3- Council: The Board of Directors of the National Center for Non-Profit Sector Development.

    • 4- Competent Authority: The authority designated by the Council of Ministers.

    • 5- Fund: The Family Fund.

    • 6- Family: Individuals who are named after the person in whose name the fund is established.

    • 7- Board of Trustees: The Board of Trustees of the Family Fund.

    • 8- Regulation: The Implementing Regulation of the Law of Associations and Non-Profit Institutions.

    • 9 - Rules: The Organizational Rules for Family Funds.

    • 10- Bylaws: The Bylaws of the Family Fund.

    • 11- Leadership Positions: Refers to the position of the executive officer and financial and legal positions.

    • 12- Relatives: Individuals who are related to the founder or founders of the fund up to the fourth degree of kinship, whether by blood or through marriage.

Article 3

  • In consideration of the objectives stipulated by the Law, the basic Regulation defines the objectives upon which the fund is established, and it may not exceed those objectives except with the approval of the center. The fund must generally aim to strengthen family ties, promote the spirit of solidarity, harmony, and compassion among family members, reconcile differences, contribute to organizing acts of charity among family members, cooperate in righteousness and piety, and contribute to the education, training, and development of family members.

Chapter 2: Establishment of the Fund

Article 4

  • The following conditions must be met by the applicant or applicants for establishment:

    • 1- Must be a Saudi national.

    • 2- Must have full capacity.

    • 3- Must not have a final judgment issued against them for a crime that undermines honor or trust, unless their status has been restored.

Article 5

  • 1- If the founder wishes to establish a fund in his personal name, in this case, the fund must serve the members of his family.

  • 2- If the founders wish to establish the fund in the name of an individual to whom they are related and who bears their family name, at least half of the children of the individual in whose name the fund is established (if any) must be among the applicants - it is sufficient for each child of the individual in whose name the fund is established to represent one of his children or the children of his children, regardless of how far down the line.

  • 3- A fund may be established in a general name to serve one family or several families under the following conditions:

    • A- There must be a relationship of kinship or marriage between the families of the founders.

    • B- The name of the family or families served by the fund must be specified in the basic regulation.

    • C- The number of founders must not be less than ten individuals from the family or families that submitted the establishment request.

Article 6

  • 1- With due regard to the provisions of paragraphs (1) and (2) of Article (5), any applicant for establishment who wishes to name the fund after themselves or applicants for establishment who wish to name the fund after an individual to whom they are related must comply with the following:

    • A- The name of the fund must be a three-part name of a natural person.

    • B- The individual after whom the fund is named must be alive.

    • C- The fund may not be named after a tribe or family, nor may the name lead to tribal disputes or family conflicts.

  • 2- The center has the right, by a reasoned decision, to amend the name of the fund in order to achieve the public interest.

Article 7

  • In accordance with the provisions of Article (5), anyone wishing to establish the fund must submit to the center the following:

  • 1- A request for establishment according to the form prepared by the center, accompanied by a statement clarifying the details of the applicant or applicants for establishment as follows:

    • A- Name as per the national identity.

    • B- National identity number.

    • C- Profession.

    • D- Contact information including email address and mobile phone number.

    • E- National address.

  • 2- The name of the fund to be established.

  • 3- A copy of the national identity of the applicants for establishment.

  • 4- The name and details of the authorized representative of the applicant or applicants for establishment, along with their contact information including email address and mobile phone number.

  • 5- The names of the members of the Board of Trustees, the Chairperson of the Board of Trustees, and the Vice Chairperson.

  • 6- A basic regulation for the fund according to the form prepared by the center that does not conflict with the law or these rules.

  • 7- A commitment to activate the fund after establishment, by opening a dedicated bank account for it to carry out its activities or mission within a period not exceeding one year from the date of issuance of the license.

Article 8

  • The center shall decide on the Claim to establish the fund according to the following procedures:

  • 1- The center studies the Claim to verify its compliance with the conditions and data stipulated in the Law, as well as these regulations, decisions, and instructions issued pursuant to them.

  • 2- The center shall announce for a period of thirty days the Claim to establish the family fund on its website after completing all the documents specified in these regulations. The announcement shall include the name of the fund, the name of the applicant or applicants for establishment, and the basic regulation of the fund.

  • 3- The Claim shall be assigned a number and date of entry for study by the center after completing all the documents specified in these regulations and the expiration of the announcement period, at which point the Claim shall be considered complete in its Justifications.

  • 4 - The center shall issue, after coordination with the relevant authority, a Decision to approve or reject the Claim within sixty days from the date of completing the Justifications.

  • 5- The center shall issue the fund's license after fulfilling the above and according to the following procedures:

    • A- The center shall register the fund in its special register for family funds and grant it a specific license number.

    • B- The center shall take measures to publish the content of the Decision to establish the fund on its website.

    • C- The center shall issue the fund's license based on the special register for family funds, in addition to an approved copy of the basic regulation, and these shall be delivered to the authorized representative of the applicant or applicants for establishment.
