Technical Regulation for Front, Rear, and Side Guards of Trucks and Trailers

Preamble

Based on Article Four (Paragraph - 2) of the Organization of the Saudi Standards, Metrology and Quality Organization issued by Council of Ministers Resolution No. 216 dated 17/6/1431 AH, corresponding to 31/5/2010 AD, whereby the Organization shall "issue regulations for the conformity assessment procedures for goods, products, and services according to the standard specifications it adopts".

And based on Article Four (Paragraph - 14) of the Organization of the Saudi Standards, Metrology and Quality Organization issued by Council of Ministers Resolution No. 216 dated 17/6/1431 AH, corresponding to 31/5/2010 AD, whereby the Organization shall "review the regulatory systems and regulations related to the fields of the Organization's work, develop them, and propose the necessary amendments to them, in accordance with the legal procedures".

And based on Article Six (Paragraph - 1) of the Organization of the Saudi Standards, Metrology and Quality Organization issued by Council of Ministers Resolution No. 216 dated 17/6/1431 AH, corresponding to 31/5/2010 AD, whereby the Organization shall "considering what is stated in Article Four of this Organization, the Organization is the reference in the Kingdom for everything related to standard specifications, conformity assessment procedures, and granting the quality mark, measurement, and calibration, and all government and private sectors must comply with the Saudi standard specifications in all their purchases".

Whereas the standard specifications for products covered in one of the technical regulations are considered evidence of those products meeting the essential requirements in the specified regulation, the Organization has prepared this technical regulation.

Note: This preamble and all annexes to this regulation are an integral part of it.

Article (1) Terms and Definitions

1/1 1/1 The terms and phrases below - when applying the provisions of this Regulation - shall have the meanings indicated next to them unless the context of the text requires otherwise:

The Kingdom: The Kingdom of Saudi Arabia.

The Council: The Board of Directors of the Authority.

The Authority: The Saudi Standards, Metrology and Quality Organization.

Technical Regulation: A document approved by the Board of Directors that sets out the characteristics of products and the processes associated with them and their production methods, including the applicable administrative provisions that must be adhered to. It may specifically include or address terms, definitions, packaging, and requirements for labeling or marking on products, services, processes, or production methods.

Standard Specification: A document approved by the Board of Directors; it sets out - for regular and repeated use - the rules, instructions, or characteristics for products or processes and related production methods; the application of which is optional, and may specifically include or address terms, definitions, packaging, and requirements for labeling or marking applicable to products, services, processes, or production methods.

Essential Requirements: The requirements specific to products that may affect safety, health, and the environment; which must be adhered to.

Market Survey: The activities and measures taken by market survey authorities to verify that products meet the requirements stipulated in the relevant technical regulations, and that they do not pose a risk to health, safety, and the environment, or any other aspect related to the protection of the public interest.

Market Survey Authorities: The governmental entity/entities responsible for conducting market surveys.

Regulatory Authorities: The governmental entity/entities with regulatory tasks according to their jurisdiction; responsible for implementing or monitoring the implementation of technical regulations, whether at customs points, markets, or factories.

Licensing Authority: The competent authority in the Kingdom responsible for issuing licenses for the activity of manufacturing and installing protective barriers for trucks.

The Product: Front, side, and rear protective barriers for trucks, trailers, and semi-trailers with a maximum weight exceeding 3.5 tons.

Hazard: A potential source of harm.

Risk: The likelihood of a hazard causing harm; related to the severity of the harm.

Supplier: Refers to the following:

- The manufacturer of the product, if established in the Kingdom, or any person who presents themselves as the manufacturer of the product by naming the product in their name or any relevant trade description, as well as any person who renews the product.

- The manufacturer's agent in the Kingdom if the manufacturer is located outside the Kingdom, or the importer in the absence of an agent for the manufacturer in the Kingdom.

- Any person in the supply chain whose activity may affect the characteristics of the product.

Conformity Assessment Procedures: A document approved by the Board of Directors that outlines the procedure used directly or indirectly for conformity assessment.

Accepted Entities: Entities for conformity assessment that have been accepted by the Authority according to the Regulation for Accepting Conformity Assessment Entities.

Certificate of Conformity: The certificate issued by the Authority or one of the accepted entities; confirming that the product or any batch of it complies with the requirements of the relevant standard specifications.

Supplier's Declaration of Conformity: A declaration from the supplier themselves that their product complies with the applicable legislative requirements, without any mandatory intervention from a third party - neither at the design stage nor at the production stage of the manufacturing process - and the declaration may rely on tests on the product according to the relevant legislation.

Saudi Quality Mark: A mark approved by the Authority indicating that the establishment has an effective management system that ensures the production of a product compliant with the Regulation and the granting procedures and the relevant Saudi standard specifications.

Market Placement: The initial placement of the product in the market of the Kingdom, for which either the manufacturer or the importer is responsible.

Market Offering: Means any supply of the product for distribution, consumption, or use in the Kingdom within a commercial activity, whether for monetary compensation or without compensation.

Withdrawal: Any action aimed at preventing products from being offered in the market and in the supply chain.

Recall: Any action aimed at retrieving products that have been provided to the end user.

Front Protection: The presence of a specific front protective barrier, or part of the vehicle body or chassis, fixed at the front of the vehicle, or other components considered as front protective barriers, due to their shape and characteristics.

Rear Protection: The presence of a protective barrier or part of the vehicle body or chassis fixed at the rear of the vehicle, or other components considered as rear protective barriers either fully or partially, due to their shape and characteristics.

Side Protection: The presence of a side protective barrier, or part of the vehicle body or chassis fixed on the sides of the vehicle, or other components considered as side protective barriers, due to their shape and characteristics.

Truck: A vehicle for transporting goods or towing a trailer.

Tractor: The head of a truck (equipped with a towing plate); designed to tow a semi-trailer, and not equipped to carry weights other than the part resting on the semi-trailer.

Trailer: A vehicle designed such that no essential part of it depends on the towing vehicle (truck), and a small flatbed semi-trailer is considered a trailer.

Semi-Trailer: Designed to couple with a tractor via a towing plate, with part of its weight resting on the tractor.

Maximum Weight per Axle: The maximum weight specified by the manufacturer for each axle of the vehicle, measured at the point of contact of its tires with the road surface.

Category N: Motor vehicles with at least four wheels, designed and manufactured for transporting goods.

Category N2: Vehicles designed and manufactured for transporting goods with a maximum mass exceeding 3.5 tons but not exceeding 12 tons.

Category N3: Vehicles designed and manufactured for transporting goods with a maximum mass exceeding 12 tons.

Category O: Trailers (including semi-trailers).

Category O3: A trailer (including a semi-trailer) with a maximum mass exceeding 3.5 tons but not exceeding 10 tons.

Category O4: A trailer (including a semi-trailer) with a maximum mass exceeding 10 tons.

Competent Authorities: The entities legally authorized in the Kingdom to issue licenses for the manufacturing of the product and conducting the activity, and to apply the provisions of this Regulation.

Article (2) Scope

Previous Amendments

This Regulation applies to front, rear, and side protective barriers for trucks, trailers, and semi-trailers with a maximum weight exceeding 3.5 tons for trucks and trailers classified as (N2, N3, O3, O4). This Regulation does not include trucks and trailers used off-road, military trucks, and trucks designed for specific purposes where the installation of such barriers is not feasible.

Article 3 - Objectives

This Regulation aims to define the essential requirements for the products covered under its scope, and to establish the conformity assessment procedures that suppliers must adhere to, in order to ensure the compliance of this product and to maintain the health and safety of road users.

Article 4: Obligations of the Supplier

The supplier must, when manufacturing or importing trucks and trailers or semi-trailers, comply with the following requirements:

1) The front, rear, and side barriers covered by this regulation must meet the standard specifications outlined in Appendix No. (1).

2) Reflective light markings (strips) must be placed on the side and rear barriers, and they must be yellow in color and comply with the Saudi standard specification indicated in Appendix No. (1).

4/ 2/ 1 General Requirements

A) The factory must have a License to operate the activity from the relevant licensing authorities.

B) The manufacturer must cooperate with the Authority, licensing authorities, and relevant regulatory bodies, and provide them with all documents and data upon Claim.

C) Provide evidence that the factory has met the requirements stated in item 4/1 of this Regulation.

D) Admission that all information provided to the Authority is accurate and verified.

4/3 Metrological Requirements

The International System of Units (SI Units) or their multiples or subdivisions must be used during the design, manufacturing, or trading of products covered by this regulation.
