Regulations for Work Procedures and Litigation before the Committee for Reviewing Violations and Resolving Credit Information Disputes

Article 1: Definitions

Committee: Committee for Reviewing Violations and Resolving Credit Information Disputes.
General Secretariat: General Secretariat of the Committee for Reviewing Violations and Resolving Credit Information Disputes.
Consumer: A natural or legal person who has credit transactions.
Member: The government agency or private entity that is linked by a contract to exchange credit information with at least one credit information company.
Company: The credit information company licensed to collect and maintain credit information about consumers and to provide members with that information upon request.

Article 2

Previous Amendments
  • 1. The consumer's lawsuit shall not be accepted unless he submits - along with his statement of claim - proof of the rejection of his objection submitted to the company, provided that such objection pertains to the subject matter of the lawsuit presented to the Committee.

  • 2. The Saudi Central Bank shall prosecute before the Committee against those who violate the regulations.

Article 3

  • The filing of the lawsuit and the attachment of its documents, responding to the opponents' papers, and taking all necessary actions to proceed with the lawsuit and its consideration may be conducted through the electronic means provided by the General Secretariat, and in accordance with the announced terms and conditions, provided that what is submitted through those means has the effect of written documents.

Article 4

  • Among the tasks undertaken by the General Secretariat are the following:

    • 1. Registering the lawsuit, recording memoranda and documents, and setting session dates.

    • 2. Directing notifications, responses, and correspondence to the parties of the lawsuit and relevant entities.

Article 5

  • The General Secretariat shall notify the Defendant of the lawsuit, and the Defendant must submit their response to the lawsuit, supported by documents, within the period specified in the notification memorandum. The exchange of memoranda and responses between the parties to the lawsuit shall be conducted through the General Secretariat and within the deadlines set by it.

Article 6

  • 1. Notification of the lawsuit, documents, session dates, decisions, and others may be made by all available means.

  • 2. Proof may be presented before the Committee by all methods of proof, provided that they are consistent with the nature of the cases presented before the Committee.

Article 7

  • If the Committee deems it necessary to request any documents, information, or responses from any person, whether that person is a party to the case or not, or if the Committee decides to appoint any expert houses, whether they are available at the General Secretariat or outside of it, it shall record that in the minutes of the hearing, and the General Secretariat shall take the necessary procedures to implement it.

Article 8

  • The Secretary of the Committee prepares the minutes of its sessions, recording in the minutes the date and time of the opening and closing of each session, the location of the meeting, the names of the Chair and members of the Committee, and the parties to the case or their representatives. It also records all procedures, events, statements of the parties presented, their requests, and their defenses raised in the session, as well as the decisions issued by the Committee. The minutes are signed by the Chair of the Committee, its members, the Secretary, and the parties to the case or their representatives. If any party or their representative refuses to sign, this is noted in the minutes of the session.

Article 9

  • The Committee issues its decision unanimously or by a majority of its members' votes. In the event that the number of Committee members exceeds three and the votes are equal, the opinion voted for by the Chair of the Committee shall prevail.

Article 10

  • An appeal may be filed against the decisions of the committee before the Board of Grievances within (sixty) days from the date of notification of such decisions.
