Law of Protection of Heritage Manuscript in the Kingdom of Saudi Arabia

Article 1: Definitions

The following terms, wherever mentioned, indicate the meanings recorded next to them:
 A- Manuscript: It is a document that has been handwritten or typed, and has been in existence for fifty years or more, whether it has been published later or not, and whether it is in a public or private library, or with a specific entity or individual.
B- Library: It refers to the King Fahd National Library.
C- Restoration: The process of repairing damaged parts of the manuscript and preserving it in a technical manner that does not affect its scientific content.
D- Registration: The act of recording the descriptive data related to the manuscript in a special register of the library.
E- Indexing: The act of recording descriptive data about the manuscript by mentioning its title, subject, author, the era in which the author lived, its line count, number of pages, copyist, date of copying, and other information recorded on it; such as ownership, endowment, condition, and the artistic features it contains.

Article 2

The purpose of this Law is as follows:

  •  A- To preserve the existing manuscript heritage in the Kingdom.

  • B- To provide the library with a legal document that assists in requesting manuscripts from local authorities, libraries, and individuals by mutual consent; for the purpose of photographing them and making them available to researchers in one location.

  • C- To assist the library in issuing a national catalog of the manuscripts existing within the Kingdom, which will help provide information about them to researchers and others.

Article 3

The library operates as follows:

  • A- Acquiring original manuscripts through purchase, donation, or endowment.

  • B- Registering manuscripts preserved in official and private libraries, as well as those held by organizations and individuals, in a special register, and issuing registration certificates to manuscript owners from individuals and official and private libraries.

  • C- Coordinating with other technically qualified libraries in sterilizing manuscripts that require it, restoring, and maintaining them.

  • D- Photocopying all original manuscripts preserved in official and private libraries and owned by individuals, and keeping a copy within its collections to make them available to researchers. In case another copy is deposited in a special storage - which provides protection and security, it shall be located at a site at least four kilometers away from the library's location.

  • E- Cataloging the manuscripts existing in the Kingdom, and issuing a descriptive catalog for them, with the continuation of issuing successive catalogs for each collection after its cataloging is completed.

  • F- Exchanging manuscript images between various scientific bodies inside and outside the country.

Article 4

  • The Library Board of Trustees shall form a specialized committee to identify the manuscript heritage subject to protection in accordance with this Law, and to consider violations of its provisions. The Implementing Regulation shall specify the procedures for the work of this committee.

Article 5

 A- The library has the right to access manuscripts from private libraries, organizations, or individuals for the purpose of documentation.
B- The owner of the manuscript has the right to take it outside the Kingdom for the purpose of restoration, exhibition, or sale with the library's approval if the library or any other entity within the Kingdom does not wish to purchase it at the offered price, and the library shall inform the new owner.

Article 6

Anyone who violates the provisions of paragraph (B) of Article Five shall be punished with a fine not exceeding fifty thousand Riyals in accordance with Article Four of this Law. An appeal may be filed before the Board of Grievances within sixty days from the date of notification.

Article 7

The Board of Trustees of the Library shall issue the Implementing Regulation for this Law.

Article 8

This law shall be published in the official gazette and shall come into effect ninety days from the date of its publication, repealing all provisions that conflict with it.
