Project Registry Rules

Article 1

The following words and phrases are intended to mean the definitions indicated next to each:
Committee: Committee for the sale or lease of real estate units on the map.
Regulations: The regulations related to the sale or lease of real estate units on the map, issued by the Council of Ministers Decision No. (536) dated 4/12/1437 AH.
Rules: The rules issued by the Committee to organize the work of selling or leasing real estate units on the map.
Activity: The sale or lease of any real estate units on the map, regardless of their purpose, whether residential, commercial, investment, office, service, industrial, tourism, or others, and regardless of the method of their development or construction, in which the developer receives amounts from beneficiaries or project financiers.
Project: The construction works or land development aimed at selling or leasing real estate units on the map.
Real Estate Unit: The part segregated from the project, including portions of the undeveloped land if the project is for establishing infrastructure.
Developer: The person licensed to sell, lease, purchase, and develop real estate, as the main developer of the project.
Sub-developer: The person licensed to sell, lease, purchase, and develop real estate under an agreement with the main developer.
Beneficiary: The buyer or tenant of the real estate unit.
Map: A detailed engineering plan for the real estate units subject to sale or lease, approved by the competent authority.
Project Register: The register maintained by the Committee to organize and document contracts for the sale or lease of real estate units on the map in licensed projects, and the actions related to them.
Certified Accountant: The person licensed to perform accounting and legal auditing services.
Consulting Office: The licensed engineering supervision office authorized to provide engineering consulting services.
Guarantee Account: The bank account specific to the project where amounts paid by beneficiaries and project financiers are deposited.
Account Custodian: The banking institution licensed by the competent authority.

Article 2

1- These rules aim to regulate the registration of contracts for the sale or lease of real estate units on the map.
2- These rules do not violate the regulations related to the sale or lease of real estate units on the map.

Article 3

The Committee establishes a special register called the Projects Register, which includes the arrangement and documentation of sale or lease contracts for real estate units on the map in the licensed projects, as well as the actions related to them.

Article 4

Data for each licensed Project must be recorded in the Project register separately, and the following information must be included:
1- Name of the Project (if available).
2- Start date of the Project and its duration.
3- Location of the Project and its total area.
4- Development works or Projects of the licensed Real Estate, regardless of their nature, purposes, or the entity carrying them out.
5- Number of segregated Real Estate units and their types, along with their areas.
6- All common parts, facilities, and services.
7- Name of the main and subsidiary developer, if available.
8- Name of the consulting office supervising the Project, along with the attached contract related to it.
9- Name of the account custodian, along with the attached contract related to it.
10- Name of the legal accountant supervising the guarantee account, along with the attached contract related to it.

Article 5

1- The Contract for the Real Estate Unit shall be registered in the Projects Register after verifying the submitted documents and recording all contracts.
2- The developer must provide the Committee with a copy of the Contract for the Real Estate Unit within ten days from the date of signing the contract, indicating the unit number, contract price, payments, due dates of installments, and the obligations of the developer and the beneficiary, for the purpose of registering the contract in the Projects Register.
3- The beneficiary is entitled to obtain a certificate of registration for the unit, stating the area of the unit, the common parts, facilities, and services, the value of the unit, the number of installments, and the date of their completion, after the Committee's approval of the registration.
4- Upon the developer's completion of selling or leasing all units, this shall be recorded in the Projects Register, and a note shall be made indicating the completion of the project.

Article 6

The committee has the authority to amend any provision of these rules, and the amendments shall not take effect until they are published.

Article 7

These rules shall come into effect from the date of their publication.
