Rules of Endowment-owned Zakat Payer to be Not Subject to Zakat Collection

Article I

Terms and expressions used herein shall have the meaning ascribed thereto in Article (1) of the Executive Regulation for the Collection of Zakat issued by the resolution of Minister of Finance No. (2216) dated 07/07/1440 H, unless otherwise required by the context.

All provisions mentioned in the Bylaws of Transfer Pricing issued by the resolution of ZATCA’s Board of Directors No. (6-1-19) dated 25/05/1440 H and any amendments thereto shall be applied to all existing transfers with relevant entities, endower, heirs, Council of Guardianship, and any other beneficiaries of the endowment or endowment-owned zakat payer.

Article IV

  • 1- Zakat payer shall submit –on an annual basis- a request to become not subject to zakat collection in accordance with the prepared form by ZATCA for such purpose, and shall attach all document required by ZATCA.

  • 2- Zakat payer shall submit a request to become not subject to zakat collection within the legal period illustrated in Article (17) of the Regulations. Such request shall include data declaration, and ZATCA may accept late requests if zakat payer submits reasonable justifications.

  • 3- After ZATCA examines the request and verifies the fulfillment of all regulations, zakat payer may receive a ruling not to be subject to zakat collection.

  • 4- If the endowment own more than one zakat payer, or if the endowment-owned zakat payer fully owns another zakat payer, then, each zakat payer shall submit an independent request to become not to be subject to zakat collection.

Article V

Except as provided herein, all remaining provisions contained in the Regulations shall be applied to the zakat payer for whom a ruling not to be subject to zakat collection was issued.

Article VI

If it has been proven by ZATCA that the zakat payer has provided incorrect information or fails to abide by the provisions hereof, ZATCA may cancel such ruling, and reassess such zakat payer based on the available information in accordance with provisions of the Regulations.
