The Committee for Reviewing Violations of Domestic Pilgrims Service plays a fundamental role in enhancing the Ministry's oversight of the Hajj sector. Therefore, this guide aims to:
1. Serve as a primary reference to clarify the jurisdiction of the main committee and the subcommittees, their operational mechanisms, and the classification of violations and penalties.
2. Contribute to informing those assigned to work in the committee about the committee's jurisdiction, operational mechanisms, and the tasks required of them.
3. Assist in measuring the extent of compliance of the committee members with the regulations, rules, and instructions when carrying out their duties or issuing their decisions, and the appropriateness of those procedures in accordance with the stipulated regulations, rules, and instructions.
The Domestic Pilgrims Service System issued by Royal Decree No. (M/ 85) dated 28/ 10/ 1426 AH, amended by Royal Decree No. (M/ 9) on 25/ 6/ 1445 AH, its executive regulations issued by Ministerial Decision No. (440922150) dated 24/ 9/ 1444 AH, and the instructions implementing them.
This guide has been prepared based on paragraph (4) of Article Nineteen of the Law on Domestic Pilgrims' Services issued by Royal Decree No. (M/58) dated 28/10/1426 AH, which states that "the implementing regulation of this law shall determine the procedures for the work of the committee and the time required to complete its tasks," and what is stated in paragraph (4) of the first section of Article (Fourteen) of the implementing regulation of the law, which states that "the Ministry shall prepare a guide for the procedures of the investigation and the work of the main committee and the sub-committees, as well as the classification of violations and their corresponding penalties."
The evidence came to define the course of the committee's work and its stages, starting from the initial phase of determining the legal bases for the committee and receiving complaints and violations reported by the relevant authorities. This is followed by the verification stage of those complaints and violations that have been received, through a series of sequential procedures, leading to the stage of issuing decisions and submitting them to His Excellency the Minister of Hajj and Umrah for approval.
The evidence targets all those obligated to work in the Committee for Reviewing Violations of Domestic Pilgrims.
The evidence is approved by His Excellency the Minister of Hajj and Umrah, and it shall be effective from the date of its approval.
A Committee to consider violations by domestic Hajj service providers is formed based on paragraph (1) of Article Nineteen of the Law on Domestic Hajj Services, which states that "A decision by the Minister of Hajj and Umrah shall establish one or more committees - as needed - consisting of three members from the Ministry of Interior, the Ministry of Hajj and Umrah, and the Ministry of Commerce, specialized in legal and Sharia aspects, with ranks not less than the eighth, to consider violations by the licensed parties of the provisions of this law and their failure to meet their obligations towards the pilgrims contracted with them, investigate these violations, refund the value of services not rendered or that may affect the performance of Hajj rituals for the pilgrims, and determine appropriate penalties for the violators, with the decisions of the committee being ratified by the Minister of Hajj and Umrah."
