In this Law, the following words and phrases shall have the meanings assigned thereto, unless the context requires otherwise:
Law: Product Safety Law. Regulations: Implementing Regulations of the Law, and other regulations issued pursuant to its provisions.
Organization: Saudi Standards, Metrology, and Quality Organization.
Board: Board of Directors of the Organization.
Governor: Governor of the Organization.
Committee: Committee for reviewing violations of the provisions of the Law and the Regulations.
Market Surveillance: Any task carried out by the competent authorities to ensure that products are in compliance with the provisions of the Law and the Regulations.
Competent Authorities: Authorities in charge of market surveillance in accordance with the provisions of the Law and the Regulations.
Product: Any product placed or made available on the market.
Product Category: A set of products that share specific characteristics and properties.
Placing on the Market: To place a product on the market.
Making Available on the Market: Any supply or advertisement of a product for the purpose of distribution or consumption in the context of a commercial activity, whether with or without financial consideration. Consumer: A natural or legal person who uses a product.
Supply Chain: All the stages a product goes through until the end use thereof.
Manufacturer: A natural or legal person that manufactures a product or entrusts the manufacture thereof to another natural or legal person then markets such product under his name or his trademark.
Authorized Representative: A natural person, or a legal person established in the Kingdom, authorized by a manufacturer outside the Kingdom to act on his behalf in accordance with legal procedures.
Importer: A natural or legal person that imports a product from outside the Kingdom into any of its markets.
Distributor: A natural or legal person in the supply chain, other than the manufacturer and the importer, that makes a product available on the market or provides, in the field of the commercial activity, at least two of the following services without being the owner of the product: warehousing, packaging, address labeling, and shipment preparation. A distributor shall not include any person that provides any of the following services: postal services, package delivery services, and cargo transportation services.
Economic Operator: A manufacturer, authorized representative, importer, or distributor.
Technical Regulations: Regulations adopted by the Board that set the requirements and essential requirements to be mandatorily applied to a specific product or product category in accordance with the provisions of the Law.
Requirements: All rules, methods, and procedures to be complied with in accordance with the provisions of the Law, including the essential requirements.
Essential Requirements: Requirements and outcomes relating to safety, health, and the environment that must be met, or relating to hazards and risks that require action.
Standard: An approved document that sets the rules, instructions, or properties of products or the processes and production methods related thereto; compliance with such document is not mandatory.
Saudi Standard: A standard approved by the Board and considered a national standard of the Kingdom.
National Standard: A standard adopted by a standardization body in a particular country.
Regional Standard: A standard adopted by a regional standardization body.
International Standard: A standard adopted by an international standardization body.
Conformity Assessment: Verifying that a product, service, process, or procedure meets the requirements and essential requirements.
Conformity Assessment Procedures: Procedures used for conformity assessment, including calibration, testing, certification, and inspection.
Notified Bodies: Conformity assessment bodies that are recognized by the Organization in accordance with the provisions of the Law and the Regulations.
Declaration of Conformity: A document issued by the person in charge of placing a product on the market prior to placement thereof, in which he certifies under his responsibility that the product meets the requirements.
Conformity Index: A tool that determines the percentage of products on the market that conform to all applicable obligations and essential requirements.
Hazard: Any property, action, or omission that endangers or is likely to endanger consumer safety, property, or the environment.
Risks: The likelihood of the occurrence of a hazard and the severity thereof, including cases in which the effects are not likely to be apparent or immediate.
Risk Assessment: The process of identifying any hazard presented by a product and the measures to be taken to prevent, eliminate, mitigate, or control such hazard.
Serious Violation: A violation that could cause serious harm to the health and safety of the consumer, or to property or the environment. Inspector: A person appointed by a Board decision to detect and record any violation of the provisions of the Law and the Regulations.
Tracking System: A system that enables the identification and tracking of a product and the economic operator involved in its supply chain. Such system includes developing electronic solutions and affixing labels to products or the packages thereof, or including accompanying documents if affixing labels to the products is not feasible. Corrective Measures: Actions taken to prevent, mitigate, or eliminate safety hazards
Product Recall: A procedure that aims to retrieve products previously placed on the market or made available to the end user.
This Law aims to protect consumers by preventing hazards associated with products placed or made available on the Kingdom's markets, and by indicating the manner in which the hazards and risks associated with such products are to be addressed.
The provisions of this Law shall apply to all products, including products circulated through electronic means. The provisions of this Law shall not, however, apply to products under the jurisdiction of the Saudi Food and Drug Authority.
For the application of the provisions of this Law, the following principles shall be observed:
1. Non-discrimination between local and imported products placed or made available on the market, in terms of compliance with the technical regulations.
2. Proportionality of the requirements, corrective measures, and penalties prescribed under this Law with the severity of the hazard and the gravity of the violation.
3. Effective coordination and cooperation between all entities concerned with the application of this Law.
4. Transparency in the application of the provisions of this Law, and engaging all stakeholders.
The manufacture, import, marketing, circulation, or advertising of unsafe products shall be prohibited.
1. A product shall be deemed safe if, under normal conditions of use, it poses no hazard, or the risks it may cause are reasonable and meet the specified safety levels that ensure the safety of the consumer, property, and the environment; meets all essential requirements; and complies with the technical regulations.
2. In the absence of essential requirements or relevant technical regulations, a product shall be deemed safe if it conforms to Saudi standards, if available, or to relevant regional or international standards.
Upon assessment of the safety of a product on the market, the following shall be taken into consideration:
1. Product properties, including its composition, and the instructions for its use, installation, and repair.
2. Effect of the product on other products if used together.
3. Product presentation, clarity of labeling, usage instructions and warnings, disposal instructions, and any other indicators and information related to the product.
4. Consumers who may be exposed to hazards when using the product.
5. The reasonable safety expectations of consumers when using the product.
