Chapter 1: Definitions

Article (1): Definitions

  • The meanings of the following words and phrases, wherever they appear in this case, are as defined next to each of them, and references to the singular apply to the plural and vice versa, unless the context requires otherwise:

  • The Kingdom: The Kingdom of Saudi Arabia.

  • The Federation: The Saudi Football Federation.

  • The Council: The Board of Directors of the Saudi Football Federation.

  • The International Federation: The International Football Federation (FIFA).

  • The Law: The Basic Law of the Saudi Football Federation.

  • The Regulation: The Regulation of the Dispute Resolution Chamber of the Federation, which is the organizational and procedural framework of the chamber.

  • The Chamber: The Dispute Resolution Chamber of the Federation.

  • The Clubs: A sports institution or company with a legal personality officially licensed by the General Panel for Sports and recognized by the Federation.

  • The General Secretariat: The General Secretariat of the Federation.

  • The Association: An organization with legal personality administratively, financially, and organizationally, recognized by the Federation.

  • The Professional Clubs League Associations: Representing the Saudi Professional League Association and the Saudi First Division League Association, responsible for organizing and managing the professional league.

  • The Saudi Sports Arbitration Center: The authority responsible for reviewing and deciding on objections submitted against the decisions of the chamber in accordance with its law and procedural rules.

  • The Game: The game of football.

  • The Player: A Saudi or non-Saudi player registered with any club affiliated with the Federation in a professional capacity.

  • The Intermediary: A natural or legal person, Saudi or foreign, licensed by the Federation or international federations, representing players and/or clubs in negotiations aimed at concluding an employment contract or representing clubs in negotiations aimed at concluding a transfer, re-transfer, or renewal agreement for a financial consideration or free of charge.

  • The Parties: The parties to the dispute or their legal representatives.

  • The Member: A member of the Dispute Resolution Chamber of the Federation.

  • The Sports Season: The period during which competitions, tournaments, and official and friendly matches organized and determined by the Federation or sports associations take place.

  • The Ordinary Majority: The total votes exceeding half of the present members who have the right to vote.

 

Chapter 2: Applicable Law, the Principles on which the Regulation is Based, and its Scope of Application

Article 2: The Legal Foundations on which the Chamber is Based

  • The chamber is an arbitration body aimed at achieving justice and preserving the rights of the parties, and it bases its operations and competencies on the following:

  • 1. The contracts and agreements concluded between the parties, unless they contravene the public order stipulated in local or international laws and regulations, the Professional Regulations, the Status and Transfer of Players by the Federation, and the Federation's Articles of Association and its regulations.

  • 2. The regulations of the International Federation in the absence of a text regarding the dispute under consideration.

  • 3. The customary sports rules related to football.

Chapter 3: Jurisdiction of the Chamber, Its Composition, Meetings, and Decisions

Article 5: Jurisdiction of the Chamber

  • 1. The chamber is responsible for examining and resolving disputes between clubs and/or players and/or agents and/or coaches, including the following:

    • 1/ 1 The safety and stability of all aspects of the professional contract.

    • 1/ 2 Any dispute between clubs, specifically:

      • 1/ 2/ 1 Compensation for training at the local level.

      • 1/ 2/ 2 Solidarity contribution at the local level.

      • 1/ 2/ 3 Transfer values.

    • 1/ 3 Contracts of agreements between players or agents with clubs and/or players and/or coaches and related matters.

  • 2. If the chamber finds that it is not competent to examine the dispute, it shall issue its decision regarding jurisdiction, and this decision may be appealed regardless of the value of the dispute.

  • 3. In case of doubt regarding jurisdiction in a case between the Professional Committee and the Players' Status Committee of the Federation and the chamber, the Chairman of the Professional Committee and Players' Status Committee in the Federation shall decide on the competent authority to examine the case.

  • 4. No claim shall be heard before the chamber in any dispute according to the provisions of this regulation after the lapse of two Gregorian years from the date of termination of the contractual relationship that gave rise to the entitlement.

Article 6: Formation of the Chamber, its Headquarters, and the Official Language

  • 1. The chamber exercises its functions and competencies in accordance with the equal representation between representatives of clubs and players.

  • 2. The chamber consists of a president, a vice president, and a maximum of six other members.

  • 3. The president of the chamber and his deputy must hold legal qualifications in accordance with the conditions specified in this Regulation, and they are appointed by the Council.

  • 4. Three members represent the professional clubs, nominated by the Professional Clubs League from a proposed list of at least five individuals selected by the Council, provided that no single club has more than one representative.

  • 5. Three members represent the professional players, nominated by the Professional Players Association from a proposed list of at least five individuals selected by the Council.

  • 6. The term of office for the members of the chamber lasts for four years and is renewable.

  • 7. The Federation shall be the headquarters of the chamber.

  • 8. Arabic is the official language of the chamber.

Article (7): Conditions Required for the President and Vice President of the Chamber

  • 1. Must hold an academic qualification of at least a university degree in Sharia or Law.

  • 2. Must have experience in the field of legal consulting, law practice, or legal affairs for no less than ten years.

  • 3. Must have complete familiarity and knowledge of the regulations and rules related to the sport of football in general, and professional sports in football in particular.

  • 4. Must not be a member of the Council.

  • 5. Must not be a member of the Board of Directors of any club, or engage in any work therein, whether full-time or part-time, and whether on a permanent or temporary basis.

  • 6. Must be recognized for competence, good reputation, and good conduct and behavior.

  • 7. There must be no legal impediment preventing him from performing his duties if he works in the public or private sector.

  • 8. Must not hold membership in the chamber and membership in any of the permanent or judicial committees of the federation or the professional clubs league.
