Article (1) – Definitions
The following terms and expressions - wherever they appear in this Executive Regulation – shall have the meanings set forth below, , except where it is therein expressly otherwise:
Law: Environmental Law.
Executive Regulation: Executive Regulation for Controls and Procedures Pertaining to Financial Dues for Environmental Licenses, Permits, and Services.
Ministry: Ministry of Environment, Water and Agriculture.
Minister: Minister of Environment, Water and Agriculture.
Fund: Environment Fund.
Competent Center: The National Center for Environmental Compliance, the National Center for Vegetation Cover and Combating Desertification, or the National Center for Wildlife Development.
Founding Regulations: Founding regulations of the competent center. Person: Any public or private natural or legal person.
Activity: Any industrial, commercial, or service-related facility, project, business, or other activities that are expected to have an environmental impact.
Permit: A document issued by the competent center to a person before undertaking any activity.
Environmental Permit for Operation: A document issued by the National Center for Environmental Compliance to a person before operating or undertaking any new activity; or in order to resume or continue operating an existing activity.
License: A document issued by the competent center authorizing a person to undertake an environmental activity.
Environmental Services: Services provided by the competent center to persons, such as reviewing studies submitted to the Center and others.
Financial Dues: An amount of money collected by the competent center from a person for the purpose of issuing or renewing licenses or permits or for providing environmental services.
Environmental Impact Coefficient: Coefficient set by the National Center for Environmental Compliance based on the environmental impact of types of activities, such as mining, energy, industry, and other activities. This coefficient is utilized to compute the financial dues for the environmental permit for operation in accordance with the provisions of this Executive Regulation.
Activity’s Environmental Compliance Coefficient: Coefficient set by the National Center for Environmental Compliance for each activity based on the level of its environmental compliance. This coefficient is utilized to compute the financial dues for the environmental permit for operation operate in accordance with the provisions of this Executive Regulation, and is aimed at promoting environment-friendly practices.
Financial Dues Charter: Document issued by the competent center that shows the financial dues’ computation mechanism for each category of activities, the amounts thereof, the collection mechanism, and any related requirements, in accordance with the provisions of this Executive Regulation.
