Regulations on the Marriage of a Saudi Male to a Non-Saudi Female and a Saudi Female to a Non-Saudi Male

Article 1

Marriage between a Saudi and a non-Saudi, or a Saudi woman and a non-Saudi man, is prohibited if they belong to the following categories:
1- Ministers and those of equivalent rank, holders of the excellent rank, and those in the fourteenth and fifteenth ranks.
2- Members of the judiciary in the Ministry of Justice, Board of Grievances, and Notaries.
3- Employees of the Royal Court and the Council of Ministers, and members of the Shura Council.
4- Diplomatic and administrative employees of the Ministry of Foreign Affairs.
5- Employees working outside the Kingdom.
6- Members of the armed forces in the Ministry of Defense and Aviation, the National Guard, and the Internal Security Forces, whether they are officers or individuals.
7- Those working in investigations and general intelligence, whether military or civilian.
8- All students studying abroad, whether they are sponsored by the government or studying at their own expense.
9- Chairpersons of joint-stock companies and appointed members of companies.
10- Employees of the Ministry of Defense and Aviation, the Ministry of Interior, and the National Guard in all their sectors, both civilian and military.
11- Members of the Public Prosecution and Investigation Authority.
12- Customs employees.
13- Employees holding positions of special importance as deemed by their authorities.

Article 2

The approval of marriage requests submitted by individuals not belonging to the categories mentioned in Article One shall be granted with the permission of the Minister of Interior or his delegate, for nationals of Arab and Islamic countries, and, when necessary, for nationals of other countries in accordance with Sharia regulations.

Article 3

Marriage between Saudis and citizens of the Gulf Cooperation Council (GCC) countries is permitted, provided that they are not from the categories subject to prohibition as stipulated in Article One of this Regulation. The diplomatic missions shall verify the profession and ensure that there are no remarks against the individuals, and they will issue their approval to the relevant authorities to complete the contract procedures. When documenting the contract, the competent Sharia Court for residents within the Kingdom shall ensure compliance with what has been indicated prior to the execution of the contract.

Article 4

Children born in the Kingdom to Saudi mothers and non-Saudi fathers must have their marriage documentation procedures with Saudi nationals completed in the Sharia courts in the Kingdom, provided that the Saudi national is not seeking to marry individuals from the categories prohibited as stated in Article One.

Article 5

A Saudi national is permitted to marry a non-Saudi woman born in the Kingdom to non-Saudi parents, provided that her birth certificate is issued from the birth registry in accordance with the Civil Status System and that she holds a valid residency permit or a special authorization. Additionally, the marriage applicant must not belong to the prohibited categories specified in Article One.

Article 6

The Saudi who wishes to marry a non-Saudi or the Saudi woman who wishes to marry a non-Saudi must ensure that the non-Saudi individual is not undesirable for reasons related to their character, nationality, or religion. This includes individuals belonging to beliefs that are not recognized by Islamic law.

Article 7

The Sharia courts in the Kingdom are responsible for ensuring the fulfillment of the conditions mentioned in the previous articles and applying them before the marriage contract is documented. The Saudi representations are responsible for verifying what is stated in Article Six.

Article 8

A Saudi national married to a non-Saudi is prohibited from holding any of the positions specified in Article One.

Article 9

  • Any marriage that is found by the competent authority to be in violation of the previous provisions shall result in the following:

    • A- Disciplinary trial of the married individual before the Board of Grievances.

    • B- Non-registration of the marriage by the competent Saudi authorities.

    • C- Prohibition of entry for the foreign spouse into the Kingdom and termination of their residency if they are residing within the Kingdom.

Article 10

The Minister of Interior has the authority to approve marriages that are conducted in violation of the provisions of Article Two, while those exempted under Article One may only have their marriages approved based on an order from the High Authority.
