Regulations for Domestic Service Workers and Those Equivalent to Them

Article 1

Previous Amendments

The following terms - wherever they appear in this Regulation - shall have the meanings specified next to each, unless the context requires otherwise:
Regulation: Regulation of domestic workers and those in similar positions.
Minister: Minister of Labor.
Home: The place where the family resides permanently or temporarily.
Employer: Any natural person who has personally recruited a domestic worker, either directly or through a licensed recruitment office, or has contracted with them - directly or indirectly - to perform domestic services.
Family: The employer and the individuals who live with them in their home, and are related to them by blood, marriage, or for whom they provide care for any legal or moral reason.
Domestic service: The direct or indirect personal service provided by a domestic worker to the employer or any member of their family in exchange for wages.
Domestic worker: Any natural person who provides direct or indirect domestic service to the employer or any member of their family, and is under the supervision and direction of the employer or their representative while performing the service, such as a housemaid, domestic worker, private driver, gardener, or housekeeper, and those in similar positions. When the term domestic worker is used in this Regulation, it refers to domestic workers and those in similar positions.
Wage: The amount received by the domestic worker at the end of the month in exchange for the work agreed upon in the contract.
Committee: The committee specified in this Regulation that resolves disputes arising from its application.
Parties: The employer and the domestic worker.

Article 2

The employer shall not assign the domestic worker tasks other than those agreed upon in the contract, or require them to work for others.

Article 3

1- The employment relationship between the domestic worker and the employer is organized by a written contract, and the Arabic text of the contract is relied upon for proof.
2- The contract and its translation - if available - are prepared in three copies, with each party retaining one copy and the third deposited with the private recruitment office.

Article 4

The Contract must include, in addition to other terms agreed upon by the Parties, and in a manner that does not conflict with the provisions of this Regulation, the following essential elements:
1- The type of work that the domestic service worker is obligated to perform.
2- The wage that the employer is obligated to pay to the domestic service worker.
3- The rights and obligations of the Parties.
4- The trial period.
5- The duration of the Contract and the method of its extension.

Article 5

1- The parties may agree to place the domestic worker on a trial period not exceeding (ninety) days, during which the employer has the right to verify the professional competence of the domestic worker and the appropriateness of their personal conduct.
2- The employer may terminate the contract unilaterally during the trial period without any liability, if it is proven that the domestic worker is inadequate.
3- A domestic worker may not be placed on trial more than once with the same employer, unless the parties agree that the domestic worker will perform a different job from their initial one.

Article 6

The domestic service worker is obligated to the following:
1- To perform the agreed-upon work and to exercise the care of a reasonable person.
2- To follow the orders of the employer and the family members related to the execution of the agreed-upon work.
3- To maintain the property of the employer and the family members.
4- Not to harm family members, including children and the elderly.
5- To keep the secrets of the employer, family members, and individuals in the household, which he/she becomes aware of during or as a result of work, and not to disclose them to others.
6- Not to refuse work or leave the service without a legitimate reason.
7- Not to work for his/her own account.
8- Not to disrespect the dignity of the employer and family members, and not to interfere in their matters.
9- To respect Islam, comply with the regulations in force in the Kingdom, and adhere to Saudi community customs and traditions, and not to engage in any activity that harms the family.

Article 8

The domestic worker is entitled to a weekly day of rest as agreed upon by the parties in the contract.

Article 9

Deductions from the wages of a domestic worker are not permitted except in the following cases, and shall not exceed half of the wage:
1- Costs of what has been deliberately or negligently damaged.
2- An advance received from the employer.
3- Execution of a judicial judgment or administrative decision issued against him, unless it has been stipulated in the judicial judgment or administrative decision that the deduction exceeds half of the wage.

Article 10

A domestic worker is entitled to a paid leave of one month if they have completed two years and wish to renew for a similar period.
