Implementing Regulations for Non-Governmental facilities for people with disabilities

Article 1:

1. The terms and expressions defined in Article 1 of the regulation on non-governmental social facilities for people with disabilities, issued by the Council of Ministers Decision No. (691) of 17/8/1445 H (27/2/2024), shall, whenever referenced in these Rules, retain the same meanings as specified in the regulation, unless otherwise indicated by the context.

2. The following terms, whenever mentioned in these Rules, shall have the meanings assigned herein unless the context otherwise requires:

Rules: The Implementing regulations governing non-governmental facilities for people with disabilities.

Guide: A comprehensive reference document outlining detailed requirements and procedures, issued in accordance with the these rules, as stipulated in Article 15 thereof.

Section: A designated unit within a social facility that provides social services to people with disabilities, classified by age group, category or gender.

1. The facility is prohibited from providing any service prior to obtaining a valid license.

2. A facility seeking to offer additional services and programs shall obtain the necessary licenses from the competent authority and submit these to the general management of licensing prior to providing the service.

Article 5:

The license shall be valid for a period of five years.

Article 6

License renewal requires the following:

1. Submission of a license renewal application no later than 180 days prior to the expiration of the current license period.

2. Compliance with all requirements specified in the Guide.

3. Fines shall be paid (if applicable).

4. Payment of any required fees.

Article 7:

A facility seeking to amend an issued license must:

1. Submit an application specifying the type of amendment; including any of the following: transfer of ownership, relocation of headquarter, reclassification (per the classifications outlined in Article 2 of these Rules), change in activity, addition of an activity, or the modification of facility capacity.

2. Compliance with all requirements specified in the Guide.

3. Fines shall be paid (if applicable).

4. Payment of any required fees.

Article 8:

Without prejudice to the provisions of these Regulations and other statutory provisions, the facility must notify the general management of licensing of any changes made to the licensed facility

Article 9:

The facility shall inform people with disabilities, benefiting from its services or their guardians (as applicable), of any modification to its license and its fulfilment of obligations to them. The facility must also notify the general management of licensing of fulfilling these obligations at least 90 days prior to the amendment.

Article 10:

1. The license shall be revoked under the following circumstances:

a) Upon submission of an application by the facility requesting license revocation.

b) In the event of the licensee's death.

c) Upon issuance of a penalty resulting in license revocation.

d) If the licensee no longer meets one or more of the licensing conditions.

2. For voluntary cancellations as provided for in this Article (10) paragraph (1) Clause (A), the following conditions must be met by the facility prior to revocation:

a) Payment of any outstanding fines, if applicable.

b) Provision of evidence demonstrating that beneficiaries have been informed of the revocation.

c) Provision of evidence confirming fulfillment of all obligations to the beneficiaries.
