Article 2

The products included in the Law and Regulation encompass all categories that are placed or displayed in markets or through electronic means, whether they are new, used, previously repaired or refurbished, in the form of raw materials or processed, tangible or intangible, or products integrated into another category or non-transferable products. This includes products that are placed or presented to the consumer in the context of providing services.

Article 3

The provisions of the Law and the Regulation apply to products offered in the markets through electronic means, including telephone, fax, mail, and the website.

Article 4

The products displayed in markets or through electronic means are considered to be offered from the moment they are targeted at the consumer in the Kingdom.

Chapter 3: Public Safety Obligations

Article 5

  • When assessing whether a product is safe, the following must be considered:

    • 1- The characteristics of the product, including its design, technical features, composition, packaging, and the conditions of its assembly, installation, use, repair, and maintenance.

    • 2- The impact on other products if the product being assessed is expected to be used with other products, or the impact of other products on it, or if it is expected to be used with other products, including the effect of non-included elements intended to determine, change, or complete the operation of the product being assessed.

    • 3- The appropriate cybersecurity features necessary to protect the product from external influences, as required and according to the nature of the product or its developmental, educational, and predictive functions.

    • 4- The presentation of the product and the identification labels, including labels for the appropriate age for children, and any warnings and instructions regarding the safe use and disposal of the product, as well as any other guidelines or information related to it.

    • 5- The categories of product users, by assessing the risks that vulnerable groups of consumers, such as children, the elderly, and individuals with disabilities, may face.

    • 6- The appearance of the product that may lead the consumer to use it in a manner other than it was designed for.

    • 7- Saudi specifications, national specifications, Gulf specifications, and international specifications.

    • 8- The product obtaining a voluntary conformity certificate according to certification grant programs, or according to similar conformity assessment processes from third-party entities.

    • 9- Recommendations or guidelines from the authority regarding the assessment of product safety.

    • 10- The latest technological developments, including the opinions of recognized scientific bodies and specialized committees.

    • 11- Good practice guidelines applicable to product safety in the relevant sector.

Article 6

  • The products that are placed or displayed in the markets are supposed to comply with the following:

    • 1- The requirements stated in the applicable technical regulations for the concerned products, and the general safety requirements stipulated in the law and regulations, in case the risks and categories of risks to which they are exposed are covered by those regulations, and they conform to Saudi specifications.

    • 2- The assumption of conformity does not prevent the competent authorities from taking the necessary measures under the law and regulations if it is proven that the product is unsafe despite this assumption.

Article 7

When any economic operator offers a product in the markets, online, or through electronic means, the offer must clearly include any warnings or information related to the safety of the product or packaging, or in a document attached to the product in accordance with this Regulation.
