Regulations for the Election of Heads of Crafts and Professions and Their Deputies

Article 1: Definitions

  • The following terms and phrases, wherever mentioned in this regulation, shall have the meanings indicated next to each of them, unless the context requires otherwise:

    • 1- Ministry: Ministry of Municipalities and Housing.

    • 2- Minister: Minister of Municipalities and Housing.

    • 3- Law: Law of Municipalities and Rural Areas.

    • 4- Trustee/ Mayor: The authorized person under whose supervision falls the group of craftsmen and professionals.

    • 5- Municipality/ Municipal Authority: An entity with a legal personality and financial and administrative independence that performs the functions assigned to it under the laws and regulations.

    • 6- Craft or Profession: A skilled work that requires expertise and skill, practiced by the craftsman or professional after a sufficient period of training, education, and gaining experience.

    • 7- Members of Crafts and Professions: All craftsmen or professionals from the practitioners of a single activity or brokers or traders who own shops at various skill levels, licensed by (municipalities/ municipal authorities).

    • 8- Head of Craft and Profession: A natural person elected to head the members of the craft or profession and to look after their interests.

    • 9- Deputy Head of Craft and Profession: A natural person elected to carry out the duties of the head of the craft or profession according to the provisions contained in this regulation.

    • 10- Nomination Approval: A document issued by the ministry allowing the head of the craft or profession or his deputy to perform the duties of the presidency for a specified period.

    • 11- Headquarters: The permanent address for the head of the craft or profession or his deputy to perform his duties.

    • 12- Relevant Authorities: All entities related to the work of the craft and profession.

    • 13- Supervisory Committee: The committee that supervises the elections of the heads of crafts and professions and their deputies.

    • 14- Appeals Committee: The committee specialized in considering the objections of candidates to the procedures or results of the elections.

    • 15- Group: A group that includes the practitioners of the craft or profession, brokers, or shop owners.

Article 2

1- The Ministry is responsible for approving the nomination of heads of crafts and professions and their deputies, and their cancellation.

2- The Secretariat/Municipality is responsible for monitoring and implementing the articles and instructions of this regulation.

Article 3: Designation of Sects

1- The municipality determines the names of the guilds after they are periodically approved by the Ministry according to the availability of the guild's crafts and professions within its scope.

2- The municipality publishes the names of the guilds on its website.

Article 4: Candidate Conditions

First: The candidate must meet the following conditions:

1- Must be Saudi.

2- Must not be a government employee currently in service.

3- Must be a resident of the city where the activity is practiced and reside there permanently.

4- Must not have been previously convicted of a crime involving dishonor or breach of trust unless rehabilitated, and must provide a declaration to that effect.

5- Must have been actively practicing the craft or profession for which they are nominated for presidency for no less than five years for the activity/activities specified in the commercial activity license according to the National Economic Activities Guide, and must provide a declaration to that effect.

6- The vice president must have been actively practicing the activity for no less than two years for the activity/activities specified in the commercial activity license according to the National Economic Activities Guide, and must provide a declaration to that effect.

7- Must be able to perform the duties of the profession or craft.

8- Must hold a high school diploma or its equivalent, at a minimum.

9- Must be at least 30 years old and not more than 65 years old.

10- A headquarters must be provided for managing the affairs of crafts and professions, to perform the president's duties and determine working hours.

11- Must present an electoral program for organizing and developing the craft and profession, and must commit to implementing it after approval by the municipality.

Second: The secretary/municipality president may exempt some candidates from the age and qualification requirement with a justified decision.

Article 5: Mechanism of Elections and Nomination

Article 6: Voting Mechanism

1- Voting is conducted through ballot boxes, and modern technology means may be used in the election process as an auxiliary method according to what the Supervisory Committee decides.

2- The Supervisory Committee at the Secretariat/Municipality determines the date and place of voting according to its decision, provided that the date is set sufficiently before the end of the presidency term (President/Vice President).

3- Each voter has one vote, and if more than one candidate is selected, the vote is canceled.

Article 7: Prohibitions of Candidacy

Article 8: Termination of the Presidency of the President or his Deputy

The presidency of the President or his Vice President ends in the following cases:

1- Medical incapacity and inability to perform duties or death, and the (Secretariat/Municipality) assigns the management of tasks to the Vice President until a new President for crafts and professions is appointed.

2- Medical incapacity and inability of the Vice President to perform duties or death, and the Secretariat/Municipality appoints a new Vice President for crafts and professions.

3- Upon submission of resignation, provided that notification is given no less than three months from the date of submission.

4- Upon issuance of a judicial conviction in any case involving dishonor or breach of trust.

Article 9: Term of Office of the President or Vice President

1- Four years from the date of the candidate's approval (President/Vice President).

2- The competent secretariat shall address the Ministry to extend the presidency term for one year, according to the performance level of the craft and profession president in performing his duties.

3- The president of the craft and profession and his deputy may run for consecutive terms if they meet the nomination conditions.

Article 10: Jurisdictions of the Heads of Crafts and Professions or Their Deputies

1- Representing members of crafts and professions before all official entities.

2- Addressing and resolving problems or disputes that may arise between members of crafts and professions among themselves or with those they deal with.

3- Field supervision of the practices of craft and profession members in terms of their compliance with the texts regulating the affairs of the craft or profession.

4- Deciding on technical problems based on his craft or professional expertise.

5- Supporting municipalities and related entities in regulating markets and dealings with members of crafts and professions.

6- Assisting (supporting) members of crafts and professions and all affiliated with them in issuing licenses.

7- Systematic registration of databases, and continuous updating to meet the documentation requirements for the affairs of the craft or profession and its dealings.

8- Qualifying and developing members of crafts and professions with modern methods in practicing the craft or profession, through programs and training courses dedicated to that.

9- Guiding members of crafts and professions to available governmental and private support sources, and financing and investment entities to expand their businesses.

10- Informing members of crafts and professions of the obligation to adhere to the ethics and conduct of the craft or profession, and to comply with all related laws and regulations in force in the Kingdom.

11- Addressing the competent (secretariat/municipality) regarding violators from the profession or craft members with the aim of taking necessary actions against them.

12- Submitting a (quarterly) report to the competent secretariat or municipality, including the positives, negatives, and required support.

13- Informing the secretariat/municipality and competent authorities of non-regulatory sales related to the profession and craft that occur within markets and informing the secretariat/municipality and competent authorities of the observed cases.

14- Providing advice, opinion, and technical support in the field of craft or profession specialization to any of the concerned government entities upon their request.

15- The head of crafts and professions may delegate some of his powers to his deputy, and this shall be in accordance with a record approved by the competent (secretariat/municipality).
