Regulation Governing the Committee for Reviewing Objections to Land Transport Violations

Chapter 1: Definitions

Article 1

Previous Amendments
  • The following words and phrases shall have the meanings indicated next to each of them unless the context requires otherwise:

    • The Panel: Transport General Authority.

    • The President: President of the Panel.

    • The Law: Public Transport Law on Roads in the Kingdom of Saudi Arabia.

    • The Regulation: The regulation of the Panel issued by the Council of Ministers Decision No. (323) dated 14/9/1434 AH and its amendments.

    • The Regulations: The regulations issued in implementation of the Law.

    • The Regulation: Regulation of the Committee for Considering Objections to Violations of Land Transport.

    • The Board of Directors: Board of Directors of the Panel.

    • The Competent Administration: General Administration of Licenses or any of the administrations related to the Panel, or the branches of the Panel in the regions of the Kingdom, or the representatives of the Panel in the regional administrations.

    • The Violation: Any act that contradicts the provisions of the Law or the Regulations, and is detected by the competent employee.

    • The Committee: The committee formed by a decision from the President in each region of the Kingdom, responsible for considering objections to the violations stipulated in the Law and the Regulations.

    • The Main Committee: The committee formed by a decision from the President, headquartered at the main center. Its meetings can be held in any of the regions of the committees according to work requirements.

    • The Offender: Anyone who commits a violation of the provisions of the Public Transport Law and its regulations.

    • The Members: Members of the Committee.

    • The Official Addresses: Communication means specified by activity practitioners according to what is determined by the Regulations - including the national address - necessary to notify the objector of the correspondence and decisions of the Panel and the Committee.

    • The Technical Means: Electronic procedures specified by the Panel necessary to notify the objector of the correspondence and decisions of the Panel and the Committee.

    • The Seizure Report: The tool used by the Panel during the monitoring and inspection process to detect violations, according to the mechanism approved by the Panel.

    • The Violations Guide: A statement that specifies the actions for which non-compliance is considered a violation according to the Law and the resulting Regulations.

    • The Unlisted Violations: Violations that are not mentioned and not specified in the Law, the Regulations, and the Violations Guide.

    • The Activities: Land transport activities.

Chapter 2: Formation of the Committee

Article 2

  • 1. The Committee is formed by a decision from the President, and the number of members must not be less than (4) members, including at least one legal expert. The decision shall specify the President of the Committee, its Vice President, and its headquarters. More than one Committee may be formed according to the work requirements.

  • 2. Members are selected by a decision from the President.

  • 3. The term of membership in the Committee is (three Hijri years) and is renewable. A member shall continue in their membership after the expiration of this term until it is renewed or a successor is appointed.

Article 3

  • 1. If a member excuses themselves from continuing their membership in the Committee or is absent from attending (5) five consecutive sessions, or (8) eight separate sessions during the membership period, without an excuse accepted by the President of the Committee, the President of the Committee shall present the matter to the main Committee to elevate it to the President for the termination of the membership of the excused or absent member and appoint a new member, taking into account the provisions of Article (2) of this Regulation.

  • 2. If the excused or absent member - according to paragraph (1) of this Article - is the President of the Committee, the Vice President of the Committee shall present the matter to the main Committee to elevate it to the President for approval to terminate their membership and appoint another member, and to reappoint the President of the Committee from among the members in accordance with Article (2) of the Regulation.

  • 3. If the President of the Committee is absent, the Vice President of the Committee shall take their place in all matters necessary to facilitate the work of the Committee.

Article 4

  • 1. In consideration of the rules and instructions of the competent authorities, the allowances for the President and members of the Committee shall be determined by a decision issued by the President.

  • 2. The allowances for the members shall be disbursed monthly or according to the availability of the financial appropriations allocated in the authority.

Chapter 3: Secretary of the Committee

Article 5

  • The President appoints a Secretary for the Committee by decision, and assists him in this regard with a number of employees from the Authority as needed for the work, and the decision specifies the duration of their assignment to work.

Article 6

  • The Secretary of the Committee is responsible for providing technical and administrative services to accomplish the Committee's work as determined by the Chair of the Committee, including but not limited to the following:

    • 1. Recording what is referred to the Committee from minutes of control, complaints, and reports from the relevant administration.

    • 2. Preparing the minutes of the Committee's sessions and its decisions, archiving them, and preserving the rulings of the Board of Grievances issued regarding them.

    • 3. Following up on the Committee's agenda, organizing its meetings, and notifying members of the sessions.

    • 4. Preparing correspondence and notifications exchanged between the Committee and other entities and following up on them.

    • 5. Coordinating with the relevant administration regarding the requirements for notifications and decisions related to the Committee's work.

    • 6. Creating a record for the Committee's decisions to document the text of the decisions and their details.

    • 7. Notifying the objector of the decision issued by the Committee as stated in Article (14) of this Regulation.
