Organizational Arrangements for the National Program for Community Development in the Regions

Firstly

The National Program for Community Development in Regions (hereinafter referred to as the Program) aims to achieve community development when undertaking major development projects.

Second

  • Without prejudice to the competencies and responsibilities of the relevant authorities, the program undertakes all necessary actions to achieve its objectives, including the following:

    • 1- Setting policies and standards related to its fields of work.

    • 2- Utilizing distinguished personnel and capabilities in its fields of work.

    • 3- Conducting surveys and public opinion polls on topics related to its objectives.

    • 4- Assessing social, economic, and other risks related to community development operations in the regions.

    • 5- Conducting field visits and communicating with beneficiary residents at community development operation sites in the regions.

    • 6- Resettling and supporting residents according to its plans and executive programs.

    • 7- Coordinating with agencies as necessary to carry out its work.

    • 8- Conducting necessary research and studies on topics related to its objectives.

    • 9- Utilizing research centers, expert houses, and consultants at both local and global levels in its fields of work.

    • 10- Organizing workshops, conferences, and seminars in cooperation with agencies and entities related to its fields of work according to the regulations governing this.

Third

Previous Amendments
  • 1- The program shall have a Board of Directors chaired by the Minister of Interior and including the following members:

    • A- Minister of Municipal and Housing Affairs. Member

    • B- Deputy Minister of Interior. Member

    • C- Assistant Head of State Security. Member

    • D- Representative of the Ministry of Finance.  Member

    • E- Representative of the Public Investment Fund. Member

    • F- Representative of the Ministry of Economy and Planning Agency for Human and Social Affairs. Member

    • G- Undersecretary of the Ministry of Interior for Regional Affairs. Member and Secretary of the Board

    • H- Independent Member

    • The appointment of the independent member referred to in paragraph (H) and any additional member of the Board of Directors shall be issued by an order of the Prime Minister, and the remuneration of the Board members and its subcommittees shall be determined by an order of the Prime Minister.

  • 2- The ranks of the representatives of government entities shall not be less than rank (fourteen) or its equivalent.

Fourth

  • The Board of Directors shall oversee the program and follow up on the implementation of its activities to ensure the achievement of its objectives, particularly the following:

    • 1- Approving the organizational structure of the program.

    • 2- Approving the administrative and financial regulations of the program and other necessary regulations for the management of the program's affairs.

    • 3- Approving the general policy of the program.

    • 4- Approving the plans and executive programs related to the program's activities, and submitting those necessary to the Council of Ministers for consideration and approval.

    • 5- Approving the mechanism for obtaining information and data needed by the program from the agencies, and submitting it to the Prime Minister for approval.

    • 6- Approving the opening of program offices as needed.

    • 7- Reviewing the periodic reports submitted by the Executive Director of the program on the progress of work, and approving them.

    • 8- Appointing an external auditor (or more) and an internal financial controller.

    • 9- Approving the program's budget project, and approving the final account, the auditor's report, and the annual report, in preparation for submission according to the applicable legal procedures.

    • 10- Accepting donations, grants, bequests, and contributions offered to the program, provided they do not conflict with the governing rules.

    • 11- Assigning the Executive Director of the program any task within the scope of the program's activities. The Board, in order to achieve these competencies, may form permanent or temporary committees from among its members or others, entrusting them with tasks as it deems appropriate. The decision to form each committee shall specify its chairman, members, and competencies, and it may seek assistance from whomever it deems necessary to perform the tasks assigned to it. The Board may also delegate some of its powers to any of its members or program staff as it sees fit.

Fifth

1- The Board of Directors meets under the chairmanship of its President - or his delegate from the members of the Board of Directors - periodically, not less than four times a year, or whenever necessary as determined by the President of the Council. The invitation to the meeting is issued by the President. The meeting is valid with the attendance of at least the majority of the members, including the President or his delegate. Decisions are made by a majority of the votes of those present, and in the event of a tie, the side with which the President of the meeting voted prevails.

2- The deliberations and decisions of the Board of Directors are recorded in minutes signed by the President of the meeting and the attending members. The program communicates these decisions to the relevant authorities in an appropriate manner.

3- A member may not abstain from voting or delegate another member to vote on his behalf in his absence. A member who objects to any decision may record his objection with reasons in the minutes.

4- The Council may invite individuals to attend its sessions whose information and expertise are deemed useful, without granting them the right to vote.

5- The Council may issue its decisions by circulation according to a regulation approved for this purpose.

Sixth

  • The program shall have an Executive Director, who is appointed and dismissed by a decision of the Board of Directors. The decision shall determine his salary and other financial benefits. He is responsible for managing the program, coordinating its work, and conducting its operations, and in particular, he shall have the following:

    • 1- Supervising the financial, administrative, and technical operations of the program, and contracting with its employees, in accordance with the program's regulations and approved plans and programs.

    • 2- Proposing the organizational structure of the program and submitting it to the Board of Directors.

    • 3- Proposing the administrative and financial regulations and other necessary regulations for the conduct of the program's affairs, and submitting them to the Board of Directors.

    • 4- Proposing the general policy of the program and submitting it to the Board of Directors.

    • 5- Proposing general and detailed plans and executive programs related to the program's operations, and supervising their implementation after the Board of Directors' approval.

    • 6- Proposing a mechanism for obtaining information and data needed by the program from the agencies and submitting it to the Chairman of the Board of Directors.

    • 7- Submitting periodic reports to the Board of Directors on the program's operations, achievements, activities, and obstacles it faces, in preparation for completing what is necessary regarding them.

    • 8- Submitting proposals to the Board of Directors on matters within its jurisdiction.

    • 9- Supervising the preparation of the program's budget project, annual report, and final account; in preparation for presenting them to the Board of Directors.

    • 10- Representing the program before others and the judiciary inside and outside the Kingdom within the scope determined by the Board of Directors in this regard.

    • 11- Seeking the assistance of experts, consulting firms, consultants, and specialized companies in the field of the program's work to achieve its objectives, according to regulations determined by the Board of Directors.

    • 12- Signing agreements and protocols after the Board of Directors' approval, in accordance with the applicable legal procedures.

    • 13- Following up on the implementation of decisions issued by the Board of Directors or decisions related to the program's operations.

    • 14- Preparing the agenda for the Board of Directors' meetings.

    • 15- Executing any other task the Board of Directors assigns to him.

    • The director may delegate some of his tasks to whomever he deems appropriate from the program's staff.

Seventh

The state funds the program with an annual subsidy included in the budget of the Ministry of Interior, and the ministry provides administrative and technical support and assistance to the program to perform its tasks.

Eighth

  • 1- The program's resources consist of the following:

    • A- Allocations from the general budget of the state.

    • B- Donations, grants, bequests, and contributions accepted by the Board of Directors.

    • C- Any other resource approved by the Board of Directors that does not violate regulations and instructions.

  • 2- The program's funds are deposited with the Saudi Arabian Monetary Authority, and it is allowed to open other accounts in banks licensed to operate in the Kingdom, and expenditures from these funds are made according to the program's regulations.

Ninth

Technical and administrative positions in the program are filled by contract in accordance with the Labor Law, and it is not permissible to contract for permanent positions in the state's general budget.

Tenth

The program shall submit its annual final account to the Council of Ministers within ninety days from the end of the fiscal year, and provide a copy to the General Auditing Bureau.
