Regulations for the Use of the Name Saudi Arabia and the Names of Cities, Regions, and Public Places in the Trade Name

  • Minister of Commerce Decision No. (113) dated 19/05/1445 AH

  • The Minister of Commerce

  • Based on the powers vested in him, and after reviewing:

    • Law of Trade NamesIssued by Royal Decree No. (M/15) dated 12/8/1420 AH.

    • The Royal Order No. (86852) dated 18/12/1444 AH, including in item Third: The Minister of Commerce and the Minister of State and Member of the Council of Ministers, Chairman of the Saudi Authority for Intellectual Property - each within his jurisdiction and in coordination between them - shall issue regulations for approving the use of the name Saudi Arabia, and the names of cities, regions, and public places, in the trade name or trademark intended to be registered, and the approval for registration shall be issued according to the regulatory procedures followed by both authorities.

    • And for what the public interest requires.

    • It is decided as follows:

      • First: Issuing regulations for the use of the name Saudi Arabia and the names of cities, regions, and public places in the trade name in the form attached to this decision.

      • Second: These regulations shall be published in the Official Gazette and shall come into effect from the date of their publication.

First

  •  The name (Saudi Arabia) and the names of cities and public areas may be used in the trade name in accordance with the Trade Names System and its executive regulations, and according to the following controls:

  • 1- The trade name must not be identical or similar to the name of any governmental entity or project and similar entities.

  • 2- The name of Saudi Arabia or the name of the city, region, or public place must not be the essential element or the main component of the trade name.

  • 3- The trade name must not resemble a globally famous trademark, or resemble a registered or famous trademark in the Kingdom, unless the trademark is owned by the applicant.

  • 4- The owner of the trade name must undertake not to tarnish the trade name with the reputation of the Kingdom or the cities, regions, or public places, or to offend them.

 

Secondly

  • Companies that bear the name of Saudi Arabia or the names of cities, regions, or public places are exempt from these regulations when expanding or merging.

 

Thirdly

  •  The registration of the trade name that includes the names of my cities, Makkah and Madinah, is exempt from these regulations, as per the guidelines issued regarding them in accordance with the gracious royal order No. (9311) dated 8/2/1444 AH.

Fourthly

  • The relevant administration shall receive applications for the registration of trade names that include the name (Saudi Arabia) or the names of cities, regions, or public places, and shall study them to consider their acceptance or rejection in accordance with these regulations.
