Standards for Licensing Electronic Real Estate Platforms and Their Classification

First

The following terms and phrases, wherever they appear in these standards, shall have the meanings specified next to them:
1- The Authority: Real Estate General Authority.
2- The Regulations: Regulations for Real Estate Announcements.
3- The Standards: Standards for Licensing and Classifying Electronic Real Estate Platforms.
4- Real Estate Announcement: A visual, written, or audio announcement; for the purpose of acting on the real estate by any electronic means.
5- Classification: Evaluating the capabilities of the electronic real estate platform to place it in the appropriate field and degree according to these standards and the decisions and circulars issued by the Authority in implementation thereof.
6- Electronic Real Estate Platform: The application or website and similar entities specialized in marketing the real estate announcement.
7- The Owner: The owner of the real estate asset or its benefit.
8- The Advertiser: The party requesting the publication of the real estate announcement, whether the announcement is for themselves or for others by any means.

Secondly

The Authority issues licenses for electronic real estate platforms as follows:
1- A claim for the license must be submitted fulfilling the regulatory requirements, and the Authority shall decide on the claim within (60) days. In case of rejection, it must be justified.
2- The license is issued by a decision from the Governor of the Authority, including: the license number and its duration, and the data of the electronic real estate platform mentioned in item (Third).
3- The duration of the license is (3) years, renewable for a similar period in accordance with the provisions of these standards.
4- A request for renewal of the license must be submitted at least (90) days before its expiration, using the form prepared by the Authority for this purpose.
5- The license shall be revoked in the following cases:
A- If the owner of the electronic real estate platform submits a request for cancellation of the license.
B- If the electronic real estate platform violates the provisions of these standards.
6- The cancellation does not exempt the electronic real estate platform from any financial obligations or rights owed to the Authority or to others.

Thirdly

The application for the electronic real estate platform license to the authority shall be submitted along with the following information:
1- The name of the platform and its electronic link.
2- Information about the platform owners.
3- Contact information.
4- The commercial register - if available -.

Fourthly

The electronic real estate platform must comply with the following:
1- The provisions contained in the Electronic Commerce Law and its executive regulations.
2- The provisions contained in the (Regulations for Real Estate Advertisements) issued by the authority and published on the platform, and obligating advertisers to adhere to them.
3- The publication of real estate advertisements shall be limited to the advertiser being:
A- A natural person of Saudi nationality.
B- A legal entity licensed to conduct business in the Kingdom.
Exceptions are made for non-Saudi advertisers for properties owned by them.
4- Registration of advertisers through the National Access Platform.
5- The advertiser must be from one of the following categories:
A- The owner.
B- An authorized representative of the owner by means of a written authorization or a court order.
6- Removal of misleading, fictitious real estate advertisements, or those violating intellectual property rights or contravening the provisions of the regulations and standards.
7- Obliging the advertiser – in case of using the platform for maps – to accurately specify the location of the property, and based on the advertiser's request, the platform may refrain from displaying the exact location to the public.
8- Technical linkage with the authority and providing it with the required data.
9- Maintaining the confidentiality of information and full responsibility for the data and privacy of the user and the intellectual property rights of others.
10- Compliance with the requirements issued by the relevant authorities regarding data and cybersecurity.
11- Publishing the privacy policy, intellectual property rights policy, and terms and conditions for using the platform.

Fifthly

Receiving complaints regarding the real estate announcement, establishing a mechanism for processing and resolving them, and compiling the recurring ones to provide the authority with them on a semi-annual basis, and the processing should be as follows:
1- The platform shall receive complaints related to the real estate announcement published therein, verify the identity of the complainant, and the content of the complaint, while requesting evidence to support the validity of the complaint, and taking necessary actions as follows:
A- If it is found that the complaint regarding the announcement was due to a violation of the provisions or standards, the platform must take the necessary actions to address the complaint within a period not exceeding (four) days from the date of its receipt.
B- If it is found that the complaint requires verification from the advertiser, the platform must, within (two) days, contact the advertiser, request evidence to support its validity, and grant them a period not exceeding (four) days; if the necessary documents are not provided, the platform shall hide the announcement.
C- The complainant must be informed of the actions taken by the platform within a period not exceeding (seven) days from the date of submitting the complaint.
2- If the advertiser repeats the violation three times within (twelve) months, the platform must suspend their account for a period not exceeding (one) year.
3- A complaint may be submitted to the authority if the complainant is not satisfied with the outcome of the processing of their complaint, or if (ten) days have passed without resolving the complaint.

Sixthly

The electronic real estate platform must remove the real estate announcement within a period not exceeding (two days) from the date of occurrence of any of the following cases:
1- Notification of the completion of the sale or lease process, in which case it may be distinguished by indicating that it has been sold or leased.
2- Notification of the owner canceling the delegation.
3- Violation of the real estate announcement of any of the provisions of the regulations, standards, or related systems.

Seventhly

The authority shall take the necessary measures to ensure the compliance of the electronic real estate platform with the provisions of these standards.

Eighth

The authority issues a mechanism for classifying and evaluating electronic real estate platforms, as well as the feedback from beneficiaries, and publishes the results periodically.

Ninth

The Authority may, in the event of a violation of any of the standards, take any of the following procedures:
1- Obligate the platform to remove the announcement.
2- Warn the electronic real estate platform.
3- Suspend the advertiser from publishing on the platform for a period not exceeding (one year).
4- Suspend the license of the electronic real estate platform for a specified period and announce that.
5- Revoke the license of the electronic real estate platform and announce that.

Tenth

These standards are published in the official gazette and shall come into effect after (90) days from the date of their publication.
