Regulation of the Arbitration Chamber for considering appeals against decisions issued by the Electoral Committee of the Association

Article 1 (1): Definitions

  • Association: Association of First Division Professional Clubs.

  • Center: Saudi Sports Arbitration Center.

  • Council: Board of Directors of the Center.

  • Law: Basic Law of the Center.

  • Procedural Rules: Procedural Rules of the Center.

  • Electoral Committee: The authority responsible for organizing elections and supervising them and the procedures for their approval at the level of the Association.

  • Chamber: Temporary Arbitration Chamber considering appeals against decisions issued by the Electoral Committee of the Association.

  • President of the Chamber: President of the Temporary Arbitration Chamber responsible for considering appeals against decisions issued by the Electoral Committee of the Association.

  • Arbitration Body: A single arbitrator or three arbitrators assigned to consider and resolve the dispute.

  • Chief Executive: Chief Executive of the Center.

  • Secretary: The person appointed by the Chief Executive, responsible for written work and managing correspondence between the Arbitration Body and the parties to the dispute and the administrative apparatus of the Center.

Article 2: Scope of Application of the Regulation

  • A. This Regulation is the primary reference for considering appeals against the decisions issued by the Electoral Committee regarding the candidate lists for the Board of Directors elections of the Association according to the timeline (attached as Appendix C).

  • B. The provisions contained in the Law, procedural rules, Center Regulations, and relevant Council decisions shall apply in matters not specifically addressed in this Regulation.

Article 3: Establishment of the Chamber

  • A temporary arbitration chamber is established to adjudicate appeals against the decisions issued by the electoral committee of the association.

Article 4: President of the Chamber

  • The head of the chamber is responsible for the following:

    • A- Issuing a decision on the (acceptance/rejection) of the arbitration request in form.

    • B- Issuing a decision to form the arbitration panel.
      C- Monitoring and overseeing the arbitration process from its inception until the judgment is issued.

    • D- Alerting the arbitration panel in case of delays in issuing the arbitration judgment.

Article 5: Arbitration Costs

  • The arbitration applicant is obligated to pay the full arbitration costs upon submitting the arbitration request, which are as follows:

    • 1. Registration fee amounting to (10,000) ten thousand Saudi Riyals.

    • 2. Administrative fees amounting to (20,000) twenty thousand Saudi Riyals.

    • 3. Fees for the arbitration panel and the Secretary amounting to:

      • A. (22,000) twenty-two thousand Saudi Riyals if the arbitration panel consists of a single arbitrator.

      • B. (62,000) sixty-two thousand Saudi Riyals if the arbitration panel consists of three arbitrators.

    • 4. The registration fee is non-refundable.

    • 5. The administrative fees are non-refundable after the issuance of the decision to form the arbitration panel.

    • 6. If the arbitration proceedings conclude before the issuance of the arbitration award, the CEO may determine the fees for the arbitration panel and the Secretary, taking into account the circumstances that the arbitration proceedings have reached.

Article 6: Conditions for Accepting the Arbitration Request

Article 7: Formation of the Arbitration Tribunal

  • 1. The arbitration panel shall consist of a single arbitrator - unless the parties to the dispute agree to form it with three arbitrators - who shall be selected from the list of approved arbitrators at the center as stated in (Appendix B).

  • 2. The parties to the dispute shall agree on the appointment of the single arbitrator within less than 24 hours upon the acceptance of the arbitration request by the president of the chamber; otherwise, the president of the chamber shall appoint the arbitrator and notify the parties to the dispute of the name of the arbitrator.

  • 3. In the event that the parties to the dispute agree to form the arbitration panel with three arbitrators, they shall be selected from the list of approved arbitrators at the center as stated in (Appendix B) as follows:

    • A) Each party shall name an arbitrator within less than 24 hours upon the acceptance of the arbitration request by the president of the chamber, and if one of the parties to the dispute fails or refuses to name the arbitrator within the aforementioned period, the president of the chamber shall appoint him.

    • B) The appointed arbitrators shall select the presiding arbitrator within six hours, and the president of the chamber may choose the presiding arbitrator after the expiration of the aforementioned period.

  • 4. The duration for forming the arbitration panel and issuing the decision shall not exceed 36 hours.

  • 5. The panel may not consider more than one dispute at the same time except with the approval of the president of the chamber.

Article 8: Language of Arbitration

  • The Arabic language is the official language for all communications and correspondences.

Article 9: Place of Arbitration

  • The arbitration venue shall be at the location of the election, and electronic means may be used.

Article 10: Nature of Arbitration

  • The expedited arbitration procedures apply to all claims accepted by the chamber.
