Regulatory Arrangements for the Taif Development Authority

  • After reviewing in its session chaired by the Custodian of the Two Holy Mosques King Salman bin Abdulaziz Al Saud, the correspondence received from the Royal Court No. 60734 dated 19/8/1445 AH, regarding the organizational arrangements for the Taif Development Authority.

  • After reviewing the aforementioned draft arrangements.

  • After reviewing the financial and administrative regulations for the Development Authorities of Regions and Cities, issued by Council of Ministers Decision No. (475) dated 7/9/1439 AH.

  • After reviewing the two Royal Orders No. (62332) dated 4/10/1443 AH, and No. (68175) dated 2/11/1443 AH.

  • After reviewing memoranda No. (104) dated 9/1/1444 AH, No. (521) dated 19/2/1444 AH, No. (1371) dated 3/5/1444 AH, No. (1761) dated 9/6/1444 AH, No. (2701) dated 7/9/1444 AH, No. (353) dated 1/2/1445 AH, No. (683) dated 27/2/1445 AH, No. (1001) dated 25/3/1445 AH, No. (1721) dated 16/5/1445 AH, No. (2286) dated 22/6/1445 AH, No. (3242) dated 8/9/1445 AH, No. (960) dated 16/3/1446 AH, No. (2238) dated 24/6/1446 AH, prepared by the Bureau of Experts at the Council of Ministers.

  • After reviewing the minutes prepared by the Council of Economic and Development Affairs No. (46/965/M) dated 4/6/1446 AH.

  • After reviewing the telegram from the Secretariat of the Council of Economic and Development Affairs No. (4052) dated 18/6/1446 AH.

  • After reviewing the recommendation of the General Committee of the Council of Ministers No. (6607) dated 25/6/1446 AH.

  • It is decided as follows:

    • First: Approval of the organizational arrangements for the Taif Development Authority, in the attached form.

    • Second: The application of the financial and administrative regulations for the Development Authorities of Regions and Cities - issued by Council of Ministers Decision No. (475) dated 7/9/1439 AH - to the Taif Development Authority.

    • Third: The Chairman of the Board of Directors of the Taif Development Authority and the Minister of Finance shall agree on all matters related to the investment of the Authority’s funds, and establish appropriate mechanisms that enable the Authority to benefit from its revenues and the financial consideration for the services and works it provides - without prejudice to the provisions of the Royal Circular Order No. (55685) dated 30/11/1438 AH - in a manner that ensures the financial sustainability of the Authority.

    • Fourth: Formation of a committee from: Makkah Region Development Authority and Taif Development Authority, to coordinate regarding the transfer of tasks and competencies related to the comprehensive planning and development of Taif Governorate, and its associated projects, from the Makkah Region Development Authority to the Taif Development Authority.

    • Fifth: The first fiscal year of the Taif Development Authority shall commence from the effective date of its organizational arrangements - referred to in item (First) of this decision - and shall end at the end of the following fiscal year of the state, as an exception to the provision of paragraph (2) of item (Tenth) of the arrangements.

First

  • The following words and phrases shall have the meanings indicated next to each, unless the context requires otherwise:

    • 1- Authority: Taif Development Authority.

    • 2- Arrangements: Organizational arrangements of the authority.

    • 3- Council: Board of Directors of the authority.

    • 4- Administrative Regulation: Administrative regulation for development authorities of regions and cities.

    • 5- Financial Regulation: Financial regulation for development authorities of regions and cities.

    • 6- Regulations: Administrative regulation and financial regulation.

    • 7- Supervisory Scope: The geographical area in which the authority exercises its powers, including the Taif Governorate and the centers affiliated with the governorate that are added to this scope.

Secondly

The authority enjoys legal personality and financial and administrative independence, and is organizationally linked to the Prime Minister. Its headquarters is located in Riyadh, and it has the authority to establish offices as needed within the Kingdom.

  • The Authority aims - without prejudice to the competencies of other relevant agencies and within the supervisory scope - to plan and develop comprehensively in the fields of urban, demographic, economic, developmental, social, cultural, environmental, transport, infrastructure, and digital infrastructure, and also aims to provide the needs for public services and facilities. In order to achieve this, the Authority undertakes the following tasks and competencies within the supervisory scope:

    • A- Drawing up general policies for development and growth.

    • B- Preparing comprehensive strategic plans, studies, and programs, approving them, and updating them as necessary.

    • C- Direct supervision over the planning, design, and implementation of strategic programs and projects, along with related operational and maintenance activities.

    • D- Reviewing development plans, programs, and projects - related to the Authority's work - prepared by government agencies, public authorities, institutions, associations, and non-profit organizations, ensuring balanced development and their approval.

    • E- Following up on the planning of infrastructure projects in coordination with the relevant agencies.

    • F- Prioritizing the implementation of programs and projects in accordance with development plans.

    • G- Monitoring the implementation of programs and projects, taking necessary actions to ensure their execution, in coordination with the relevant agencies, and applying indicators for improving and measuring urban performance based on the objectives of the approved development plans.

    • H- Proposing the expropriation of certain real estate based on development needs, in coordination with the relevant secretariat within the supervisory scope and related agencies, in preparation for completing the legal procedures regarding it.

    • I- Supervising the rehabilitation of existing urban neighborhoods - including historical neighborhoods - improving them, addressing and developing informal settlements, and enhancing them urbanly, socially, economically, security-wise, and environmentally, and taking necessary actions to ensure implementation.

    • J- Preparing building regulations and land use that contribute to the implementation of development and growth plans, and approving them.

    • K- Reviewing land subdivision plans and approving them.

    • L- Establishing and managing a database and urban information systems, serving as a unified platform and a primary reference for the information relied upon by the relevant agencies in development and growth.

    • M- Coordinating and organizing efforts among the relevant agencies in development and growth, according to the approved studies and plans.

    • N- Setting programs, foundations, procedures, and motivating means for private sector participation in achieving development goals and implementing projects and services, and supervising them.

  • In order to achieve its tasks and competencies, the Authority may seek assistance from necessary government agencies and others, including consulting firms and specialized personnel, both within and outside the Kingdom.

The authority shall have a Board of Directors whose chairman and members are appointed by a decree from the Prime Minister, based on a nomination from the Chairman of the Council of Economic and Development Affairs. The term of membership in the Council shall be three (3) years, renewable once.

Sixth

  • 1- The Council meetings are held at the headquarters of the Authority, chaired by the President of the Council or a member designated by him. The President of the Council may, by decision, hold them in another location.

  • 2- The Council holds its meetings periodically four times a year, and the President of the Council may call for a meeting whenever necessary. The invitation to the meeting is sent by the Chief Executive Officer of the Authority - in writing - with the approval of the President of the Council, at least seven days before the meeting date, and the invitation must include the agenda. The Council meeting is not considered valid unless attended by the majority of its members, including the President of the Council or a member designated by him, and decisions are made with the approval of the majority of the attending members (at least). In the event of a tie, the side that the meeting President voted for prevails.

  • 3- The Council may invite any officials or experts it deems appropriate to attend its meetings to provide any information and clarifications they have, without having the right to vote.

  • 4- The Authority shall notify the relevant agencies of the Council's decisions after being signed by the President of the Council and the attending members, taking into account the completion of the legal procedures for decisions that require it.

  • 5- The Council may issue its decisions by circulation, in accordance with a regulation issued by the Council to organize its work.

  • The Authority shall have a Chief Executive Officer appointed and dismissed by a decision of the Council, which specifies his salary and other financial and functional benefits. He shall be the executive responsible for managing the Authority's affairs, and his responsibilities shall be limited to the arrangements and the two regulations. He shall specifically exercise the following powers and responsibilities:

    • A- Supervising the Authority's staff in accordance with the powers granted to him and as specified by the two regulations.

    • B- Overseeing the Authority's technical, administrative, and financial operations in accordance with the two regulations and based on the approved policies in accordance with the arrangements.

    • C- Following up on the implementation of the decisions issued by the Council.

    • D- Representing the Authority before the judiciary, government agencies, and institutions within the Kingdom, and related bodies outside the Kingdom, with the authority to delegate others in this regard.

    • E- Preparing the Authority's budget draft, final accounts, auditor's report, and annual report, and submitting them to the Council for approval.

    • F- Preparing reports related to the implementation of the Authority's plans, programs, and studies, and presenting them to the Council.

    • G- Supervising the preparation for Council meetings and preparing its agenda.

    • H- Appointing the Authority's staff in accordance with the two regulations.

    • I- Contracting with local and international experts and consultants.

    • J- Any other task assigned to him by the Council or its Chairman.

  • The Chief Executive Officer may delegate some of his powers to other staff members of the Authority.

  • The resources of the authority consist of the following:

    • A- What is allocated to it from financial appropriations in the state budget.

    • B- Donations, grants, gifts, and bequests.

    • C- Revenues from its endowments according to the rules set by the Council.

    • D- Income obtained from its investment returns.

    • E- Any other resource approved by the Council, provided it does not violate the regulations and instructions.

  • A- The revenues of the Authority shall be deposited in the current account of the Ministry of Finance at the Saudi Central Bank.

  • B- The Authority shall open an account for itself at the Saudi Central Bank, and it may open other accounts at any of the banks licensed to operate in the Kingdom, and withdrawals shall be made in accordance with the Authority's budget and the approved regulations.
