Anti-Bribery Law - 1382

Article 1

  • Any public employee who requests for himself or for others, or accepts or receives a promise or gift for performing a task related to his job or claims it is related to his job, even if this task is lawful, is considered to be bribed and shall be punished with imprisonment for a term of one to five years and a fine ranging from five thousand to one hundred thousand Riyals, or with one of these penalties. The intention of the employee not to perform the task he promised does not affect the establishment of the crime.

Article 2

  • Any public employee who requests for himself or for others, or accepts or takes a promise or a gift to refrain from performing any of the duties of his position, or claims that such refraining is part of his duties, even if this refraining is lawful, shall be considered as engaging in bribery and shall be punished with the penalties stipulated in Article One of this Law. The intention of the employee not to perform what he promised does not affect the establishment of the crime.

Article 3

  • Any public employee who requests for himself or for others, or accepts or takes a promise or a gift to breach the duties of his position or to reward him for what he has done, even if there was no prior agreement, is considered to be bribed and shall be punished with the penalties specified in Article One of this Law.

Article 4

  • Any public employee who violates their job duties by performing or refraining from performing any acts of that job as a result of a request, recommendation, or mediation is considered to be in the position of a briber and shall be punished with imprisonment for a period not exceeding one year or a fine not exceeding ten thousand Riyals, or with one of these two penalties.

Article 5

  • Any public employee who requests for himself or for others, or accepts or takes a promise or gift to use real or alleged influence to obtain or attempt to obtain from any public authority actions, orders, decisions, obligations, licenses, supply agreements, or a position, service, or benefit of any kind is considered to be in the position of a briber and shall be punished with the penalty stipulated in Article One of this law.

Article 6

  • The briber, the intermediary, and anyone who participated in any of the previous crimes shall be punished with the penalty stipulated in the article that criminalizes it. Anyone who agrees, incites, or assists in committing the crime with knowledge of it shall be considered an accomplice in the crime, provided that the crime was committed based on the aforementioned agreement, incitement, or assistance.

Article 7

  • Those who use force, violence, or threats against a public employee to obtain an unlawful act or to compel them to refrain from performing a duty assigned to them by law shall be punished with the penalties specified in Article One of this Law.

Article 8

  • Anyone who offers a bribe that is not accepted, or who uses force, violence, or threats without achieving their purpose, shall be punished with imprisonment for a period of six months to thirty (30) months, and a fine ranging from two thousand five hundred Riyals to fifty thousand Riyals, or with one of these penalties.

Article 9

  • Considered as a Public Servant for the purposes of this Law.

    • A- An employee in the government or its affiliated entities or public authorities, whether appointed permanently or temporarily.

    • B- An Arbitrator or Expert appointed by the government or any entity with judicial authority.

    • C- A doctor or midwife regarding the certificates they issue, even if neither is a Public Servant.

    • D- Any person assigned a task for the government or any other administrative authority.

    • E- Employees of joint-stock companies or companies that undertake obligations in public facilities.

 

Article 10

  • Any person who is the briber or the bribed to receive a gift or benefit, and who is aware of the reason, shall be punished with imprisonment for a period of one month to six months and a fine ranging from one thousand to five thousand Riyals, or with one of these penalties - provided that this person did not mediate in the bribery.
