Regulations of the Arbitration Chamber for Appeals Requests in the Saudi Games 2023

Article 1 (1): Definitions

  • The Event: Saudi Games (2023).

  • Sports Federations: The federations and sports bodies participating in the event.

  • The Center: Saudi Sports Arbitration Center.

  • The Council: Board of Directors of the Center.

  • The Law: The foundational law of the Center.

  • Procedural Rules: The procedural rules of the Center.

  • The Regulation: Regulation of the Arbitration Chamber regarding appeals on decisions issued concerning disciplinary cases of the event.

  • The Chamber: The arbitration chamber specialized in considering appeals on decisions issued by sports federations regarding disciplinary cases of the event.

  • President of the Chamber: The president of the arbitration chamber specialized in considering appeals on decisions issued by sports federations regarding disciplinary cases of the event.

  • The Body: A single arbitrator or three arbitrators assigned to consider and resolve the dispute.

  • Chief Executive: The chief executive of the Saudi Sports Arbitration Center.

Article 2: Scope of Application of the Regulation

  • A. This Regulation is the primary reference for considering appeals against decisions issued by sports federations regarding disciplinary cases related to the tournament according to the specified timeline.

  • B. The provisions contained in the Law, procedural rules, center regulations, and relevant Council decisions shall apply in matters not specifically addressed in this Regulation.

Article 3: Place of Arbitration

  • A- The arbitration shall be held at the main headquarters of the center, and the authority may conduct the proceedings of the dispute either in person or by using electronic means, whether at the center's headquarters or outside of it.

  • B- If the judgment is issued outside the main headquarters of the center, it shall be considered as if it were issued at its main headquarters.

Article 4: Language of Arbitration

  • Arabic is the official language for all communications and correspondences.

Article 5: Establishment of the Chamber

  • A temporary arbitration chamber is established to adjudicate appeals against decisions issued by sports federations regarding disciplinary cases related to the tournament.

Article 6: Conditions for Accepting the Claim

  • 1. The arbitration claim is submitted to the Chief Executive Officer through the means of communication specified in Article (8) of the Regulation, and according to the form approved by the center.

  • 2. The claimant is obligated to complete all data and information contained in the arbitration claim form (Appendix A), which must include the following:

    • A. A memorandum of appeal including a brief statement of the facts, supporting legal grounds, and requests.

    • B. A copy of the contested decision issued by the sports federation.

    • C. Evidence of notification of the contested decision.

  • 3. The arbitration claim must be submitted within a period not exceeding (5) five working days from the date the claimant is notified of the decision issued by the sports federations.

Article 7: Representation

  • A- Any party to the dispute has the right to appear and represent themselves directly or through a licensed attorney in the Kingdom under an approved power of attorney that explicitly states representation before the center.

  • B- The presence of parties to the dispute with legal personality shall be through their legal representative as stipulated in the relevant regulations.

Article 8: Communication Officer

  • 1. The email identified as ([email protected]) shall be the approved method of communication for (sending and/or receiving) all correspondence, communications, arbitration requests, arbitration rulings, and others.

  • 2. Notification by electronic means is considered received and produces its legal effects from the date of sending to the person to whom the notification is directed, unless proven otherwise.

  • 3. All notifications must be issued in writing, and the center may, when necessary, use any other means that ensures notification.

Article 9: Nature of Arbitration

  • The expedited arbitration procedures apply to all claims accepted by the chamber.

Article 10: President of the Chamber

  • The head of the chamber is responsible for the following:

    • A- Issuing a decision on the (acceptance/rejection) of the arbitration request in form.

    • B- Selecting the composition of the panel and issuing a decision regarding it.

    • C- Monitoring and overseeing the arbitration process from its inception until the judgment is issued.

    • D- Alerting the panel in case of any delay in issuing the arbitration judgment.
