Article One:
The words and phrases mentioned below - wherever they appear in this Regulation - shall have the meanings specified next to each of them, unless the context indicates otherwise:
Law: The Tourism Law.
Regulation: The Regulation for the Inspection of Tourism Activities.
Ministry: The Ministry of Tourism.
Minister: The Minister of Tourism.
Inspection: The process of verifying compliance with the conditions and regulations of tourism activities and the continued adherence to them, for the purpose of monitoring violations, investigating them, and other purposes stipulated in the law and its regulations, through field visits or remote office inspections.
Tourism Inspector: A person who has been issued a decision by the Minister - either individually or jointly with others - to undertake inspection duties in accordance with the law and its regulations.
Visit Report: A document - either paper or electronic - that includes the results of the inspection.
Violation: Any incident that contravenes the law and its regulations.
Competent Committee: A committee or committees that consider violations of the Tourism Law and its regulations as stipulated in paragraph (1) of Article (Fifteen) of the law.
Tourism Activities: Activities that fall under the jurisdiction of the Ministry, including tourist guidance, travel and tourism services, management or operation of hospitality facilities, providing tourism consultations, and offering experiential activities and similar services, as defined by the regulations of the law, and what is determined - by a decision from the Council of Ministers - to be subject to the Ministry's licensing.
Tourism Facility: The real estate, building, or location through which tourism activities are conducted, or anything similar, that is licensed by the Ministry.
License or Permit: A document issued by the Ministry to practice an activity or provide a service in the field of tourism in accordance with the law.
Classification: A mechanism for evaluating tourism activities and the level of service provided therein, determining the type and category or grade.
Practitioner of Tourism Activity: Any natural or legal person who practices any of the tourism activities licensed by the Ministry in accordance with the law and its regulations.
Tourist: A natural person who stays for tourism purposes for no less than one night outside their usual place of residence in a lawful manner for tourism, or benefits from one or more services of tourism and complementary and specialized activities.
Technical Means: All electronic means adopted by the Ministry for the purpose of implementing the law and the regulation.
Procedural Guidelines: A document that includes instructions, guidelines, standards, or others to determine the detailed procedures complementing the regulation in accordance with the law and its regulations.
Official Address: The address registered in the license or permit, or the national address, or the contact means of the activity practitioner - in all its forms - that the Ministry has obtained.
Article Two:
The Regulation aims to define the mechanism of Inspection, the powers of the inspector, and his duties.
1- A decision shall be issued by the Minister -based on a nomination from the Ministry- to appoint the tourism inspector who meets the criteria approved by the Ministry.
2- The tourism inspector must take an oath before commencing his duties in the following form: (I swear by Almighty God that I will perform my duties with honesty, integrity, and sincerity, and that I will not disclose any secrets that I have come to know by virtue of my work, even after my work has ceased or I have left it).
3- The Ministry shall prepare a record of the oath -referred to in paragraph (2) of this article- and it shall be kept in the file of the tourism inspector.
1- The tourism inspector may not be replaced unless the replacement is due to his inability to perform his duties because of force majeure, emergency circumstances, or for a reason that ensures neutrality, or the absence of conflict of interest, or for the integrity of the procedures followed in inspection tasks.
2- The tourism inspector may be assigned additional tasks, provided that they do not conflict with the nature of his work and primary duties.
The Ministry issues an official identification card for the tourism inspector, which includes their basic information, and also issues an electronic account for remote inspection using the technical means adopted by the Ministry.
The tourism inspector shall perform his duties in accordance with the law and its regulations, and shall adhere to the following:
1- To carry out his duties with honesty, integrity, sincerity, fairness, and impartiality.
2- Not to disclose any secrets that he becomes aware of by virtue of his work, even after his employment has ended or he has left it, except within the scope required by the Ministry or the relevant authorities officially.
3- To comply with the approved inspection attire, introduce himself, and present his identification card to the practitioner of the tourism activity or his employees, as appropriate for the purpose of the inspection.
4- To apply the procedures and use the means approved by the Ministry – in accordance with the law and its regulations – when carrying out his duties, unless this is impossible for reasons beyond his control, in which case he must explain the reasons to the Ministry.
5- To adhere to the limits of the tasks assigned to him in accordance with the law and its regulations, and the inspection plans approved by the Ministry.
6- To disclose to the Ministry before conducting the inspection any direct or indirect relationship he has, whether by kinship (up to the fourth degree) or otherwise, or any interest with the practitioner of the tourism activity or his employees, in accordance with the disclosure form approved by the Ministry.
7- To include in the visitation report whether the practitioner of the tourism activity under inspection or any of his employees accompanied the tourism inspector during the inspection, along with the details of the accompanying person (if any).
8- To clarify what has been included in the visitation report – if any – to the practitioner of the tourism activity or his representative, if present, after the inspection is completed.
9- To maintain politeness and professionalism in dealing with others.
10- Not to accept any gifts or similar items, and to refuse any offer or service from the practitioner of the tourism activity or his employees.
11- To return the official identification card issued to him by the Ministry and all items related to the inspection upon leaving the job or losing his status as a tourism inspector for any reason.
12- Not to give prior notice to the practitioner of the tourism activity about the visitation for the purpose of verifying the existence of the license or permit and classification, and to comply with all conditions, requirements, controls, and standards necessary in accordance with the law and its regulations.
