Implementing Regulation of the Railway Law

  • Based on the powers vested in it by the law

  • After reviewing the Railways Law, issued by Royal Decree No. (M/159) dated 22/8/1445 AH.

  • After reviewing the Statute of the Transport General Authority, issued by Council of Ministers Resolution No. (323) dated 14/9/1434 AH, and its amendments.

  • After reviewing the recommendation of the Executive Committee No. (1/11/T/2024/3) dated 22/5/2024 AD.

  • After deliberation, the Board decided the following:

  • Approval of the Implementing Regulation of the Railways Law and the schedules of violations and penalties in the attached form.

  • And Allah is the Grantor of success.

Chapter One Definitions

Article 1

  • The following phrases and expressions, wherever mentioned in the Regulation, shall have the following meanings assigned to each of them, unless the context states otherwise:

  • Kingdom: Saudi Arabia.

  • Law: Railway Law.

  • Regulation:  The Implementing Regulation of the Law.

  • Authority:  The Transport General Authority. 

  • Board: The Authoritys Board of Directors. 

  • President: The President of the Authority.

  • Committee: The Committee for the Consideration of Violations of the Law and Regulation. 

  • Executive Decisions: Decisions issued by the President in implementation of the provisions of the Regulation.

  • Investigation Team: A team formed by the President for the purpose of conducting a technical investigation into the accident or incident.

  • Service Controller: A person who by law has the authority to control and inspect to ensure compliance with the provisions of the Law and Regulation, Technical Manuals or Executive Decisions, and to take the necessary action in case of breach of any of them. 

  • Control and Inspection: A procedure through which the service controller or whoever is authorized by the Authority enters the places and means of transport subject to the provisions of the Law and Regulation in accordance with the procedures approved by the Authority, with the aim of ensuring compliance and the absence of violations of the Law, Regulation, Technical Manuals or Executive Decisions.

  • Infrastructure Manager: The legal person licensed to manage the infrastructure and provide related services, whether this person is the owner or non-owner of the infrastructure.

  • Infrastructure Owner: The person who owns the infrastructure or part of the infrastructure.

  • Operator: A legal person licensed to provide any of the railway services.

  • Persons with disabilities: Every person who has a long-term physical, mental, sensory or psychological disorder or impairment that may prevent him or her from participating fully and effectively in society on an equal basis with others. 

  • Persons with reduced mobility: Any person other than a person with a disability, who has an injury or   a case that prevents him or her from walking without the assistance of other natural persons or mobility equipment.

  • Other: A person who visits a transport facility or means of transport other than passengers or employees. 

  • Beneficiary: Any natural or legal person who benefits from the activities of the railway services and its facilities.

  • Violation: Any intentional or unintentional violation of any provision of the Law, Regulation, Executive Decisions or Technical Manuals. 

  • Complaint: Complaints submitted to the Authority related to railways, including complaints from operators or users, whether for consideration in its capacity as the regulator and supervisor of the sector, or to be submitted to the Committee for the Consideration of Violations pursuant to Article (forty-six) of the Law. 

  • Manual (s): Manuals issued by the Authority that includes, but is not limited to, the requirements, standards, specifications, technical conditions, documents to be submitted, and the procedures to be adhered to for the issuance of a license, procedure or certificate or for the approval of any service.

  • Technical Investigation: An investigation conducted by the Authority by a team or through one of its employees nominated by a decision of the President to carry out the investigation of a specific accident or incident or to investigate accidents or incident that may occur in the future, and the investigation is limited to the technical aspects without criminal, in order to determine the causes of the accident or incident and propose appropriate recommendations. The purpose of the investigation may be to verify mis service, find out its causes and propose appropriate recommendations. 

  • Mobility equipment: Any means specifically designed to assist persons with disabilities or persons with reduced mobility in their personal mobility; including electric or manual wheelchairs, walkers, crutches, canes or other means of mobility.

Chapter Two: Scope of application of the regulation and Railway campus

Chapter Three: Establishing public facilities and transferring their ownership

Article Four: Approval of the infrastructure owner and/or manager

  • Works related to the construction of service lines, public utility networks or oil and gas pipelines shall not be carried out or laid through the railways or their right of way  without obtaining the approval of the owner or manager of the railway infrastructure. The execution of the works shall be in accordance with the plan set and approved by the owner or manager of the railway infrastructure. 

Article Five: Rules and Requirements for the Establishment of Public Utilities

  • 1. The owner or manager of the railway infrastructure shall determine - in a document prepared for this purpose - based on the guideline or policies established by the Authority regarding technical requirements or safety measures, the  technical ,safety requirements and rules, to which entities intending to establish service lines, public utility networks or oil and gas pipelines and extending them through railway lines or their right of way, must adhere to, and submit them to the Authority.

  • 2. The Authority approves the rules and requirements submitted by the owner or the infrastructure manager and may amend them if the technical or safety needs required so.

Article Six: Procedures for the Establishment of Public Utilities and Intersecting Networks with the Railway Network

  • The procedures for the establishing of public utilities and the extension of their networks through the railway right of way or at the intersection with them shall be in accordance with the following: 

    • 1. The public utilities entities who are intending to establish lines or networks and supply them through railway right of way or intersecting with them shall submit a written request to the owner or manager of the railway infrastructure to obtain its approval, and the establishment of any public facility or any of its networks may not be commenced before obtaining such approval.

    • 2. The owner or manager of the railway infrastructure shall notify the entity of its decision whether approval or non-approval in writing, and in the event of non-approval, the response shall be justified.

    • 3. In the event that the applicant entity is not satisfied with the reasons for the non-approval, or if the owner or manager of the railway infrastructure does not respond to its request, the entity shall inform the Authority in writing of the non-approval of the owner or manager of the railway infrastructure or its failure to respond to its request.

    • 4. The Authority shall study the reasons for the non-approval or non-response of the owner or manager of the railway infrastructure to the request. The Authority may direct the owner or the railway infrastructure manager as it deems appropriate.
