The following words and phrases - wherever they appear in this Regulation - shall have the meanings indicated opposite each of them, unless the context of the text dictates otherwise:
Law: Tourism Law.
Regulation: Regulation of the Private Tourist Hospitality Facility.
Ministry: Ministry of Tourism.
Minister: Minister of Tourism.
Private Tourist Hospitality Facility: A furnished, independent real estate unit owned by an individual and licensed by the Ministry, providing daily accommodation services to tourists for a fee.
Travel and Tourism Service Provider: The licensed party authorized to provide marketing and booking management services for units of the Private Tourist Hospitality Facility.
Authorization: A document issued by the Ministry approving the practice of the Private Tourist Hospitality Facility activity.
Authorized Person: Any natural person holding an authorization from the Ministry in accordance with the Law and Regulation.
Tourist: A natural person who stays - legally - for the purpose of tourism for no less than one night outside their usual place of residence legally for tourism purposes, or benefits from one or more of the services of tourism, complementary, and specialized activities.
Procedural Guides: A document containing instructions, guidelines, standards, or others to specify the detailed procedures complementing the Regulation in accordance with the provisions of the Law and its regulations.
Official Address: The address registered in the authorization, or the national address, or the communication means related to the activity practitioner - of all types - obtained by the Ministry.
The Regulation organizes the practice of private tourism hospitality activities, and specifies the controls for obtaining the permit, its requirements and procedures, the ongoing obligations that must be followed, and the general provisions.
The activity of a private tourism hospitality facility may not be conducted without obtaining a permit, or after its expiration or cancellation, or during the period of its suspension.
Regulations for Issuing the Permit:
1- The tourist accommodation facility must be located within a property designated for residential or agricultural use.
2- The total number of permits issued to the permit holder for a single property shall not exceed (3) permits.
The Minister - or his delegate - may, by his decision and for reasons deemed appropriate by the Ministry, suspend the issuance of the permit for a specified period in any geographical area.
It is required when submitting a claim for a permit to provide the following:
1- Must be a Saudi national.
2- An electronic ownership deed or an electronic lease contract, proving the right of ownership or usufruct of the property subject to the permit - where applicable.
3- No objections from the owners in the shared real estate where the private tourist accommodation facility is located regarding daily leasing.
4- Updated official data for the applicant and the private tourist accommodation facility,
and the applicant must fill out the specific form for the permit application.
Without prejudice to the conditions stated in Article (5) of the Regulation, the claimant, in the event that the number of permits issued to them exceeds (8) permits, must submit a valid contract with the authorized facility management provider for the duration of its validity, covering the period of its effectiveness.
Without prejudice to the authority of the Minister referred to in Article (4) of the Regulation, the Ministry shall, after the availability of the specified controls and conditions for the permit in Articles (4), (5), and (6) of the Regulation in the permit application, and the payment of the financial fee according to the attached financial fee schedule of this Regulation; issue the permit.
1- The permit must contain the details of the permit holder and the specific tourist accommodation facility, the date of issuance and expiration, and any other information specified by the Ministry.
2- The validity period of the permit shall not exceed (one year).
