Implementing Regulation of the Law on the Use of Surveillance Cameras

Review of the Preamble

Article 1

  • 1- The phrases contained in this Regulation shall have the meanings specified before each of them in Article One of the Law.

  • 2- The following phrases - wherever they appear in the Regulation - shall have the meanings specified before each of them:

    • A- The Directorate: General Directorate of Public Security.

    • B- The Electronic Platform: The platform designated by the Directorate for receiving reports and requests for the transfer of registrations.

    • C- Women's Salons: Places designated for hairdressing and other types of beauty treatments.

    • D- Women's Clubs: Clubs designated for practicing sports activities.

Article 2

  • 1- Those subject to the provisions of the Law are required to install security surveillance cameras to cover the following areas:

    • A- Entrances of the facility within the range of identity recognition.

    • B- Stores and warehouses.

    • C- The main hall and corridors on all floors of the facility.

    • D- Reception offices within the range of identity recognition.

    • E- Automated teller machines.

    • F- Emergency exit doors, emergency assembly points, and fire equipment locations.

    • G- Entrances and exits of parking lots within the range of vehicle plate reading and identity recognition.

    • H- Entrances to communication rooms, internal networks, and electrical rooms within the range of identity recognition.

    • I- Drop-off and pick-up areas for visitors from vehicles within the range of vehicle plate reading and identity recognition.

    • J- Areas for unloading and loading goods and service areas.

    • K- Gas cylinder storage area/room and its surrounding area.

    • ل- Electrical room/storage area and its surrounding area.

    • م- Water tank storage area/room and its surrounding area.

    • ن- Central air conditioning room/storage area and its surrounding area.

    • س- Fuel stations covering fuel pumps, tanks, and surrounding areas.

    • ع- Stairs and escalators.

    • ف- Locations specified in the terms document.

  • 2- Commercial and economic establishments – which are located within (enclosed shopping centers and buildings designated for offices) – are exempt from the requirement to install external security surveillance cameras for the shops or offices.

  • 3- The Director of Public Security shall issue a decision to add any location, activity, or facility that he deems necessary to obligate the installation of security surveillance camera systems.

Article 3

  • Those subject to the provisions of the Law, in addition to the technical specifications outlined in the terms document, shall adhere to the following controls:

    • A- Installation of security surveillance camera systems in secure, clean locations, and subject to continuous monitoring by the establishment.

    • B- All storage media must be dedicated solely to security surveillance camera systems, with compliance to the requirements of the National Cybersecurity Authority when connecting and integrating with other networks, after obtaining the approval of the Ministry.

    • C- Access to the security surveillance camera systems in the establishment shall be restricted to authorized personnel only.

    • D- There must be a record of the entry and exit data of those authorized to access the security surveillance camera systems.

    • E- Immediate notification to the Directorate – through the electronic platform – of any incident that prevents the operation of the security surveillance camera systems, and the removal of that incident as quickly as possible.

Article 4

1- The directorate issues a certificate of compliance with the requirements for the installation of security surveillance camera systems.

2- The relevant government authorities responsible for licensing those subject to the provisions of the law to engage in any activity must not issue or renew the license without the certificate mentioned in paragraph (1) of this article.

Article 5

1- Those subject to the provisions of the Law are obligated to connect the security surveillance camera systems to the operations rooms – according to the classification of site sensitivity (Appendix 1).

2- The Director of Public Security shall update the classification of site sensitivity whenever necessary and publish the classification on the ministry's website.

Article 6

1- The person responsible for the location, activity, or facility subject to the provisions of the law shall be notified of the existence of a report regarding any security incident by the competent authority upon its initiation, and a written acknowledgment shall be obtained from them to retain the recordings until the investigation procedures are completed or for the duration specified in the terms document, whichever is longer.

2- Those responsible for the locations, activities, or facilities subject to the provisions of the law must not deliver the recordings except upon an official request from the enforcement authorities of the Ministry of Interior and the Presidency of State Security.

Article 7

  • The procedures for applying for a License to practice any of the activities specified in Article Five of the Law are as follows:

    • 1- Fulfillment of the conditions stipulated in the terms document.

    • 2- Submission of the License application to the Directorate.

    • 3- Completion of the designated form for obtaining the License.

    • 4- Attachment of a copy of the identity if the applicant is an individual, or a copy of the identity of the owner of the establishment along with the Commercial Register, and a copy of the Commercial Register and the Articles of Incorporation if the applicant is a company.

    • 5- A declaration indicating awareness of the conditions and regulations for practicing the activity and a commitment to comply with them.

Article 8

  • 1- Security surveillance cameras shall be installed in women's salons and women's clubs in the locations specified in paragraphs (A, B, D, W, Z, H, T, K, L, M, N) of Article Two of the Regulation.

  • 2- The provisions of paragraph (B) of Article Six of the Law shall not apply to filming for scientific purposes in operating rooms or similar, after obtaining the approval of the Ministry.

  • 3- The activation of the audio recording feature in security surveillance cameras is prohibited unless approved by the Directorate.

  • 4- The use of thermal cameras is prohibited unless approved by the Directorate.

  • 5- A privacy mask must be added and activated to obscure the view and recording from locations that enjoy privacy in the following cases:

    • A- The use of cameras with panning and zooming capabilities.

    • B- When installing external cameras on surfaces that extend their monitoring range beyond the boundaries of the site, or the boundaries of the building, or the boundaries of the residential complex.

    • C- The use of cameras with high specifications or with zoom capabilities that exceed (150) meters.

  • 6- Those subject to the provisions of the Law must place warning signs – according to the two forms shown in the conditions document – at all entrances and exits of the establishment, activity, or facility, in a visible location.

Article 9

A request for the transfer of registrations – detailing the justifications that necessitate the transfer – is submitted on the electronic platform.
