Rules for Monitoring State Properties and Removing Trespassing

First

The following words and phrases – wherever they appear in these regulations – shall have the meanings specified next to each of them:

1- Regulations: Regulations for Monitoring State Properties and Removing Trespassing.

2- State Properties: Any property located within the territory of the Kingdom of Saudi Arabia, detached from private ownership; whether it has state deeds or not.

3- Trespassing: The act of taking possession of any state property or acting upon it without a legal basis, or preventing others from entering it, or altering its features in any way, including: planning it, cultivating it, constructing on it, fencing it, placing barriers on it, filling it, agreeing upon it, extracting raw materials from it, or exploiting it – either permanently or temporarily – for purposes that violate the relevant regulations, orders, decisions, and instructions.

4- Trespasser: Any individual, whether a natural or legal person, who has committed any of the acts or actions referred to in paragraph (3) of this item.

5- Main Committee: The committee responsible for monitoring state properties and removing trespassing, established in the Emirate of each region.

Secondly

The purpose of these regulations is to protect state properties from any encroachment, to preserve them, and to take the necessary measures for their removal.

Thirdly

The main committee is formed in the Emirate of each region, chaired by a representative from the Emirate of the region and consisting of representatives from the Ministry of Justice, the Ministry of Municipal and Rural Affairs and Housing, the Ministry of Environment, Water, and Agriculture, and the State Properties General Authority, provided that the rank of the representatives from these entities is not less than the tenth rank or its equivalent. The main committee has the authority to form subcommittees in the governorates and centers whenever necessary, and to delegate any of the tasks of the main committee mentioned in the regulations, except for matters related to issuing demolition orders.

Fourthly

The Committee shall undertake the following tasks:

1- Monitoring state properties, protecting them from any trespassing, and maintaining them within the scope of administrative supervision of the region.

2- Issuing the necessary decisions to remove trespassing on state properties, and obtaining approval from His Highness the Emir of the region.

3- Supervising the implementation of the removal of trespasses after the necessary decisions have been issued and ensuring that there are no violations in the execution.

4- Preparing monthly reports on the progress of its work and the challenges it faced, and submitting them to His Highness the Emir of the region.

Fifthly

The headquarters of the Committee shall be in the Emirate of the region, and it shall be provided with the necessary support to carry out its work.

Sixthly

Each main committee shall be responsible for monitoring state properties and protecting them from any encroachments, as well as maintaining them within the administrative scope of the region, in accordance with the mechanisms that achieve its assigned tasks, which shall include:

1- What it is informed of by ministries and other government agencies.

2- Reports received from individuals with natural or legal status.

3- Information provided by aerial and satellite imagery.

Seventhly

The Committee shall undertake the following actions in order to execute the tasks assigned to it based on these rules:

1- Inspect the site of any state property that has been trespassed upon.

2- Halt any trespassing on state properties that have been violated.

3- Prepare a report indicating that the Committee has verified the trespassing and any available documents or records related to the site, which shall be signed by all Committee members, in accordance with the procedures outlined in these rules.

Eighthly

The trespasser must remove the trespass at their own expense within a period not exceeding ten days from the date of being notified. In the event of their refusal or delay, the trespass will be removed under the supervision of the Committee.

Ninth

The government entities – each in their respective capacity – shall cooperate with the Committee in implementing the decision to remove the trespassing, and the Committee may seek assistance from the private sector in providing the equipment necessary for the removal.

Tenth

The trespasser is required to pay the costs of removal and all consequences arising from the trespassing, including compensation for the affected parties and expenses, such as compensation for the extraction of raw materials and the costs of restoring the site to its original condition before the trespassing.
