The terms and phrases mentioned below - wherever they appear in these regulations - shall have the meanings specified next to them, unless the context of the text requires otherwise:
Ministry: Ministry of Human Resources and Social Development.
Minister: Minister of Human Resources and Social Development.
Deputy Minister: Deputy Minister of Human Resources and Social Development for Labor
Law: Labor Law.
Regulations: Regulations for practicing recruitment activities and providing labor services.
Supportive Labor: Service workers who work in the employer's home and those in similar positions of both genders.
Professional Labor: They are professional service workers and those in similar positions of both genders.
Specialized Labor: Labor that works for an individual employer in specific specialized professions, provided that this labor holds a scientific qualification or vocational training in a specific field.
Client: Any natural or legal person who contracts with the licensee to provide labor services for a specified period
Relevant Agency: The agency responsible for the services provided to licensees under the organizational structure of the ministry or any ministerial decisions issued to regulate that.
Employer: Any natural or legal person who contracts with a recruitment company to mediate the recruitment of a supportive worker,
Employee: Any natural person who works for the benefit of an employer and under their management or supervision for a wage, even if they are outside of their direct oversight.
Local Labor: It is the labor coming from both males and females within the Kingdom from categories for which specific instructions have been issued to regulate their conditions for the benefit of employers.
Company/Licensee: The company licensed to practice the activities regulated by the provisions of these regulations.
Foreign Investor: An establishment licensed by the Ministry of Investment in the Kingdom owned by non-Saudis, with previous experience in the workforce and a valid license.
Applicant: The person who applies to the ministry for initial approval or a license to establish one of the entities specified in these regulations.
Activity: The activity permitted for the licensee to practice according to the provisions of these regulations.
Initial Approval: Approval granted by the ministry to the applicant to start establishing one of the entities specified in these regulations, and does not authorize them to practice the activity.
License: A document issued by the ministry to the applicant after fulfilling the conditions and requirements specified in these regulations and related systems, authorizing them to practice the activities they are licensed for according to these regulations.
Senior Management: The administrative positions represented by the president, board member, managing member, CEO, and any other positions specified by the relevant agency.
Recruitment Costs or Related Costs: Any fees or costs incurred in the recruitment process to enable supportive and professional labor to obtain job opportunities or for employers or clients to obtain the service, regardless of the method or location of applying or collecting those costs.
Sending Offices: Any office, company, or recruitment agency outside the Kingdom licensed in their country to recruit and send supportive and professional labor, and approved on the electronic platform for providing and employing supportive and professional labor, according to the specifications approved by the ministry.
Approved Platform: An electronic platform through which the operations of licensees are documented, such as "Musanid, Ajir Recruitment, and any platform approved by the ministry.
Supporting Activities: The works or services that support the main activities mentioned in the regulations aimed at improving the quality of services provided by the licensees mentioned in these regulations.
Possible Activities: The works or services of an indirect nature related to the main activities mentioned in the regulations, which the licensee can practice according to the controls mentioned in the regulations.
These rules aim to regulate the practice of recruitment activities and the provision of labor services, as well as the supervisory and regulatory activities and the powers exercised by the Ministry over the licensed entities. The provisions of these rules apply to every entity licensed to engage in one or more of the recruitment activities and the provision of labor services specified in these rules or any other recruitment activity approved by the Ministry.
The agency specifies the standards and requirements for the activities that the licensee is permitted to engage in, and it has the authority to restrict the license with specific conditions that define the activities or the geographical area of the license.
An applicant whose request has been previously rejected may not submit a new license application unless one year has passed from the date of rejection.
The agency has the right to inquire and verify (security and credit) the historical records of natural and legal shareholders of the claimants with government or private entities inside or outside the Kingdom to ensure the accuracy of the submitted data and documents.
1- The Ministry issues the license to the applicant after fulfilling all the required conditions and procedures according to these rules, including but not limited to:
A- Providing human resources and systems.
B- The necessary equipment to start the activity.
2- The agency may take the necessary procedures to verify that the applicant meets the requirements mentioned in these rules by all means, such as visiting the company's headquarters, meeting its officials, and reviewing its systems, procedures, and records, and it may revoke the preliminary approval if the applicant does not meet these requirements.
