Implementing Regulation of the Statute for the Services of Umrah Performers and Visitors of the Prophet's Mosque Coming from Outside the Kingdom

Chapter 1: Definitions

New Section

  • The following terms mentioned in this regulation shall have the meanings indicated opposite each of them unless the context requires otherwise, and words in the singular form also include the plural form whenever the text requires and vice versa.

    • 1. Kingdom: Kingdom of Saudi Arabia.

    • 2. Statute: Statute for the Services of Umrah Performers and Visitors of the Prophet's Mosque coming from outside the Kingdom, issued by Council of Ministers decision No. 93 dated 10/6/1420H.

    • 3. Ministry: Ministry of Hajj.

    • 4. Representation: Embassy or Consulate of the Custodian of the Two Holy Mosques.

    • 5. Umrah Performers: Persons coming from outside the Kingdom of Saudi Arabia to perform Umrah rituals and visit the Prophet's Mosque.

    • 6. Licensed Entity: Any establishment, whether a Saudi institution or company, regardless of its legal form, licensed to engage in Umrah services as recorded in the commercial register of the institution or company.

    • 7. Responsible Manager: The manager responsible for the Saudi institution or company seeking to obtain a license for Umrah services as recorded in the commercial register of the institution or company.

    • 8. Branch Offices: The offices that the licensed entity must have in each of Makkah, Madinah, and Jeddah according to paragraph (3) of Article Three of the statute.

    • 9. External Entity: Any establishment, whether an agency, office, or travel company officially licensed in other countries to engage in organizing travel and tourism trips outside those countries.

    • 10. Service Contract: The contract concluded between the licensed entity and the external entity.

    • 11. Official Entity: Any ministry, government department, or public institution in the Kingdom of Saudi Arabia.

    • 12. Approved Service Levels List: The detailed list of Umrah service levels, types, grades, specifications, and prices of each, referred to in clause (3) of Article Five of the statute.

    • 13. Committee: The permanent committee referred to in Article Eight of the statute.

    • 14. Defendant: The person against whom a complaint has been filed before the committee in accordance with the provisions of the statute and this regulation.

Chapter 2: Procedures for Obtaining the License and Its Conditions

  • The issuance of a license to practice Umrah services requires fulfilling the following requirements:

    • 1. The establishment applying for the license must take the form of a sole proprietorship or a company formed in accordance with the provisions of the Companies Law, and an official document from the Ministry of Commerce must be submitted indicating that the capital of the establishment is fully owned by Saudis and not less than five hundred thousand riyals.

    • 2. An unconditional final bank guarantee in the amount of two hundred thousand riyals in favor of the Ministry, issued by one of the local banks accredited by the Saudi Arabian Monetary Authority, valid throughout the license period and automatically renewed with the renewal of the license, and not subject to cancellation except with prior written approval from the Ministry.Throughout the license period and automatically renewed with the renewal of the license, and not subject to cancellation except with prior written approval from the Ministry.

    • 3. A copy of the commercial register of the establishment if the license applicant is a sole proprietorship.

    • 4. A copy of the company’s articles of incorporation and its amendment annexes if the license applicant is a company, along with a copy of the commercial register.

    • 5. Adding the Umrah service activity to the commercial register of the license applicant based on a referral from the Ministry to the Ministry of Commerce.

    • 6. A copy of the civil status ID card of the responsible manager and the branch office managers.

    • 7. A copy of the certificate of no criminal record for the branch office managers as well as for the owner of the sole proprietorship if the establishment applying for the license is a sole proprietorship.

    • 8. The administrative organizational structure for the Umrah services activity according to the requirements determined by the Ministry.

    • 9. An engineering drawing showing the locations of the branch offices in each of Makkah Al-Mukarramah, Al-Madinah Al-Munawwarah, and Jeddah.

    • 10. Copies of lease contracts or ownership deeds for the branch offices.

    • 11. Availability of computers and software according to the Ministry’s requirements, including linking the licensee’s network with the Ministry’s network to achieve automatic transfer of the required information in this regulation from the licensee’s network to the Ministry’s network.

    • 12. Filling out the license application form prepared by the Ministry, to be signed by the responsible manager.

    • 13. Approval of the Minister of Hajj.

Article 3

The originals of the documents referred to in the previous article must be brought for comparison with their copies submitted with the license application. After ensuring the match, the relevant ministry employee will annotate the copy as matching the originals.

If the individual commercial enterprise applying for the license is owned by a woman, she must have a legal Saudi agent authorized with powers enabling him to undertake and follow up on the procedures for obtaining the license and to represent her before the Ministry and others, and he must be responsible for managing the activity of pilgrim services.

The responsible manager, branch office managers, and service supervisors must be Saudi nationals of good conduct and behavior, none of whom have been previously convicted of a crime related to security breach or sentenced to a legal limit or discretionary punishment in a crime involving dishonor or breach of trust recorded in the criminal record - unless their reputation has been restored.

Article 8

In the event of the termination or expiration of the services of the responsible manager or the manager of one of the licensed branch offices, a new manager meeting the conditions stipulated in this regulation must be appointed within a period not exceeding sixty days from the date the position becomes vacant, and the Ministry must be notified of the new manager's name no later than three days from the date his name is registered in the Commercial Register.
