Regulation on Temporary Work Visas and Temporary Work for Hajj and Umrah Services

    • After reviewing the correspondence received from the Royal Court No. 78651 dated 1/11/1445 AH, including the telegram of His Excellency the Minister of Human Resources and Social Development No. 129827 dated 11/7/1442 AH, regarding the draft regulation for temporary work visas and temporary work for Hajj and Umrah services.

    • After reviewing the aforementioned draft regulation.

    • After reviewing the minutes No. (182) dated 24/4/1443 AH, No. (74) dated 24/2/1444 AH, No. (329) dated 12/11/1444 AH, memoranda No. (1358) dated 15/8/1442 AH, No. (2122) dated 16/9/1443 AH, No. (1381) dated 4/5/1444 AH, No. (1085) dated 1/4/1445 AH, No. (2313) dated 26/6/1445 AH, No. (2882) dated 9/8/1445 AH, No. (4400) dated 29/12/1445 AH, and No. (793) dated 5/3/1446 AH, prepared by the Bureau of Experts at the Council of Ministers.

    • After reviewing the recommendation prepared by the Council of Economic and Development Affairs No. (6-17/45/D) dated 25/4/1445 AH.

    • After considering the Shura Council decisions No. (153/21) dated 29/7/1444 AH, and No. (278/27) dated 27/10/1445 AH.

    • After reviewing the recommendation of the General Committee of the Council of Ministers No. (2700) dated 16/3/1446 AH.

    • Decides:

      • Approval of the regulatory regulation for temporary work visas and temporary work for Hajj and Umrah services, in the attached form.

Chapter 1: Definitions

Article 1

  • For the purposes of applying this Regulation, the words and phrases mentioned below - wherever they appear herein - shall have the meanings specified next to each of them:

    • Regulation: The regulatory regulation for temporary work visas and temporary work for Hajj and Umrah services.

    • Ministry: Ministry of Human Resources and Social Development.

    • Minister: Minister of Human Resources and Social Development.

    • Visa Applicant: The establishment managed by a natural or legal person that employs one or more workers for any type of wage.

    • Temporary Work Visa: The license to enter the Kingdom to perform a specific job for a specified duration.

    • Temporary Work Visa for Hajj and Umrah Services: The license to enter the Kingdom to perform a specific job related to Hajj and Umrah services during the Hajj season and Umrah season services.

    • Supervising Authority: The authority overseeing the activity or project for which temporary work visas for Hajj and Umrah services are requested.

 

Chapter 2: Temporary Work Visa

Article 2

  • 1- The Ministry, in coordination with the relevant authorities, shall determine the purposes and professions covered by the temporary work visa.

  • 2- The Ministry, in coordination with the relevant authorities, shall specify the technical and professional requirements that must be met by the employee applying for the temporary work visa.

 

Article 3

  • 1- The validity period of the temporary work visa (one year) from the date of issuance.

  • 2- The Ministry automatically cancels the unused temporary work visa after the expiration of its validity period, or earlier at the request of the applicant, who in this case is entitled to a refund of the fee paid.

 

Article 4

  • The duration of stay for the holder of a temporary work visa is ninety (90) days from the date of entry into the Kingdom. The Ministry has the authority to extend this duration for an equivalent period once. The visa holder must leave the Kingdom before the expiration of this period.

 

Article 5

  • The Ministry is responsible for studying applications for temporary work visas, determining their numbers, and issuing the necessary permits, in accordance with the specified conditions and regulations.

 

Article 6

  • The Ministry automatically sends the permits for the temporary work visa to the Ministry of Foreign Affairs; for the issuance of the visa, after the Kingdom's representations abroad have taken the necessary procedures to verify the employee's eligibility to obtain the visa.

 

Article 7

  • The applicant for the temporary work visa must submit to the Kingdom's representations abroad, prior to being granted the visa, the following:

    • 1- A copy of the work contract signed by both parties.

    • 2- Medical insurance for the worker for whom the visa is requested.
