Rules and Procedures for Settling Violations of the Copyright Law

Chapter 1: General Provisions

Article 1

  • The following words and phrases - wherever they appear in these rules - shall have the meanings set forth opposite each of them:

    • Law: Copyright Law.
    • Regulation: Implementing Regulation of the Law.
    • Rules: Rules and Procedures for Settling Violations of the Law.
    • Authority: Saudi Authority for Intellectual Property.
    • Council: Board of Directors of the Authority.
    • President: Chief Executive Officer of the Authority.
    • Violations: Violations referred to in Article (Forty-Seven) of the Law.
    • Applicant: The natural or legal person attributed with committing a violation of the Law, or his legal representative.
    • Settlement: A voluntary procedure between the Authority and the Applicant, aimed at settling the violation attributed to him in accordance with the provisions of the Law and these Rules.
    • Committee: Committee for Considering Settlement Requests for Violations of the Law formed pursuant to Article (Four) of the Rules.
    • Competent Department: The department concerned with receiving the settlement request at the Authority, examining it, and completing its requirements.

Article 2

These rules aim to regulate the procedures for settling violations recorded during the Authority's performance of its tasks referred to in Article (43) of the Law.

Article 3

The provisions of these rules apply to the claims submitted to the Authority by the applicant regarding violations detected during the Authority’s performance of its duties, and settlement requests are not accepted from those considered as returning persons according to the provisions of the Law.

Article 4

One or more committees called the (Committee for Considering Requests to Settle Violations of the Copyright Law) shall be formed by a decision of the President. The number of its members shall not be less than (three), and it shall be chaired by a person with legal qualification. The decision shall include the approval of the committee's working procedures, the mechanism for holding its meetings, issuing its recommendations, the settlement recommendation form, and the appointment of its Secretary - if any.

Chapter 2: Provisions and Procedures of Settlement

Article 5

1- The settlement request shall be submitted to the Authority with complete data according to the designated form within a period not exceeding fifteen (15) days from the date of notifying the violator of the completion of the control and investigation procedures.

2- The competent administration may request any additional data or documents it deems necessary, provided that the applicant completes the required information within a period not exceeding ten (10) working days from the date of notification. The competent administration may extend this period if deemed appropriate, provided that the extension does not exceed ten (10) working days.

Article 6

The competent department shall examine the settlement request within a period not exceeding thirty (30) working days from the date of completion of all documents and regulatory requirements, and shall refer the request to the committee for consideration.

Article 7

The Committee shall study the settlement claims referred to it and issue its recommendation - according to criteria adopted by the Council - within thirty (30) working days from the date the claim is referred to it by the competent administration.
