Rules of Procedure for Committees Reviewing Violations within the Geographical Jurisdiction of the Royal Commission for Al-Ula Governorate

  • Decision of the Governor of the Royal Commission for AlUla No. (451843) dated 25/12/1445 AH

  • The Governor of the Royal Commission for AlUla, after reviewing the decision to form the Committee for Considering Violations of the Tourism Law and its regulations within the geographical scope of the Commission, and the decision to form the Committee for Considering Grievances regarding the Licensing and Supervision of Entertainment Activities Regulation within the geographical scope of the Commission, and after reviewing Clause (Third) in the aforementioned decisions, which includes approval of the rules of work for the two committees in the form accompanying the decisions, and based on the powers granted to him.

  • Decides the following:

    • First: Approval of the rules of work for the Committees for Considering Violations within the geographical scope of the Royal Commission for AlUla (the Rules) in the form attached.

    • Second: The Rules shall replace the rules of work for the Committee for Considering Violations of the Tourism Law and its regulations within the geographical scope of the Commission, and the rules of work for the Committee for Considering Grievances regarding the Licensing and Supervision of Entertainment Activities Regulation within the geographical scope of the Commission issued by our decision No. (451802) dated 10/3/2024 AD.

    • Third: The Rules shall be effective from the date of their approval and published in the Official Gazette.

    • Fourth: This decision shall be communicated to the chairpersons and members of the committees, and to those concerned for its enforcement and implementation.

Chapter 1: Definitions

Article 1

  • The following words and phrases - wherever they appear in these regulations - shall have the meanings specified before each of them, unless the context requires otherwise:

    • The Laws: The laws of activities whose tasks and competencies have been transferred to the Commission by Royal Order No. (A/38) dated 29/1/1442 AH.

    • The Regulations: The regulation of penalties for municipal violations issued by Council of Ministers Decision No. (92) dated 5/2/1442 AH, and the regulations, decisions, and executive instructions for the laws and regulations.

    • The Commission: The Royal Commission for AlUla.

    • The Council: The Board of Directors of the Commission.

    • The Governor: The Governor of the Commission.

    • The Committee: Any committee formed to consider violations of the laws and regulations within the geographical scope.

    • The President: The President of the Committee.

    • The Member: A member of the Committee including the President and Vice President, and the alternate members.

    • The Competent Administration: The Disputes and Enforcement Administration at the Commission.

    • The Secretary: The Secretary of the Committee.

    • The Rules: The operational rules of the Committee within the geographical scope of the Commission.

    • The Geographical Scope: AlUla Governorate, and the heritage and cultural sites in Khaybar Governorate, the Al-Mu'tasim Castle, and any other sites outside its boundaries that may later be added to the Commission's competencies and tasks.

    • The Violation: Any incident that violates the laws or regulations within the geographical scope.

    • The Violator: The person committing the violation, whether a natural or legal person.

    • The Commission Inspector: The person who has been issued a decision by the Governor or his delegate, either individually or with others, to undertake inspection tasks.

    • The Technical Means: The electronic means adopted by the Commission for the purpose of implementing the law and regulation.

    • Procedural Guidelines: A document issued in accordance with the laws that includes instructions, guidelines, standards, or others to determine the detailed procedures complementing the rules.

Chapter 2: The Purpose of the Rules and Their Scope of Application

Article 2

  • The rules aim to achieve the following:

    • 1- Enhance performance and effectiveness in accomplishing the tasks related to the Committee's work.

    • 2- Define the responsibilities, duties, competencies, and tasks assigned to the Committee and its members, as well as its operational procedures, in accordance with the relevant regulations, rules, and other related instructions.

    • 3- Define the tasks of the competent administration within the scope of implementing these rules.

Chapter 3: Formation of the Committee

Article 4

  • 1- The formation of the Committee shall be in accordance with the provisions of the regulations, and its work shall commence from the date specified in the formation decision.

  • 2- The formation decision shall specify the President of the Committee and any alternate members, if applicable, provided that the President is among the specialists in Sharia or regulations - as the case may be.

  • 3- The term of membership in the Committee shall be three (3) years, renewable by a decision of the Governor.

  • 4- In the event that the term of membership specified in paragraph (3) of this article expires and the Committee is not renewed, or another Committee is not formed, the Committee shall continue to carry out its work until a decision is issued by the Governor either to extend the current membership or to form another Committee.

  • 5- The Governor, in the event of a vacancy in the membership of one of the Committee members for any reason, may appoint a substitute from outside the members, and the appointment shall be to complete the remaining term of the predecessor in the Committee's membership.

  • 6- The Governor may reconstitute or dissolve the Committee in light of the reasons submitted by the relevant administration, as required by the public interest.

Chapter 4: Termination of Membership in the Committee

Article 5

  • The membership of a Committee member ends upon their death, or by an order from the governor in one of the following cases:

    • 1- The expiration of the membership term stipulated in the formation decision, or its termination due to resignation, health incapacity, or upon the occurrence of anything that affects their eligibility.

    • 2- Acceptance of the member's apology for continuing their membership in the Committee.

    • 3- The member's absence from (three) consecutive sessions, or (five) separate sessions within one year without an excuse accepted by the Chair of the Committee. In this case, the relevant administration must present the matter to the governor or their delegate to consider issuing a decision to terminate their membership and appoint someone to replace them for the remaining duration of their membership.

    • 4- The member's conflicts of interest with their role in the Committee, in accordance with the conflict of interest policy approved by the authority.
