Technical Regulation for Suspended Vehicle Installations

Preamble

In line with the Kingdom of Saudi Arabia's accession to the World Trade Organization in accordance with Council of Ministers Decision No. 244 dated 21/9/1426 AH, regarding the approval of the documents for the Kingdom's accession to the World Trade Organization, and the requirement for the Kingdom to align its relevant systems with the principles of the organization's agreements, especially the Agreement on Technical Barriers to Trade (TBT), which stipulates that unnecessary technical requirements should not be imposed on the flow of goods between member countries, and that there should be no discrimination between products of different origins in terms of technical requirements and conformity assessment methods, this is to be achieved through the issuance of technical regulations that include legitimate basic requirements and unify work procedures.

Based on Article Three (Paragraph - 1) of the Organization of the Saudi Standards, Metrology and Quality Organization issued by Council of Ministers Decision No. 216 dated 17/6/1431 AH corresponding to 31/5/2010 AD, which states that the organization shall "issue Saudi standard specifications, quality systems, and conformity assessment guides that comply with international standards and guidelines, meet the requirements of the World Trade Organization Agreement in this field, and are compatible with Islamic law and serve the interests of the Kingdom."

According to Article Four (Paragraph - 2) of the Organization of the Saudi Standards, Metrology and Quality Organization issued by Council of Ministers Decision No. 216 dated 17/6/1431 AH, corresponding to 31/5/2010 AD, which states that the organization shall "issue regulations for the conformity assessment of goods, products, and services in accordance with the standard specifications it adopts."

Based on Article Four (Paragraph - 14) of the Organization of the Saudi Standards, Metrology and Quality Organization issued by Council of Ministers Decision No. 216 dated 17/6/1431 AH, corresponding to 31/5/2010 AD, which states that the organization shall "review the regulatory systems and regulations related to the fields of the organization's work, develop them, and propose the necessary amendments to keep pace with quality and safety requirements, and refer them to the competent authorities for study and issuance in accordance with legal procedures."

According to Article Six (Paragraph - 1) of the Organization of the Saudi Standards, Metrology and Quality Organization issued by Council of Ministers Decision No. 216 dated 17/6/1431 AH, corresponding to 31/5/2010 AD, which states that "subject to the provisions of Article (Four) of this organization, the organization is the reference in the Kingdom for everything related to standard specifications, conformity assessment procedures, and granting quality and measurement and calibration marks. All government and private sectors must comply with Saudi standard specifications in all their purchases and operations."

Since the standard specifications for products covered by one of the regulations are considered the basis for the conformity of those products with the essential safety requirements in the specified regulation, the organization has prepared this technical regulation.

Note: This preamble and all annexes to this regulation are an integral part of it.

Article (1): Terms and Definitions

Article (2): Scope

  • 1/2 This Regulation applies to new suspended installations designed for the transportation of persons, to modifications of suspended installations that require a new license, and to the subsystems and safety components of suspended installations.

  • 2/2 The following are exempt from the application of this Regulation:

    • A- Products covered by the Regulation for electric elevators used in buildings and facilities.

    • B- Suspended installations classified as historical, cultural, or heritage, which were put into service before January 1, 1986, and are still in operation, which have not undergone any significant changes in design or construction, including the subsystems and safety components specifically designed for them.

    • C- Installations designated for agricultural and forestry purposes.

    • D- Suspended installations serving shelters and mountain cabins designated solely for the transportation of goods and specifically designated persons (qualified/specialist individuals).

    • E- Equipment that is existing on-site or mobile and designed exclusively for recreational and entertainment purposes and not as a means of transporting persons.

    • F- Installations related to mining or other industrial installations on-site used in industrial activities.

Article 3: Objectives

This regulation aims to define the basic requirements for suspended installations and their accessories, covered under the scope of this regulation, and to specify the conformity assessment procedures that suppliers must adhere to, in order to ensure that these products comply with the basic requirements aimed at preserving the environment and the health and safety of their users, as well as facilitating market surveillance procedures.

Article 4: Obligations of the Supplier

  • The supplier must comply with the following requirements:

    • 1/4 Technical requirements

    • The supplier must meet the technical requirements for suspended installations and their appurtenances, as follows:

      • 1/1/4 The products must comply with the technical requirements stated in the relevant standard specifications outlined in Appurtenance (1).

      • 2/1/4 The suspended installations, their infrastructure, subsystems, and safety components must meet the essential requirements stipulated in Appurtenance (2) of this technical regulation.

      • 3/1/4 The supplier must ensure that the subsystems or safety components are designed and manufactured in accordance with the essential requirements stipulated in Appurtenance (2), when placed on the market or when integrated into the suspended installations.

      • 4/1/4 The supplier must establish the necessary procedures to keep the production chain compliant with the requirements of this regulation. Changes in the design of subsystems or safety components or their characteristics, as well as changes in standard specifications or other technical specifications, must be taken into account.

      • 5/1/4 The supplier must ensure that the subsystems or safety components placed on the market bear a type, batch, or serial number, or any other element that allows for their identification. If the size or nature of the subsystem or safety component does not allow for this, the supplier must provide the required information on the packaging or in the accompanying documents for the subsystems or safety components.

      • 6/1/4 It must be taken into account that the safety of suspended installations depends on the surrounding conditions, the quality of the supplied system components, and the method of assembly, installation on site, maintenance, and monitoring during operation.

      • 7/1/4 The essential requirements must be interpreted and applied in a manner that considers the latest developments at the time of design and manufacturing, as well as the technical and economic considerations that align with a high degree of health and safety protection.

      • 8/1/4 Suppliers must indicate at least the following data on the subsystems or safety components:

        • A- Manufacturer's name.

        • B- Registered name/brand.

        • C- Mailing address through which they can be contacted.

        • If it is not possible to indicate the required data on the product, it must be indicated on the packaging or in the accompanying documents.

    • 2/4 Entry into service

      • 1/2/4 The competent authorities shall take all appropriate measures to determine the necessary procedures to ensure that suspended installations enter into service only if they comply with this regulation and do not pose a risk to the health or safety of persons or property when installed, maintained, and operated correctly according to their intended purpose.

      • 2/2/4 Suspended installations that comply with the standard specifications or parts thereof are considered to meet the essential requirements stipulated in Appurtenance (2) covered by the standard specifications or parts thereof.

      • 3/2/4 This regulation does not affect the right of the competent authorities to impose requirements that they may deem necessary to ensure the protection of persons or workers when using the relevant suspended installations.

    • 3/4 Metrological requirements

    • International System (SI Units) or its multiples or parts must be used for suspended installations, subsystems, and safety components during design, manufacturing, or trading, in accordance with the Saudi Measurement and Calibration System.

    • 4/4 Licensing requirements

      • 1/4/4 The competent authorities shall establish licensing procedures for the construction and entry into service of suspended installations that fall within their jurisdiction.

      • 2/4/4 Submission of the safety report referred to in Article (7), the conformity declaration, and other documents related to the compliance of subsystems and safety components, in addition to documents related to the characteristics of the suspended installations to the competent authorities.

      • 3/4/4 The documents related to the products must also include the necessary conditions, including operational restrictions, and complete details for the service, supervision, modification, and maintenance of the suspended installations. A copy of these documents must be retained at the time of installation.

      • 4/4/4 In the event of any modifications to the significant characteristics or subsystems or safety components of existing suspended installations, a new entry into service permit from the competent authorities is required, and these modifications and their implications for the overall cable installation must meet the essential requirements stipulated in Appurtenance (2).

      • 5/4/4 This regulation does not affect the right of the competent authorities to determine the appropriate procedures for licensing planned suspended installations, inspecting suspended installations before entering into service, and monitoring them during operation.

      • 6/4/4 The competent authorities have the right to establish procedures for licensing the construction of planned suspended installations, modifying these installations, and entering them into service to ensure the safe construction and assembly of suspended installations on site, in accordance with the safety analysis, the results of which are included in the safety report, and all relevant regulatory requirements.

    • 5/4 Operational requirements

      • 1/5/4 The supplier must ensure that the suspended installations remain in operation only if they comply with the conditions stipulated in the safety report.

      • 2/5/4 When the supplier finds that the licensed suspended installations used according to their intended purpose may pose a risk to the health or safety of persons or property, they must take all appropriate measures to restrict the operating conditions of the suspended installations or prohibit their operation.

      • 3/5/4 The competent authorities have the right to establish procedures to ensure the safety of suspended installations at the time of their construction, entry into service, and during their operation.

      • 6/4 Requirements related to packaging

        • 1/6/4 Ensure the safe and sound assembly and arrangement of suspended installations and their appurtenances during storage and transport, in accordance with the packaging requirements stipulated in the relevant standard specification.

Article 5: Obligations of the Owner

Compliance with the requirements of this regulation and any other requirements or regulations issued by the relevant authorities is mandatory, and obtaining the necessary licenses from the competent authority in accordance with the regulations and legislation issued in this regard in the field of this regulation is required.

Article 6: Obligations of the Operating Entity

1/6 The operating entity must comply with the requirements of this technical regulation and fulfill the conditions issued by the relevant authorities.

2/6 The relevant authorities must be notified about the products that have been completed and prepared for public use, to subject them to inspection processes before they are put into service.

3/6 Periodic inspections must be conducted on the installations of suspended vehicles, and cooperation with the relevant authorities and inspection bodies must be ensured to carry out all necessary inspection operations.

4/6 Regular maintenance must be performed on the installations of suspended vehicles.

5/6 Safety instructions on site must be followed, daily inspections must be conducted, and safe operation must be ensured.

6/6 The relevant authorities must be informed about the installations of suspended vehicles that may pose a risk during use, and the corrective actions that have been taken to ensure user safety.

7/6 Any other requirements specified by the relevant authorities.

Article 7: Safety Analysis and Safety Report for Planned Suspended Installations

  • 1/7 The supplier of the suspended installations must conduct a safety analysis for the planned suspended installations or delegate someone to carry it out.

  • 2/7 The safety analysis for the planned suspended installations must identify the components upon which the safety of the suspended installations depends.

  • 3/7 The required safety analysis must take into account, for all suspended installations, the following:

    • A- Considering all anticipated work methods.

    • B- Following an accepted or established method.

    • C- Taking into account the current state of technologies and the complexity of the suspended installations involved.

    • D- Ensuring that the design and configuration of the suspended installations consider the local environment and the most adverse conditions to ensure satisfactory safety conditions.

    • E- Covering all aspects of safety in the suspended installations and their external factors in the context of design, construction, and commissioning.

    • F- Allowing for the identification of risks from previous experiences that may occur during the operation of the suspended installations.

  • 4/7 The safety analysis must cover safety devices and their effects on the suspended installations and related subsystems, such that the safety devices are as follows:

    • A- Capable of interacting with the initial collapse or detected failure so that they remain either in a state that ensures safety or in a reduced operational mode or in a safe state from failure.

    • B- Supported by backup devices and monitored.

    • C- The likelihood of their failure can be assessed, and their effects are of an equivalent standard to those achieved by safety devices that meet the criteria specified in points (أ) and (ب).

  • 5/7 The safety analysis must be used to list hazards and hazardous situations, recommend the anticipated measures to address these risks, and identify a list of subsystems and safety components to be integrated into the suspended installations.

  • 6/7 The results of the safety analysis must be included in the safety report.

Article 8: Explanatory Data

The explanatory data for suspended installations, subsystems, and safety components, prepared for placement and display in the market, must meet the following:

1/8 The product's explanatory data must comply with the technical requirements set forth in this technical regulation and the relevant standard specifications, as outlined in Appendix (1).

2/8 The explanatory data must include information, warnings, and operating instructions, and must be in a clear font and in a manner that is difficult to remove.

3/8 The images and phrases used on the product packaging must not violate public order, public morals, or the prevailing Islamic values in the Kingdom.

Article (9): Conformity Assessment Procedures

  • 1/9 The supplier - responsible for suspended installations, subsystems, and safety components in the market - must obtain a Type 3 conformity certificate issued by an entity accepted by the authority, in accordance with the ISO/IEC 17067 standard as detailed in Appurtenance (4).

  • 2/9 An inspection certificate issued by an entity accepted by the authority must be obtained after the installation of the products covered by this Regulation and before they are put into service.

  • 3/9 Periodic inspection and examination operations must be conducted on the products covered by this Regulation to ensure their safety and the safety of their components during use, including transportation, maintenance, and modification operations.

  • 4/9 The accepted entity must implement conformity assessment procedures according to the specified model, ensuring compliance with the requirements of this technical Regulation and the relevant Saudi standard specifications; as outlined in Appurtenance (1).

  • 5/9 A technical file must be attached to the product that includes the following:

    • A- The supplier's (manufacturer/supplier) declaration of conformity according to the model attached in Appurtenance (5).

    • B- Risk assessment document.

  • 6/9 The supplier must cooperate with regulatory authorities and market survey authorities, such as providing documents from the technical file and conformity certificates, and any other documented information that proves the product's compliance with the requirements of this technical Regulation, whenever requested.

  • 7/9 Suspended installations, subsystems, and safety components that have obtained the Saudi Quality Mark or its equivalent are considered compliant with the requirements stipulated in this technical Regulation.
