Technical Regulation for Electromagnetic Compatibility

  • Based on Article Nine of the Authority's Statute issued pursuant to Council of Ministers Decision No. 216 dated 17/6/1431 AH, which stipulates that: "The Council is the competent authority to manage the affairs of the Authority, conduct its matters, and take all necessary decisions to achieve its purposes within the provisions of this Statute."

  • The Authority's Board of Directors approved in its meeting No. (194) held on 13/3/1445 AH, corresponding to 28/9/2023 AD, Decision No. (05/194/2023) including the approval of the following technical regulations:

    • 1- Technical Regulation for Electromagnetic Compatibility, Document No. (M.E-194-23-05-01-01):

      • This technical regulation aims to define the basic requirements for electromagnetic compatibility of equipment, and to specify the conformity assessment procedure that suppliers must comply with, to ensure that these products meet the basic requirements aimed at preserving the environment and the health and safety of their users, and to facilitate market surveillance procedures.

    • 2- Technical Regulation for Electrical Devices and Equipment Intended for Use in Explosive Atmospheres, Document No. (M.E-194-23-05-01-02):

      • This technical regulation aims to define the basic requirements for equipment and protective systems intended for use in explosive atmospheres covered by the scope of this technical regulation, and to specify the conformity assessment procedures that suppliers must comply with, to ensure that these products meet the basic requirements aimed at preserving the environment and the health and safety of their users, and to facilitate market surveillance procedures.

    • 3- General Regulation for Conformity Models, Document No. (M.E-194-23-05-01-03):

      • This regulation aims to ensure the supplier's and issuing bodies' compliance with the approved conformity models in issuing conformity certificates for products covered by the technical regulations issued by the Authority, before placing them on the markets, to enable the competent authorities to verify the extent to which these products meet the requirements set forth in the relevant technical regulations, especially regarding the health and safety of users, consumers, and the public interest.

Article (1): Terms and Definitions

Article 2: Scope

  • This regulation applies to the equipment, in accordance with the definitions and related terms mentioned in Article (1) and the standard specifications included in Appendix (1).

  • Note: Whenever the term "equipment" is mentioned, it includes devices and fixed installations.

  • The following are excluded from the scope of this regulation:

  • A- Wireless communication equipment (radio) and remote communication equipment, commonly abbreviated as (R&TTE) Radio Equipment and Telecommunication Terminal Equipment.

  • B- Aeronautical and aviation products and their spare parts.

  • C- Communication equipment used by amateurs.

  • D- Medical equipment.

  • E- Equipment with the following physical characteristics:

    • 1- Equipment that is incapable of generating or contributing to electromagnetic emissions that exceed the level allowing radio and telecommunications equipment and other equipment to operate as intended.

    • 2- Equipment that is not affected by the presence of electromagnetic interference typically produced by normal use.

  • F- Electronic boards designed for specialists that are used directly for research and development purposes.

Article 3: Objectives

  • This regulation aims to define the essential requirements for electromagnetic compatibility of equipment, and to specify the conformity assessment procedure that suppliers must adhere to, in order to ensure that these products comply with the fundamental requirements aimed at preserving the environment and the health and safety of their users, as well as facilitating market surveillance procedures.

Article 4: Obligations of the Supplier

Article 5: Explanatory Data

  • The explanatory data for the equipment must meet the following:

  • 1/5 Fulfillment of the requirements of the Saudi standard specifications outlined in Appurtenance (1) related to the explanatory data.

  • 2/5 The data must be in Arabic, and it may be written in another language in addition to Arabic, with the Arabic text being the authoritative version.

  • 3/5 The images and phrases used must not violate public order, public morals, and the prevailing Islamic values in the Kingdom.

  • 4/5 The products must display the following information in a visible location and in a manner that clearly shows the following details:

    • - The name and details of the supplier.

    • - The trademark.

    • - The country of origin.

    • - Warnings and safe disposal after use.

    • - Usage warnings.

Article 6: Conformity Assessment Procedures

  • 1/6 The supplier responsible for placing and displaying the devices subject to this Regulation in the market must issue a Supplier Declaration of Conformity in accordance with the model specified in Appurtenance (2), in compliance with the procedures of the internal production monitoring model outlined in Appurtenance (3).

  • 2/6 A technical file as detailed in Appurtenance (3) must be attached to the product.

  • 3/6 The supplier must implement conformity assessment procedures to ensure compliance with the requirements of this technical Regulation.

  • 4/6 Devices that have obtained the Saudi Quality Mark are considered to meet the requirements of this technical Regulation.

Article 7: Responsibilities of Regulatory Authorities

  • The regulatory authorities, within their jurisdiction and powers, shall do the following:

  • 1/7 Verify the compliance of the relevant regulated products with the specified conformity assessment procedures and the technical documents attached to the shipments.

  • 2/7 The regulatory authorities have the right to randomly withdraw samples from the relevant products and refer them to the specialized laboratories to ensure their compliance with the requirements set forth in this technical regulation.

  • 3/7 The regulatory authorities have the right to charge suppliers (manufacturers and importers) for the costs of conducting tests and related matters.

  • 4/7 In the event of a non-compliance case for the product, the regulatory authority shall withdraw the concerned products from the warehouses and take the legal actions against them.

Article 8: Responsibilities of Market Survey Authorities

  • The market surveillance authorities, as part of their jurisdiction and powers, shall undertake the following:

  • 1/8 Implement market surveillance procedures on products displayed in the markets, as well as products stored in the warehouses of traders and manufacturers, to verify the safety of the products and their compliance with the essential requirements outlined in this Regulation and the relevant standard specifications.

  • 2/8 Withdraw samples of the product, whether from the market or the warehouses of suppliers (manufacturers and importers), in order to conduct the necessary tests and ensure their compliance with the requirements stipulated in this Regulation.

  • 3/8 In the event of detecting a non-compliance case for a product - whether displayed or stored - with the requirements of this Regulation, the market surveillance authorities shall take all administrative procedures applicable to the concerned product, and shall apply the procedures and penalties referred to in Article (9), after taking the necessary actions.

Article 9: Violations and Penalties

  • 1/9 The manufacture, import, placement, and display of products that do not comply with the provisions of this Regulation, or even advertising them, is prohibited.

  • 2/9 The failure of a product to meet the requirements of this Regulation is considered sufficient grounds for market surveillance authorities and regulatory bodies to determine that this product is non-compliant, as it may pose a risk to consumer health and safety and to the environment, in the following cases:

    • A- The failure to issue a certificate of conformity or the supplier's declaration of conformity, or their incorrect issuance.

    • B- The unavailability or incompleteness of technical documents (the technical file of the product, declaration of conformity ...), or their containing incomplete or incorrect information.

  • 3/9 Upon detecting any violation of the provisions of this technical Regulation, the market surveillance authorities - as applicable - shall take all necessary measures to remove the violation and its effects from the market, and they may take the following actions:

    • A- Assigning the violating entity - responsible for placing and displaying the non-compliant product - to withdraw it from warehouses or the market for the purpose of rectifying the violation, if possible, or exporting it, within the time frame specified by the market surveillance authorities.

    • B- Withdrawing or seizing the products, or taking any other action to recall them from the markets, and the market surveillance authorities - as applicable - shall announce the recall of the product from the markets, charging the violating entity all costs incurred as a result.

    • C- Dealing with the non-compliant products covered by this Regulation in accordance with what is determined by the applicable laws and regulations of the regulatory authorities of the market surveillance authorities.

  • 4/9 Upon detecting violations of products, the authority shall take the necessary actions against these products that do not comply with the requirements of this technical Regulation, including the cancellation of the related certificate of conformity.

  • 5/9 Without prejudice to any more severe penalties stipulated by the applicable laws, anyone who violates the provisions of this technical Regulation shall be punished with the penalties and fines stipulated in the Anti-Commercial Fraud Law in effect, or any other law that replaces it, or the legislation related to consumer protection.
