The following terms and phrases, wherever stated in these Regulations, shall have the meanings set forth therein unless the context requires otherwise:
1. Authority: The Transport General Authority.
2. President: The President of the Authority.
3. Law:The Commercial Maritime Law issued pursuant to Royal Decree no. M/33 dated 5 Rabi’ II 1440H.
4. Statute:Statute of the Public Transport Authority, issued pursuant to Cabinet Resolution No. (323) dated 14/9/1434 AH, as amended by Cabinet Resolution No. (248), dated 12/6/1437AH and No. (707) dated 30/11 / 1438AH, and No. (631) dated 6/11/1440AH.
5. Regulations:Regulations issued by the Authority in implementation of the law or implementing regulations of international agreements.
6. Regulation:The Regulation organizing the committee for adjudicating objections to violations of maritime transport.
7. Board of Directors: The Authority’s Board of Directors.
8. Competent Department: The department concerned with registration and licensing in the maritime transport sector or any of the departments related to the Authority, or the authority’s branches or representatives in the regions of the Kingdom.
9. Violation:Any act in contravention of the provisions of the Law and the Regulations that is set by the Authority, it is controlled by the authorized employee.
10. Committee: A committee formed by a decision of the president, and it is specialized in examining objections to violations stipulated in the law and regulations.
11. Violator:Anyone who violates the provisions of the law and regulations
12. Members: Members of the Committee
13. Official addresses: The means of communication specified by the practitioners of activities in accordance with what is specified by the regulations - including the national address - and necessary to inform the objector of the correspondence and decisions of the Authority and the Committee.
14. Technical Means: The electronic procedures specified by the authority necessary to inform the objector of correspondence and decisions of the Authority and the committee
15. Violation report or ticket: The tool that the Authority uses during the control and inspection process to detect violations, and it is according to the mechanism approved by the Authority
16. Activities:Maritime transport activities as determined by the Authority
The committee is responsible for hearing and adjudicating objections to violations of maritime transport
1. The committee shall be formed by a decision of the President, and the number of its members shall not be less than (6) six, provided that there must be two legal members, and the decision shall specify the committee chairman, his deputy and its headquarter. It may form more than one committee according to work requirements
2. Members are chosen by decision of the President
3. The term of membership in the committee is (3) three renewable Hijri years, and the member keeps his membership after the end of this period until it is renewed or a successor is appointed.
1. If a member who wishes to discontinue in the membership of the committee or is absent from attending (5) five consecutive sessions, or (8) eight separate sessions during the term of membership, without an excuse accepted by the committee chairman, the committee chairman submits this to the President, and the President may terminate the membership of the apologized member or the absent one and appoint a new member, subject to the provisions of Article (3) in this regulation
2. If the member that wishing to leave or absent- according to Paragraph (1) of this Article - is the committee chairman ,the vice-chairman of the committee submits the proposal to the President to agree to terminate his membership, appoint another member and rename the committee chairman from among the members, in accordance with Article(3 )three of the Regulation
3. If the committee chairman is absent, then the deputy chairman of the committee takes his place in all that is necessary for the conduct of the committee’s work
1- Subject to the rules and instructions of the competent authorities, the remuneration of the chairman and members of the committee shall be determined by a decision issued by the President
2- Members' remuneration is paid monthly, or according to the availability of financial funds decided in the Authority.
The secretary of the committee shall be appointed by a decision of the President, assisted by a number of the authority’s employees as needed, and the decision determines the period of their assignment to work
The secretary of the committee undertakes the provision of technical and administrative services to accomplish the work of the committee as determined by the committee chairman, as follows:
1) Register all complaints and reports of the competent department referred to the committee
2) Preparing and retaining minutes of the committee's sessions and decisions, as well as the Board of Grievances decision issued in this regard
3) Following up the committee's agenda, organize its meetings, informing the members of the sessions
4) Preparing and following up correspondence and notifications exchanged between the committee and other bodies
5) Coordinating with the competent department regarding the requirements of notifications and decisions related to the committee's work
6) Creating a register of the committee's decisions, to record the operative part of the decisions and the data thereof
7) Taking the necessary measures to inform the objector of the decision issued by the committee according to what is stated in Article (14) of this regulation.
