Implementing Regulations of the Succession Commission Law

Article 1

  • A son of every deceased, declining, or incapacitated son, whose condition is established by a medical report, from amongst the sons of the Founding-King Abdulaziz bin Abdulrahman Al-Faisal Al-Saud shall be appointed to the Succession Commission in accordance with the following:

  • First:

    • 1. The King request the sons of a deceased or incapacitated son, who have completed the age of 17, to nominate two or three from amongst them for membership of the Commission. Sons of the sons of a deceased or incapacitated son shall nominate one of them to take part in naming the candidates for membership of the Commission. Nomination of candidates shall take place within 15 days of receiving the nomination order. If the set period lapses without nominating a candidate for membership of the Commission, the King appoints whom he deems fit from amongst them. The Commission's secretary general shall prepare minutes to this effect. Commission meetings and minutes prepared in accordance with this paragraph shall be subject to the rules and regulations governing Commission meetings.

    • 2. The King assigns whom he deems fit from amongst the sons of the Founding-King Abdulaziz bin Abdulrahman Al-Faisal Al-Saud or the sons of the sons to nominate three sons of a deceased or incapacitated son, whose condition is established by a medical report, for the King to select one of them for membership of the Commission. The King may refer said nomination to the sons of the Founding-King to nominate one of the three candidates for membership of the Commission.

    • 3. In all cases, the King may select whom he deems fit from amongst the sons of the deceased, declining, or incapacitated sons for membership of the Commission.

  • Second:

    • If a son of the Founding-King Abdulaziz bin Abdulrahman Al-Faisal Al-Saud declines membership of the Commission, he shall notify the King of his decision in writing and nominate one of his sons for membership of the Commission. If the notification does not include the nomination of any of his sons for membership of the Commission, or if the King does not agree to such nominee, the appointment shall be made in accordance with the provisions of paragraph (First) of this Article. The provisions of this Article shall apply to the Founding-King's patrilineal male descendants.

Article 2

  • A member of the Commission appointed in accordance with Article 1(2) and (3) of the Succession Commission Law shall fulfill the following:

    • 1. Be at least 22 years of age.

    • 2. Be known for his decency and competency.

Article 3

  • Without prejudice to the provisions of Article 1 of the Succession Commission Law, membership of the Succession Commission shall be for a non-renewable term of four years and shall commence from the date specified in the royal order appointing the member.

  • As an exception, the term of a Commission member may, following the King ’s approval, be renewed upon the agreement of his brothers.

Article 4

  • If a Commission member fails to fulfill his membership duties and responsibilities, the matter shall be investigated by a committee comprised of three Commission members selected by the Commission's Chairman. The committee shall submit its findings to the Commission.

  • If two-thirds of the Commission members agree to revoke the membership of the violating member, the matter shall be brought before the King for a decision.

Article 5

  • If the seat of a member of the Succession Commission becomes vacant, the King appoints a replacement in accordance with Articles 1 and 2 of these Regulations.

Article 6

  • Upon the King's death, the Succession Commission shall immediately convene to call for a pledge of allegiance to the Crown Prince as King of the country.

Article 7

  • Pursuant to Article 7 of the Succession Commission Law, the King sends to the Chairman of the Succession Commission, within the ten days following his proclamation as King of the country, a letter naming his choice for Crown Prince for presentation before the Succession Commission, or he may request the Commission to nominate whom it deems fit to be the Crown Prince. The Commission shall name its candidate within ten days of receiving the King ’s letter.

Article 8

  • Meetings of the Medical Committee shall be confidential and attended by the Secretary General of the Commission. The Committee's medical reports shall be prepared at the premises of the Commission and shall be confidential and signed by all members of the Committee.

Article 9

  • Medical reports prepared by the Medical Committee shall be submitted to the Chairman of the Commission in a sealed envelope and may only be disclosed at a Commission meeting.

Article 10

  • In the absence of the two Medical Committee members specified in Article 14(1) and (2) of the Succession Commission Law, or if the position of either member is vacant, it shall be filled by the person entrusted with his duties.

  • In the absence of one of the deans of the colleges of medicine referred to in Article 14(3), the Commission shall choose a replacement from amongst the other deans of the colleges of medicine.
