Statute of the National Center for Government Resource Systems

Article 1

  • The terms and phrases listed below - wherever they appear in this Law - shall have the meanings specified next to each of them:

  • The Center: The National Center for Government Resource Systems.

  • The Law: The Law of the Center.

  • The Minister: The Minister of Finance.

  • The Council: The Board of Directors of the Center.

  • The President: The President of the Council.

  • The Chief Executive Officer: The Chief Executive Officer of the Center.

  • The Unified System: The Unified Government Resource System (UGRP).

  • The Government Resource System: The electronic financial and administrative systems for government resources, which serve government entities, individuals, and private sector entities dealing with those entities. These systems include: the Unified System, and other electronic systems related to finance, accounting, the state budget, government payments, government competitions and procurements, supplier relations, supply chains, asset management systems, government warehouses, invoicing and collection of government revenues, human resources systems, employee affairs, payroll, and self-services for leave requests, work missions, training, and transportation, among others.

  • Government Entities: Entities included in the state budget, entities subject to the application of the Government Competitions and Procurement Law, entities subject to the application of the State Revenues Law, and any laws issued regarding government resource systems.

  • Technical Operation: Daily maintenance and technical operation processes for government resource systems, which include: identifying and upgrading the software and technical hardware that constitute those systems, repairing malfunctions, monitoring performance, and providing technical support to users of those systems.

Article 2

  • The center enjoys legal personality and financial and administrative independence, and is organizationally linked to the Minister. Its headquarters is located in the city of Riyadh, and it has the authority to establish branches or offices within the Kingdom as needed.

Article 3

  • The center aims to achieve the following:

  • 1- To provide standardized and unified electronic systems for managing government resources, supporting the integration, unification, and improvement of procedures among government entities, and enhancing decision-making processes through improved data quality and reporting, in coordination with relevant authorities.

  • 2- To contribute to assisting government entities in planning and managing their financial and human resources and supply chains efficiently and effectively.

  • 3- To work towards achieving spending efficiency by reducing the redundancy of building and operating government resource systems in government entities.

  • 4- To contribute to the unification of controls, standards, and procedures related to government resource systems in government entities, providing flexibility and speed in responding to change requests for those systems, and measuring and analyzing the expected impact of such requests.

  • 5- To contribute to achieving transparency, discovering and reducing errors and violations, and enhancing the integrity and accuracy of data and reports for auditing and oversight processes.

Article 4

  • Without prejudice to the competencies of the relevant authorities, the center shall undertake the following competencies and tasks:

  • 1- Develop policies, strategies, plans, and programs related to government resource systems and their governance, in coordination with the relevant authorities, and complete what is necessary in this regard.

  • 2- Manage and govern the data of government resource systems and utilize it to achieve the center's objectives, and establish the necessary policies and procedures to define the authorities of the beneficiaries of that data.

  • 3- Manage the legal entities of the beneficiaries of government resource systems in accordance with the specifications and policies approved for unified national access to all electronic government portals and services.

  • 4- Utilize the data produced or collected by the center from the beneficiaries of government resource systems, including but not limited to: data processing, storage, and analysis, in a manner that achieves the strategic objectives of the center.

  • 5- Manage and govern the processes of designing and developing detailed work procedures in government resource systems and their continuous improvement, and establish the controls and rules related to these procedures; coordinating this with the relevant government authorities.

  • 6- Administration, design, development, and technical operation of government resource systems.

  • 7- Design, implement, operate, and manage the infrastructure of government resource systems.

  • 8- Provide services related to government resource systems to the beneficiaries.

  • 9- Provide reporting and information services, as well as analysis and forecasting models related to government resource systems, to authorized beneficiaries.

  • 10- Establish the necessary standards, plans, and controls to enforce the application of government resource systems, in coordination with the relevant authorities, and measure performance indicators for operations in government resource systems.

  • 11- Provide supporting electronic services to government entities; to manage their government resources and achieve integration of procedures and data exchange with the systems of government entities, including the central electronic systems and their supporting systems, which the center needs to achieve its objectives or that play a role in enhancing spending efficiency and operations and achieving financial savings for the state.

  • 12- Provide administrative and consulting services and project management for the benefit of government entities; to enable them to utilize government resource systems.

  • 13- Provide training and support services to beneficiaries of government resource systems.

Article 5

  • The center shall have a Board of Directors chaired by the Minister and composed of the following members:

  • 1- Director of the National Information Center.

  • 2- Deputy Minister of Human Resources and Social Development for Civil Service.

  • 3- Governor of the Digital Government Authority.

  • 4- A representative from the Ministry of Defense at the excellent rank.

  • 5- Assistant Minister of Finance for Financial Affairs.

  • 6- Chief Executive Officer of the National Center for Government Resource Systems.

  • 7- At least one specialist representative appointed by a decree from the President of the Council of Ministers based on a proposal from the Minister, with a membership term of three (3) years, renewable once.

Article 6

  • The Council is the supreme authority of the center, responsible for overseeing its affairs, managing it, and conducting its matters. It has the authority to make necessary decisions and procedures to achieve its objectives and exercise its powers within the limits of the center's competencies. Specifically, it has the following responsibilities:

  • 1- Approving the general policy of the center and its operational work plan, which it follows to achieve its purposes, reviewing it, and monitoring its implementation.

  • 2- Establishing appropriate policies and procedures for implementing the unified law.

  • 3- Supervising the implementation of the unified law.

  • 4- Exempting government entities that have independent government resource systems and have security or operational justifications, for a specified period, from applying the unified law to maintain their systems independent of it.

  • 5- Approving the organizational structure of the center.

  • 6- Approving the administrative and financial regulations that the center operates under, provided that the approval of the administrative regulations is in coordination with the Ministry of Human Resources and Social Development, and the approval of the financial regulations and financial provisions in the administrative regulations is in agreement with the Ministry of Finance.

  • 7- Approving the financial fees that the center charges for licenses, permits, and the services it provides in accordance with the regulations.

  • 8- Approving the establishment of branches and offices for the center within the Kingdom.

  • 9- Approving the draft budget of the center, its final account, the auditor's report, and the annual report; in preparation for submitting them for the applicable legal procedures.

  • 10- Accepting gifts, donations, grants, wills, and endowments presented to the center, in accordance with the applicable legal procedures.

  • 11- Appointing an external certified auditor (or more) and an internal financial controller.

  • 12- Approving the conclusion of agreements and contracts according to the applicable legal procedures.

  • The Council may delegate some of its powers to the President or to any of its members or employees of the center as it sees fit.

Article 7

  • The council may form permanent or temporary committees from its members or others, assigning to them such tasks as it deems appropriate. The decision to form each committee shall specify its chairperson, members, and competencies. These committees may seek assistance from whomever they deem necessary to perform the tasks assigned to them.

Article 8

  • 1- The Council meetings are held at the headquarters of the center, chaired by the President or his delegate from the representatives of the government entities that are members of the Council. If necessary, meetings may be held at another location within the Kingdom.

  • 2- The Council meets - at the invitation of the President - once every (three) months, and whenever necessary as determined by the President. The President must call the Council to meet if requested by at least half of the members, provided that the invitation includes the agenda for the meeting.

  • 3- A meeting of the Council is not considered valid unless a majority of the members are present, including the President or his delegate from the representatives of the government entities that are members of the Council.

  • 4- The decisions of the Council are issued by a majority of the votes of the attending members, and in the event of a tie, the side that the President of the meeting voted for prevails.

  • 5- Council meetings may be held remotely using technical means. Decisions can be made by circulating among the members, who sign to indicate their awareness of them. Decisions made in this manner are not considered valid unless all members vote on them, and at least two-thirds of the members approve them. The decisions made in this way are presented to the Council at the first subsequent meeting to be recorded in the minutes of the meeting.

  • 6- The deliberations and decisions of the Council are recorded in minutes signed by the President of the meeting and the attending members, and any member who objects may record their objection with justification in the minutes.

  • 7- No member of the Council may abstain from voting, nor delegate another member to vote on their behalf in their absence.

  • 8- The Council may invite any specialists and consultants it deems appropriate - whether from within the Kingdom or outside it - to attend its meetings and assist it, without having the right to vote.

  • 9- The Secretary of the Council is responsible for preparing for the Council meetings, notifying its members of the dates, and preparing the agenda and decisions, as well as any tasks assigned to him by the Council or the President.

Article 9

  • The center shall have an Executive Director who is appointed and relieved from his position by a decision of the Council, which specifies his salary and other financial benefits. He is responsible for managing the center and its daily operations, and he shall specifically exercise the following authorities:

  • 1- Supervising the workflow of the center through the approved regulations, plans, and programs.

  • 2- Proposing the general policies of the center, its work plan, and its operational plans, and submitting them to the Council, as well as following up on their implementation after approval.

  • 3- Proposing the organizational structure of the center and its administrative and financial regulations, and submitting them to the Council for approval.

  • 4- Issuing the necessary decisions to implement what is required by the organization, regulations, rules, and approved procedures, according to the powers delegated to him.

  • 5- Supervising the preparation of the center's budget draft, its final account draft, and its annual report, in preparation for presenting them to the Council.

  • 6- Appointing employees in the center according to what is determined by the center's regulations, and supervising them.

  • 7- Contracting with experts, consultants, and consulting firms from within the Kingdom or abroad to serve the center's objectives and competencies, according to what is determined by the center's regulations and the applicable legal procedures.

  • 8- Signing agreements, memoranda of understanding, contracts, and other documents after obtaining the Council's approval and in accordance with the applicable legal procedures.

  • 9- Representing the center before judicial, administrative, and other authorities inside and outside the Kingdom, and he may delegate others to do so.

  • 10- Disbursing from the center's budget and taking all financial actions, in accordance with the approved regulations and within the limits of the powers delegated to him by the Council.

  • 11- Submitting periodic reports to the Council about the center's activities, achievements, and challenges it faces, as well as any suggestions he sees for improving workflow.

  • 12- Any other authorities or powers assigned to him by the Council.

  • The Executive Director may delegate some of his authorities and powers to whomever he sees fit among the center's staff, according to what is determined by the center's regulations.

Article 10

  • 1- The center shall have an independent annual budget.

  • 2- The financial year of the center is the same as the financial year of the state.
