Statute of the Technical and Vocational Training Corporation

Article 1

  • The following phrases and terms – wherever they appear in this regulation – shall have the meanings specified next to each, unless the context requires otherwise:

    • Regulation: Regulation of the Technical and Vocational Training Corporation.

    • Corporation: Technical and Vocational Training Corporation.

    • Training: Non-academic programs – varying in forms, levels, and durations – aimed at equipping individuals with practical technical or vocational skills and knowledge.

    • Training Units: The places or facilities where the Corporation conducts training in various organizational forms, names, and locations.

    • Council: Board of Directors of the Corporation.

    • President: President of the Council.

    • Governor: Governor of the Corporation.

Article 2

  • The institution enjoys an independent public legal personality, both financially and administratively, with its main headquarters located in the city of Riyadh, and it has the right to establish branches in various regions of the Kingdom.

Article 3

  • The institution aims to develop national human resources through Training, contributing to meeting the labor market's needs for qualified human resources, and in order to achieve this – without limitation – it may undertake the following:

    • 1- Preparing general policies and plans for Training, reviewing and developing them in accordance with the requirements of national development plans.

    • 2- Qualifying technical and professional trainers and developing them.

    • 3- Designing Training programs and implementing them.

    • 4- Licensing the private sector for Training and supervising it, as well as determining its technical standards.

    • 5- Establishing strategic partnerships with Training institutions in the public and private sectors to manage and operate various Training units.

    • 6- Involving the public and private sectors in Training to provide specialized technical and professional human resources.

    • 7- Providing technical assistance and administrative advice in the field of Training to the public and private sectors.

    • 8- Establishing technical and professional incubators for Training.

    • 9 - Conducting research and studies in the field of Training.

    • 10- Producing Training materials and techniques, and developing them.

    • 11- Holding conferences, seminars, and workshops and participating in them both inside and outside the Kingdom, after completing the necessary legal procedures.

    • 12- Participating in the membership of regional and international organizations, bodies, and institutions concerned with Training, after completing the necessary legal procedures.

    • 13- Providing its views regarding the laws, regulations, and decisions related to Training and proposing what is necessary for their development and submitting or referring them to the relevant authorities according to the established legal methods.

  • 1- The institution shall have a Board of Directors formed as follows:

    • A- Minister of Education   President

    • B- Governor   Vice President

    • C- Representative from the Ministry of Education   Member

    • D- Representative from the Ministry of Finance   Member

    • E- Representative from the Ministry of Human Resources and Social Development   Member

    • F- Representative from the Ministry of Energy   Member

    • G- Representative from the Education Evaluation Authority   Member

    • - Representative from the Ministry of Industry and Mineral Resources   Member

    • - Representative from the Saudi Authority for Industrial Cities and Technology Zones   Member

    • And the ranks of the representatives from the ministries and the authority in the membership of the council must not be less than the rank (fourteenth) or its equivalent.

    • ح - Five members with expertise from the private sector, whose names shall be submitted by the Minister of Education based on a proposal from the Minister of Commerce and Investment in consultation with the Council of Saudi Chambers of Commerce and Industry, and their appointment shall be issued by a decision from the Council of Ministers.

  • 2- Except for the president and vice president, the membership in the council shall be for a period of three years, renewable only once.

  • 3- The attendance allowances for council meetings shall be determined by a decision from the Council of Ministers.

Article 5

Previous Amendments
  • The Council is the supreme authority of the institution and oversees its management and affairs. It has, in particular, the following powers:

    • 1- Approving the draft policies and general plans for training, reviewing and developing them in preparation for their ratification by the Council of Ministers.

    • 2- Approving the general policies for the management of the institution and its organizational structure.

    • 3- Approving the internal regulations of the institution, especially those related to administrative and financial affairs, and the functions of the training authority in various training units in agreement with the Ministry of Finance and the Ministry of Human Resources and Social Development.

    • 4- Approving the regulations governing training in training units, especially those related to determining its hours, plans, durations, leaves, admission conditions, examinations, and certificates.

    • 5- Approving the regulations governing training in the private sector, especially those related to technical standards.

    • 6- Approving the regulations that determine the rewards, allowances, and incentives for trainees in all training units.

    • 7- Approving the establishment of training units in various regions of the Kingdom in accordance with national development plans.

    • 8- Approving the draft annual budget of the institution, its final account, the report of its auditor, its annual report, and submitting them in accordance with the applicable legal procedures.

    • 9- Appointing the internal financial auditor of the institution.

    • 10- Appointing the directors of various training units.

    • 11- Developing human resources in the institution through delegation, scholarships, and training domestically and abroad.

    • 12- Approving the rules related to licenses, permits, services, and works provided by the institution, and determining the financial compensation for them.

    • 13- Approving the purchase and sale of real estate for the benefit of the institution in accordance with its objectives.

    • 14- Accepting donations, wills, and endowments.

    • 15- Appointing a deputy (or more) for the governor in accordance with the applicable procedures.

    • 16- Forming committees derived from the Council and granting them the necessary powers to accomplish the tasks assigned to them.

    • 17- Delegating some powers to the governor or other officials of the institution.

Article 6

  • 1- The meetings of the Council shall be held at the headquarters of the main institution, and they may be held at any other location in the Kingdom when necessary.

  • 2- The President shall call for a meeting of the Council at least once every six months, and he may call for an emergency session whenever he deems it necessary, or if requested in writing by at least four members of the Council, provided that the invitation is sent – in this case – within fifteen days following the submission of the request, and the invitation must include the agenda of the meeting in all cases.

  • 3- The validity of the meeting requires the presence of the majority of the members, including the President or his deputy, and the Council may invite individuals whose expertise and information are deemed beneficial to attend its meetings without having the right to vote.

  • 4- The decisions of the Council shall be issued by a majority of the votes of those present, and in the event of a tie, the side with which the President of the meeting votes shall prevail. A member may not delegate another person to vote on his behalf in his absence, and a member may record his dissenting opinion in the minutes prepared to document the Council's deliberations.

  • 5- A member shall not disclose any information he has obtained regarding the secrets of the institution.

  • The institution shall have an independent budget issued by a royal decree.

  • 1- The funds of the institution consist of the following:

    • A- The funds allocated to it by the state.

    • B- The fixed and movable property under its control.

    • C- The revenues generated from its activities.

    • D- The income from its properties and the returns from their investment.

    • E- Donations, bequests, and endowments.

    • F- Other financial resources approved by the Council, provided they do not conflict with the nature of the institution's activities.

  • 2 - The institution's funds shall be deposited in a separate account with the Saudi Central Bank, and it may open accounts in banks licensed to operate in the Kingdom, with disbursements made in accordance with the institution's budget and its approved financial regulations.

Article 10

  • The financial year of the institution is the financial year of the state.
