Agreement for the Statute of Road Transport Operations for Passengers and Goods between the Government of the Kingdom of Saudi Arabia and the Government of the Kingdom of Morocco

  • Based on the fraternal ties between the Government of the Kingdom of Saudi Arabia and the Government of the Kingdom of Morocco, hereinafter referred to as the contracting parties, and their desire to enhance, develop, facilitate, and organize the land transport of passengers, goods, and materials between their territories and through them in transit, in a manner that aligns with the relations of brotherhood and achieves the common interests and mutual benefits between the two brotherly countries, the contracting parties have agreed to the following:

Article 1

  • The terms and phrases mentioned in this Agreement shall have the meanings specified below wherever they appear:

    • 1- Competent Authorities:

    • The entities authorized in the countries of the contracting Parties to implement the regulations.

    • 2- Carrier:

    • Any natural or legal person holding the nationality of either of the contracting Parties and licensed (authorized) in their country to engage in the activity of transporting passengers or goods or materials for a fee.

    • 3- Means of Transport:

    • Any vehicle that operates on roads with wheels powered by mechanical force (vehicle) and registered in the country of either of the contracting Parties and licensed (authorized) for use in the transportation of passengers or goods or materials
      including the following:

      • A- Private Transport Means:

      • Vehicles intended for personal use and driven by their owner or by someone officially authorized by them to drive it.

      • B- Public Transport Means:

      • Vehicles intended for the transportation of passengers or goods or materials for a fee, including:

        • 1- Buses:

        • Vehicles designed to carry more than eight passengers.

        • 2- Trucks:

        • Single vehicles or those connected to a trailer designated for transporting goods and materials.

    • 4- Standard Fuel Tank:

    • The tank equipped in the means of transport by the manufacturing company.

    • 5- Domestic Transport:

    • The transportation of passengers or goods or materials between two points within the territory of one of the contracting Parties

      • contracting.

    • 6- External Transport:

    • The transportation of passengers or goods or materials between the countries of the contracting Parties.

    • 7- Transit Transport:

    • The transportation of passengers or goods or materials by means of transport belonging to the country of either of the contracting Parties across the territory of the other contracting Party.

    • 8- Regular Service:

    • External transportation of passengers on specified routes.

    • 9- License (Permit):

    • The document granted to the carrier by the competent authority in their country, allowing them to carry out external transport operations.

Article 2

  • The contracting parties allow private means of transport to enter the territory of the other contracting party and to move within it or pass through it within the authorized duration.

Article 3

  • The contracting parties allow for the operation of regular passenger transport services by buses, provided that passengers are carried on round trips through licensed (authorized) dispatch offices approved by the competent authorities. These offices must adhere to the following obligations:

    • A- Ensure that all passengers, drivers, and their assistants possess passports containing valid entry visas for reaching and entering the country of the other contracting party.

    • B- Prepare a list of the names and nationalities of the passengers and provide a certified copy to the driver of the means of transport to be presented upon request by the competent authorities in both countries.

    • C- Place labels on all passenger luggage that indicate the owners.

Article 4

  • The carrier in each country shall appoint an authorized representative in the other party's country, who will manage the transportation activities in that country and shall bear all obligations arising therefrom, as well as those related to the means of transport under its control.

Article 5

  • The contracting parties allow trucks loaded/registered in the country of one party to enter their destinations or to the border centers in the territory of the other contracting party, provided that they comply with the permissible axle loads, dimensions, and weights for traveling on the road network in that country.

Article 6

  • The transfer of goods and materials transiting through the territories of either of the contracting parties is subject to the rules and provisions set forth in the Transit Transport Agreement between the Arab League States, except for goods whose entry is prohibited under the applicable regulations of that country. The competent authorities in the countries of the contracting parties shall exchange lists of these goods, and the driver and his assistant must obtain a visa to enter the third country.

Article 7

  • Subject to the regulations, laws, and internal instructions, the competent authorities of each contracting party shall issue valid entry visas for a period of six months and for multiple entries for the drivers and their assistants belonging to the other contracting party who are engaged in external and transit transport of passengers or goods or materials by public transport means.

Article 8

  • Drivers of transport vehicles belonging to one of the contracting parties, when operating those vehicles in the territory of the other contracting party, must ensure that they possess the following documents, which must be valid, and present them upon request by the relevant authorities in that country:

    • 1- A passport containing all valid entry visas.

    • 2- An international driving license or a local license for nationals of both countries and residents thereof, corresponding to the type of vehicle being driven.

    • 3- A vehicle registration document (form) for the vehicle being driven.

    • 4- A third-party insurance document, covering the driver and passengers, issued by one of the approved insurance companies in the territory of the other contracting party or a unified insurance card.

    • 5- Shipping documents for trucks, which will be agreed upon between the relevant authorities in both countries.

    • 6- A license document (permit).

Article 9

  • Empty public transport vehicles registered in the country of one of the contracting parties are not allowed to enter the territory of the other contracting party to transport passengers, goods, or materials to the territory of the country in which they are registered, except by virtue of a special license (permit) issued by the competent authority in the country from which the transfer will take place.
