Statute of the Digital Content Council

Article 1

The following words and phrases - wherever they appear in this regulation - shall have the meanings specified next to each, unless the context requires otherwise:
Regulation: Regulation of the Digital Content Council.
Council: Digital Content Council.
President: President of the Council.
General Secretary: General Secretary of the Council.
Ministry: Ministry of Communications and Information Technology.
Minister: Minister of Communications and Information Technology.
Digital Content: Material that is circulated and published through electronic media in a digital manner that does not have the nature of private correspondence.

Article 2

A council is established - chaired by the Minister - under the name (Digital Content Council), and its headquarters shall be located in the Ministry in the city of Riyadh.

Article 3

The Council aims to develop and enhance digital content in the Kingdom, coordinate efforts among relevant entities to improve the legislative and regulatory environment for digital content, study the impediments and challenges that hinder the development and enhancement of the digital content sector, propose necessary policies, solutions, initiatives, and recommendations for its development, and follow up on their implementation.

Article 4

Without prejudice to the competencies and responsibilities of other governmental entities, the Council - in order to achieve its objectives - shall undertake the necessary tasks and competencies that serve the purposes for which it was established, and it shall specifically have the following:

  • 1- Organizing the digital content platforms market, and preparing the strategy for digital content platforms in the Kingdom in accordance with the best global practices.

  • 2- Collaborating with governmental entities to develop the systems, regulations, policies, and controls related to digital content and proposing the necessary amendments in coordination with those entities, in order to address developments in digital content and positively reflect on its organization and development, and to elevate what is necessary according to the established procedures.

  • 3- Coordinating with the relevant governmental entities regarding digital content; to keep pace with developments and to reduce technical and organizational overlap and mutual influence among those entities, positively reflecting on the organization and development of digital content, to avoid conflicts between competencies and responsibilities among them, and to ensure they fulfill their roles, achieve their goals, and elevate what is necessary according to the established procedures.

  • 4- Coordinating with the public and private sectors; to organize efforts related to plans and initiatives for the development of digital content, and to follow up on their implementation.

  • 5- Contributing to enabling the private sector to invest in digital content, stimulating local digital content, localizing its jobs, and providing the necessary requirements and facilities to support it.

  • 6- Coordinating with the public and private sectors; to support efforts to establish companies and institutions specialized in digital content.

  • 7- Communicating with public and private entities (including institutions and non-profit organizations) to build partnerships with them, in a manner that serves the Council's objectives and the purposes for which it was established.

  • 8- Coordinating with the public and private sectors; to support efforts related to raising public awareness of the importance of development in the digital content sector, in accordance with the established legal procedures.

  • 9- Evaluating the activities and efforts made by governmental entities in the field of developing and enhancing digital content, and elevating what requires action in this regard.

  • 10- Working to improve the environment of the digital content sector and developing its legislative and regulatory environment, and elevating what is necessary to be elevated according to the legal procedures, and supervising its implementation after approval.

  • 11- Conducting research and studies on topics related to digital content.

  • 12- Identifying the impediments and challenges related to the development of digital content, providing insights and proposing the necessary reforms in this regard to the relevant authorities, and following up on compliance with their implementation.

  • 13- Contributing - in coordination with the relevant authorities - to educating and raising community awareness and disseminating awareness messages, enhancing the concept of the communications and information technology revolution and modern media, and highlighting its role in serving humanity in general and the nation in particular, while warning against the dangers of its harmful content on individuals and society.

  • 14- Contributing to holding workshops and disseminating legal and procedural knowledge regarding the systems, regulations, policies, and controls issued concerning digital content, for specialists and experienced individuals working in the professional consulting sector.

  • 15- Following up on the development of legislation in the field of digital content, participating with relevant entities in conferences and seminars in the field of digital content, enhancing international coalitions, and cooperating with them - according to the established legal procedures - in addressing negative content across various media.

Article 5

Article 6

  • 1- The Council shall meet at the invitation of its President - or his Deputy - at least twice a year, whenever necessary, or at the request of one-third of its members.

  • 2- A meeting shall not be considered valid unless attended by the majority of the Council members, including the President or his Deputy. The invitation to the meeting must be sent in writing at least (seven) days prior to the meeting and must include the agenda and necessary documents. The Council meetings are held at its headquarters, and may, when necessary, be held at any other location determined by the President or his Deputy.

  • 3- The decisions and recommendations of the Council are issued by a majority of the votes of the attending members at least. In the event of a tie, the side that the President of the meeting voted for shall prevail.

  • 4- Meetings may be held and votes on decisions and recommendations may be conducted remotely, using technical means. Decisions and recommendations can be made by circulating them among the members, who shall sign to indicate their acknowledgment. Decisions and recommendations made in this manner shall not be valid unless voted on by all Council members, and a decision or recommendation shall not be effective unless it has the approval of at least two-thirds of the members. The decision and recommendation made in this manner shall be presented to the Council at the first subsequent meeting for documentation in the minutes of the meeting.

  • 5- The Council may invite anyone it deems appropriate to attend its sessions without the right to vote.

  • 6- No member may abstain from voting, nor may they delegate another member to vote on their behalf in their absence.

  • 7- The deliberations, recommendations, and decisions of the Council shall be recorded in minutes signed by the President of the meeting and the attending members.

  • 8- The Council issues the rules and procedures governing the holding of its meetings and the mechanisms for making its recommendations and decisions.

Article 7

  • 1- The council may form permanent or temporary committees from its members or others, assigning them tasks as it sees fit. The decision to form each committee shall specify its chairperson, members, and competencies. These committees may seek assistance from whomever they deem necessary to perform the assigned tasks.

  • 2- The council may seek assistance from consulting offices, experts, specialists, and qualified consultants to aid it in carrying out its tasks.

Article 8

The council shall have a General Secretariat linked to the President, headed by a full-time Secretary-General appointed by the President, and a sufficient number of employees shall be allocated to it, along with the necessary administrative and technical equipment.

Article 9

The General Secretary shall undertake all administrative, financial, and technical secretarial tasks that serve the purposes of the Council, and shall specifically exercise the following powers and responsibilities:

  • 1- Preparing the work of the Council and its subcommittees.

  • 2- Supervising the studies and tasks carried out by consulting offices, experts, specialists, and consultants engaged by the Council; in preparation for submission to the Council.

  • 3- Following up on the work of the committees formed by the Council.

  • 4- Notifying the relevant authorities of the Council's decisions and recommendations, and following up on their implementation.

  • 5- Proposing the regulations governing the work of the secretariat and submitting them to the Council for approval.

  • 6- Preparing reports on the Council's work and achievements at the end of each fiscal year, and submitting them to the Council.

  • 7- Preparing studies and research related to the Council's work. Representing the Council before judicial, administrative, and other authorities. He may delegate others to do so.

  • 8- Any other task assigned to him by the Council.

Article 10

1- The resources of the Council consist of the following sources:
A- What is allocated to it from appropriations within the budget of the Ministry.
B- What the Council accepts in terms of gifts, donations, and grants; in accordance with the regulations governing that.

  • 2- The funds of the Council are deposited in a current account of the Ministry of Finance at the Saudi Central Bank.

  • 3- The Council opens an account for itself at the Saudi Central Bank, and it may open other accounts at any of the banks licensed to operate in the Kingdom, and expenditures from these accounts are made according to the budget of the Council.

  • 4- The Council has a budget (program) within the budget of the Ministry.
