  • Council of Ministers Decision No. (416) dated 19/7/1440 AH

  • The Council of Ministers, after reviewing the correspondence received from the Royal Court No. (58933) dated 17/11/1439 AH, including the telegram of His Excellency the Minister of Environment, Water and Agriculture No. (6789/1/1439) dated 9/11/1439 AH, regarding the draft regulation of the Environmental Fund.

  • After reviewing the aforementioned draft regulation.

  • After reviewing paragraph (2) of Article (24) of the Council of Ministers Law, issued by Royal Order No. [A/13] dated 3/3/1414 AH.

  • After reviewing the server process No. (448) dated 10/3/1440 AH, and memoranda No. [857] dated 15/5/1440 AH, and No. (1246) dated 10/7/1440 AH, prepared by the Bureau of Experts at the Council of Ministers.

  • After reviewing the recommendation prepared by the Council of Economic and Development Affairs No. (2-32/40/D) dated 23/6/1440 AH.

  • After reviewing the recommendation of the General Committee of the Council of Ministers No. (5547) dated 14/7/1440 AH.

  • It is decided as follows:

    • First: Approval of the regulation of the Environmental Fund, in the attached form.

    • Second: 1- The determination of the Fund's capital and the payment schedule shall be agreed upon between the Minister of Finance and the Minister of Environment, Water and Agriculture.

    • 2- All funds related to the Fund's capital shall be deposited in an account with the Saudi Arabian Monetary Authority, designated for disbursement on the Fund's financing activities.

  • Prime Minister

Article 1

The following phrases are intended to have the meanings specified next to each, unless the context indicates otherwise:
Regulation: Regulation of the Environmental Fund.
The Fund: Environmental Fund.
The Ministry: Ministry of Environment, Water, and Agriculture.
The Minister: Minister of Environment, Water, and Agriculture.
The Council: Board of Directors of the Fund.
The CEO: CEO of the Fund.
The National Centers for the Environment and Meteorology Sectors: National Center for Environmental Compliance, National Center for Meteorology, National Center for Wildlife, National Center for Vegetation Cover Development and Combating Desertification, and any other center that may be established in the future for the environment and meteorology sectors.

Article 2

An Environmental Fund shall be established in accordance with the provisions of the regulation, enjoying legal personality and financial and administrative independence. Its main headquarters shall be in Riyadh, and it may, by a decision of the Council, establish branches or offices within the Kingdom.

Article 3

The fund aims to contribute to achieving the national strategy for the environment and the financial sustainability of the national centers for the environment and meteorology sectors, enabling them to carry out their tasks and responsibilities in accordance with the relevant regulations and the organization of each center.

Article 4

The fund shall have all the necessary powers to achieve its objectives, and for this purpose, it has the following competencies:
1 - Financing the approved operational budgets for the national centers in the sectors of environment and meteorology. 
2 - Stimulating environmental protection plans in the Kingdom, along with their activities and initiatives, and contributing to their financing.
3 - Stimulating the sectors of environment and meteorology, as well as the studies and research related to them, and contributing to their financing.
4 - Investing its funds in a manner that achieves its objectives in accordance with the regulations governing that.
5 - Developing plans and programs for financing, stimulation, and investment, and implementing them.
6 - Encouraging investment in areas related to the sectors of environment and meteorology.
7 - Seeking the assistance of experts, specialists, consultants, and others with the qualified and required competencies in areas related to the fund.
8 - Accepting gifts, donations, grants, bequests, and endowments according to the regulations governing that.
9 - Charging fees for the services it provides in order to carry out its activities.
10 - Any other competencies related to its missions as approved by the council.

Article 5

  • 1- The Fund shall have a Board of Directors chaired by the Minister and composed of the following members:

    • A] A representative from the Ministry of Environment, Water, and Agriculture, who shall be a member and the Vice-Chairman.

    • B] A representative from the Ministry of Economy and Planning.

    • C] A representative from the Ministry of Finance.

    • D] Three members who are specialists and have experience in the field of the Fund's work, nominated by the Minister and appointed by a decision of the Council of Ministers, with a membership term of [three] years, renewable once.

  • 2- The rank of the representatives of the government entities in the Council shall not be less than [the fourteenth] rank or its equivalent.

Article 6

The Council is the authority responsible for outlining the general policy of the Fund within the framework of regulations, laws, and other related bylaws. It has the authority to make all necessary decisions to achieve the Fund's objectives, and it also has, but is not limited to, the following competencies:
1 - Supervising the implementation of the tasks assigned to the Fund.
2 - Approving the strategies and policies related to the Fund's activities, as well as the plans, programs, and projects necessary for their implementation.
3 - Determining what should be set aside from investment returns to complete the Fund's capital.
4 - Approving contributions to finance initiatives specific to each center based on the national priorities established by the Ministry.
5 - Approving the organizational structure of the Fund.
6 - Proposing amendments to the regulations in preparation for submission to the Ministry.
7 - Approving the administrative and financial regulations that the Fund operates under, in agreement with the Ministry of Finance, as well as other internal and technical regulations and procedures necessary for managing its affairs and operations.
8 - Determining the financial compensation for the services and works provided by the Fund in its area of expertise to non-national centers in the environmental and meteorological sectors, including sponsorship, advertising, and announcement revenues.
9 - Approving the Fund's budget project, its final account, the auditor's report, and the annual report; in preparation for submission according to the applicable legal procedures.
10 - Reviewing periodic reports on the progress of work in the Fund and making necessary decisions regarding them.
11 - Accepting gifts, donations, grants, bequests, and endowments according to the governing rules.
12 - Appointing an external certified auditor and an internal financial controller.
13 - Determining the investment avenues for the Fund's resources and approving development and investment plans, without prejudice to the funding priorities for national centers in the environmental and meteorological sectors.
14 - Approving the conclusion of agreements and contracts, according to the applicable legal procedures.
To achieve these competencies, the Council may form permanent or temporary committees from its members or others, assigning them specific tasks. It may also seek assistance from experts, specialists, consultants, and others to perform certain tasks within the scope of the Fund's competencies, determining their fees and duration of work.
The Council may also delegate some of these tasks to any of its members or officials in the Fund as required by the workflow.

Article 7

1- The Council shall meet at the invitation of its President at least once every three months, or whenever necessary, and the meeting shall be valid if attended by the majority of the members, including the President or his Deputy.
2- The decisions of the Council shall be issued by a majority of the votes of the attending members, and in the event of a tie, the side with which the President of the meeting voted shall prevail. The President of the Council may invite anyone he deems appropriate to attend the Council sessions to provide information, opinions, or clarifications without having the right to vote.
3- The deliberations and decisions of the Council shall be recorded in minutes signed by the President of the meeting and the attending members.
4- The meetings of the Council shall be held at the headquarters of the Fund, and may, when necessary, be held at another location within the Kingdom.
5- The Council shall issue an internal regulation that organizes its work and the exercise of its competencies and powers.

Article 8

The Fund shall have an Executive President and Deputies who are appointed and relieved by a Decision from the Council. The Decision shall specify their salaries and other financial benefits. The Executive President is responsible for managing the affairs of the Fund, and his responsibilities are concentrated within the limits set by the regulations and approved by the Council. The Executive President shall specifically undertake the following responsibilities:
1- Proposing policies related to the Fund's activities, plans, programs, and projects that ensure the enhancement of services for stimulating and financing the environmental and meteorological sectors and achieving financial sustainability, and submitting them to the Council.
2- Proposing the specific contribution to the financing of each of the national centers for the environmental and meteorological sectors based on the national priorities approved by the Ministry and what the Executive President submits for each center.
3- Supervising the workflow in the Fund according to the approved regulations, plans, and programs.
4- Proposing the administrative and financial regulations that the Fund operates under, as well as other internal and technical regulations and procedures necessary for managing the Fund's affairs, and submitting them to the Council.
5- Proposing the necessary mechanisms for quality and sustainability in the services and works carried out by the Fund, and submitting them to the Council.
6- Proposing the organizational structure of the Fund and submitting it to the Council.
7- Supervising the preparation of the draft budget, final accounts, and annual report of the Fund, and submitting them to the Council.
8- Supervising the preparation of reports related to the implementation of the Fund's plans and programs, and submitting them to the Council.
9- Representing the Fund in its relations with others and before judicial authorities, and he may delegate others in this regard after obtaining the Council's approval.
10- Disbursing from the Fund's budget and taking all financial procedures in accordance with the Fund's regulations.
11- Contracting for the execution of works and providing services, etc., in accordance with the powers delegated to him by the Council.
12- Issuing the necessary Decisions to manage the Fund's affairs, in accordance with the provisions of the regulations and issued regulations.
13- Appointing the Fund's personnel in accordance with the regulations governing that, and supervising them.
14- Any other responsibilities assigned to him by the Council.
The Executive President may delegate some of his responsibilities to whomever he sees fit among the Fund's personnel.

Article 9

The resources of the fund consist of the following sources: 
1- Contributions from the state.
2- Returns from investments of the fund's resources.
3- Donations, grants, bequests, and endowments accepted by the Council.
4- The financial surplus deposited by the national centers for the environment and meteorology in accordance with their regulations.
5- Financial savings from the annual budget allocations designated from the fund to the national centers for the environment and meteorology.
6- The financial fees charged for the services and works provided, and the financial fees collected from the national centers for the environment and meteorology in accordance with their regulations.
7- Any other resource approved by the Council that does not violate the regulations and instructions.
