The words and phrases defined below shall have the meanings assigned to each of them unless the context of the text requires otherwise:
1 - Council of Cooperation: The Council of Cooperation for the Arab Gulf States.
2 - Member States: The member states of the Council of Cooperation.
3 - Supreme Council: The highest authority of the Council of Cooperation, consisting of the heads of the member states.
4 - Committee for Financial and Economic Cooperation: The committee formed by the ministers of finance and economy of the member states of the Council of Cooperation.
5 - General Secretariat: The General Secretariat of the Council of Cooperation.
6 - General Secretary: The General Secretary of the Council of Cooperation.
7 - Authority: The Economic Judicial Authority of the Council of Cooperation.
8 - Circuit: A judicial circuit composed of an odd number of judges selected by the Authority to consider specific lawsuits.
9 - Law: The fundamental law of the Authority.
10 - Internal Regulations: The internal regulations of the Authority.
11 - Economic Agreement: The economic agreement between the member states of the Council of Cooperation. (December 2001).
1 - A judicial body shall be established under this Law, called the Economic Judicial Authority of the Cooperation Council, which shall be independent in making its decisions and rulings, and shall convene whenever necessary to adjudicate the cases brought before it.
2 - The General Secretariat shall undertake the administrative tasks of the Authority and invite judges from the member states.
The authority shall have a General Secretariat consisting of a session clerk and a number of employees, who shall be appointed by a decision of the General Secretary in accordance with the regulations in force in the General Secretariat.
1 - The body consists of twelve judges, with each country nominating two judges. Their appointment and the determination of their remuneration shall be decided by a resolution from the Supreme Council. The term of office for the members of the body is four years, which may be extended.
2 - The body shall hold its first session within three months from the issuance of the Supreme Council's resolution appointing the judges, to elect a President and a Vice President by direct secret ballot. The oldest judge shall preside over the first session until the President and Vice President are elected, and each judge shall have one vote.
3 - The consideration of cases brought before the body shall be through one or more chambers formed by the body, consisting of an odd number of judges not less than three. The resolution forming the chamber shall specify its President and members in accordance with the internal regulations.
4 - The body shall convene at the General Secretariat with the presence of at least two-thirds of its members, including the President or Vice President. It may also convene, when necessary, in any of the member states.
It is required for anyone appointed to the Judiciary in the authority to meet the following conditions:
1 - He must be a citizen of the Gulf Cooperation Council countries.
2 - He must be a judge in his country.
3 - His experience in judicial work must not be less than fifteen years.
1 - Judges shall take the following oath before the President of the Supreme Council in a public session before commencing their duties:
((I swear by Almighty God to judge with justice and to perform my duties with integrity and honesty)).
2 - The taking of the oath shall be recorded in a special register prepared for this purpose and shall be deposited with the General Secretariat.
1- Lawsuits for non-implementation of the provisions of the Economic Agreement, unified laws, or decisions issued in accordance with its provisions shall be submitted to the General Secretariat in accordance with the procedures stipulated in Article (27) of the Economic Agreement.
2 - The General Secretariat shall notify the concerned member states about the subject of the lawsuit immediately upon receiving it, and before referring it to the Economic Judicial Authority.
3 - Lawsuits may not be filed directly before the Economic Judicial Authority.
In consideration of Article (7) of this Law, the Authority shall have exclusive jurisdiction, without any other national judiciary bodies, to hear lawsuits arising from the non-implementation of the provisions of the economic Agreement, unified laws, or decisions issued in accordance with the provisions of the economic Agreement, provided that all parties involved are official entities.
In cases other than those specified in the first paragraph, the parties to the contest may resort to the national judiciary if the contest is not addressed according to the procedures outlined in Article (7).
