Law of the Ministry of Commerce

Article 1

This system is called the Ministry of Commerce Law.

Article 2

The Minister of Commerce is responsible for implementing the commercial policy and the commercial development in the Kingdom in general, as well as for executing the competencies of this Law.

Article 3

  • The Ministry shall establish a Department for Domestic and Foreign Trade specialized in the following:

    • A- Regulating means of developing trade and supervising the regulation of the condition of domestic markets, exploitation, storage, and price pressure when necessary, primarily based on developments in commodity prices generally.

    • Generally.

    • B- The chambers of commerce in the Kingdom shall be affiliated with the Ministry of Commerce, and the Ministry of Commerce shall supervise, establish systems for the chambers of commerce, implement them, guide them to perform their mission, and monitor their accounts due to the connection of all their activities and transactions with the Ministry of Commerce.

    • All their activities and transactions are linked to the Ministry of Commerce.

    • C- Establishing regulations and supervising their implementation concerning all matters related to weights, measures, scales, and stamping related to jewelry and precious metals.

    • D- Regulating all matters related to import and export policy, studying customs tariffs, and their impact on commercial activity.

    • E- Being responsible for studying and organizing investigations related to foreign trade, working to find markets abroad for all types of crops and products, and all matters related to export and supply affairs, as well as studying the country's economic and commercial matters and their relations with foreign trade.

    • F- Studying and drafting commercial agreement projects with other countries in coordination with the Ministry of Foreign Affairs.

    • G- Appointing commercial attachés at foreign representations in coordination with the Ministry of Foreign Affairs.

Article 4

Studying and drafting customs tariff projects and determining customs duties with the Ministry of Finance.

Article 5

  • Establishment of a corporation department specialized in the following:

    • A- Supervising the implementation of the Companies Law, requesting amendments to its regulations, and inspecting them.

    • B- Forming a permanent committee consisting of the Minister of Finance and National Economy and the Minister of Commerce or their representatives to study projects, proposals, and offers that have an investment or concessionary nature and submit their opinions to the Council of Ministers.

Article 6

This Ministry shall establish a Commercial Statistics Department to utilize it and to know the trade balance of general imports and exports and local production of all kinds.

Article 7

Maintaining the trade balance in the Kingdom and working as much as possible to allocate categories to importers each within their jurisdiction to prevent competition in importing that leads to the accumulation of funds and paralysis of commercial movement, and to compensate importers for losses.

Article 8

The items subject to the quota system intended for import from abroad shall have their distribution to the specialized traders regulated under the supervision of this Ministry along with the competent Ministry, and it shall monitor their prices to ensure a reasonable profit for the trader and the retail seller.

Article 9

Combating commercial fraud in all its types and forms without limitation, such as the violation of samples from the sold goods or counterfeiting of brands and trademarks, and everything that falls under this meaning of fraud and forgery methods.

Article 10

Sending a specialized representative on its behalf when one of the ministries is invited to examine tenders related to its jurisdiction in determining prices domestically and internationally.
