Organizational Arrangements for the Non-Oil Revenues Development Center

  • Having reviewed the correspondence received from the Royal Court No. 21290 dated 1439/5/3 AH, including the telegram of His Excellency the Minister of Economy and Planning No. 3901767/1 dated 1439/3/26 AH, and the letter of His Excellency the Minister of Finance No. 3236 dated 1439/4/19 AH, regarding the draft organizational arrangements for the Non-Oil Revenues Development Center.
  • Having reviewed the aforementioned draft arrangements.
  • Having reviewed paragraph (2) of Article (24) of the Council of Ministers Law, issued by Royal Order No. (A/13) dated 1414/3/3 AH.
  • Having reviewed the Royal Order No. (29356) dated 1438/6/24 AH.
  • Having reviewed the decision of the Council of Economic and Development Affairs No. (2-37/34/Q) dated 1437/8/2 AH.
  • Having reviewed the server process No. (982) dated 1439/7/22 AH, and memoranda No. (26) dated 1438/1/11 AH, and No. (1171) dated 1439/8/27 AH, prepared by the Bureau of Experts at the Council of Ministers.
  • Having reviewed the recommendation prepared by the Council of Economic and Development Affairs No. (6-39/41/D) dated 1439/8/1 AH.
  • Having reviewed the recommendation of the General Committee of the Council of Ministers No. (4531) dated 1439/9/23 AH.
  • Decides the following:
  • First: To transform the Non-Oil Revenues Development Unit into a center named (Non-Oil Revenues Development Center).
  • Second: To approve the organizational arrangements for the Non-Oil Revenues Development Center, in the attached form.
  • Third: The center shall be subject to an evaluation prepared by its Board of Directors during the fifth year from the effective date of this decision, including an assessment of the need for its continuation or transformation into another organizational form, and the evaluation shall be submitted to the Council of Ministers to decide what it deems appropriate in this regard.

Article 1

  • The following words and phrases - wherever they appear in these arrangements - shall have the meanings set forth opposite them, unless the context requires otherwise:

    • Center: Non-Oil Revenues Development Center.
    • Arrangements: The organizational arrangements of the Center.
    • Council: The Board of Directors of the Center.

Article 2

The center enjoys legal personality and financial and administrative independence, and it is organizationally linked to the Minister of Finance. Its main headquarters is located in the city of Riyadh, and it may establish branches or offices within the Kingdom as needed.

Article 3

  • The center aims to develop non-oil revenues through the implementation of unified and binding initiatives, models, methodologies, and tools for government entities, and to improve and develop the procedures for collecting revenues of those entities. It undertakes everything related to the development of non-oil revenues in a manner that achieves financial sustainability and diversity in income sources, particularly the following:

    • 1- Supporting government entities and Vision Realization Programs regarding initiatives and proposals related to increasing non-oil revenues, and preparing them to ensure their approval and full implementation.
    • 2- Monitoring the implementation of approved initiatives, overcoming difficulties that government entities may face, and working on their development in light of practical application.
    • 3- Coordinating with government entities and Vision Realization Programs regarding joint initiatives, ensuring the unification of efforts and preventing duplication.
    • 4- Providing proposals related to enhancing the efficiency of government revenue collection and Vision Realization Programs, and submitting them for the necessary follow-up.
    • 5- Providing proposals that lead to an increase in non-oil revenues, and submitting them for the necessary follow-up.

Article 4

The Center shall have a Board of Directors chaired by the Minister of Finance, and membership shall include: the Deputy Minister of Economy and Planning, the Secretary of the Strategic Committee at the Council of Economic and Development Affairs, the Secretary of the Financial Committee at the Royal Court, and the Undersecretary of the Ministry of Finance for Revenue Affairs.

Article 5

  • The Council shall supervise the affairs of the Center and shall take what is necessary to achieve its purposes within the limits of the provisions of these arrangements, and in particular, it shall have the following powers:

    • 1- Approving policies related to the Center's activities and the plans and programs necessary for their implementation.
    • 2- Approving the organizational structure of the Center.
    • 3- Approving the administrative and financial regulations governing the Center in agreement with the Ministry of Finance and the Ministry of Civil Service, as well as other internal regulations necessary for managing the Center's affairs.
    • 4- Approving proposals prepared by the Center regarding the increase of non-oil revenues, as a prelude to completing the statutory procedures related thereto.
    • 5- Approving the establishment of branches or offices of the Center.
    • 6- Appointing an external auditor and an internal financial controller.
    • 7- Approving the draft annual budget of the Center, its final account, the auditor's report, and the annual report; as a prelude to submitting them according to the applicable statutory procedures.
    • 8- Reviewing periodic reports submitted on the progress of work at the Center.
  • In order to achieve these competencies, the Council may form permanent or temporary committees from among its members or others, to which it entrusts the tasks it deems appropriate. The decision forming each committee shall specify its chairman, members, and competencies, and the committee may seek assistance from whomever it deems necessary to perform the assigned tasks.

  • The Council may also delegate some of its powers to its chairman or to any of its members or employees of the Center as it deems appropriate.

Article 6

The Council's meetings are held at the headquarters of the Ministry of Finance or the center, and may, when appropriate, be held at another location as determined by the Council. The Council shall establish the rules and procedures of its work in a manner that enables it to perform the tasks entrusted to it.

Article 7

  • The center shall have a Chief Executive Officer, who is appointed and relieved of his position by a decision of the Council. The decision shall specify his salary and other financial benefits. He shall be responsible for managing the affairs of the center, with his responsibilities concentrated within the limits of these arrangements and what the Council decides. He shall undertake the following competencies:

    • 1- Proposing policies related to the center’s activities, and the necessary plans and programs for their implementation, and submitting them to the Council.
    • 2- Supervising the workflow in the center through the approved regulations, plans, and programs.
    • 3- Proposing the organizational structure of the center and submitting it to the Council.
    • 4- Supervising the preparation of the administrative and financial regulations governing the center, as well as other internal regulations; and submitting them to the Council.
    • 5- Supervising the preparation of the center’s annual report, its draft budget, and final account; and presenting them to the Council.
    • 6- Supervising the preparation of reports related to the implementation of the center’s plans and programs, and presenting them to the Council.
    • 7- Appointing and supervising the employees of the center, in accordance with what is determined by the regulations.
    • 8- Contracting with experts and consultants within the scope of the center’s objectives, and according to what is determined by the regulations.
    • 9- Disbursing from the center’s budget, and taking all financial procedures in accordance with the approved systems and regulations, and within the powers delegated to him by the Council.
    • 10- Representing the center before the judiciary, government agencies, institutions, and other relevant bodies, and other entities inside and outside the Kingdom, and he may delegate others to do so.
    • 11- Any other task assigned to him by the Council.
  • The Chief Executive Officer may delegate some of his competencies to other center staff.

Article 8

1- The center shall have an independent annual budget.

2- The fiscal year of the center shall be the fiscal year of the state.

Article 9

  • The center's resources consist of the following:

    • 1- What is allocated to it in the state's general budget.
    • 2- Any other resource approved by the Council, provided it does not conflict with the regulations and instructions.
