Conditions and Procedures for the Qualification and Accreditation of Training Centers and Testing Centers for Drivers and Operations Managers in Land Transport Activities

Introduction

  • The Transport General Authority aims, through the professional qualification of drivers (trucks, buses, taxis) and operation managers in land transport activities, to enhance the skills and efficiency of employees in the land transport sector, in accordance with the needs of the profession and safety and security standards, as well as the best local and international practices, thereby achieving the economic and social development goals in the Kingdom of Saudi Arabia. This takes into account the technical and environmental aspects, ensuring safe, integrated, and sustainable transport of passengers and goods to their final destinations at the lowest costs, on time, and with the highest standards of quality and safety, in accordance with the Public Transport System on Roads in the Kingdom of Saudi Arabia, issued by Royal Decree No. (M/25) dated 21/6/1397 AH, and the organization of the General Panel issued by Council of Ministers Resolution No. (323) dated 14/9/1434 AH, along with any amendments made to it, and the land transport regulations approved by the authority.

The legal instrument

  • Paragraph (4) of Article Thirty-Two of the Regulation governing the activity of freight transport and truck leasing on land routes, issued by the decision of His Excellency the Minister of Transport and Logistics Services No. (122 /41/ 1) dated 7/5/1441 AH, and its amendments states: “Professional training courses for drivers and drivers of hazardous materials transport shall be held at training centers accredited by the Authority.” Additionally, the Regulation governing the taxi activity and taxi mediation and guidance issued by the decision of His Excellency the Minister of Transport and Logistics Services No. (13 /41/ 1) dated 27/1/1441 AH and its amendments stipulates in paragraph (4) of Article Twenty-Three that “The following conditions must be met for a taxi driver: 4- Must hold a training certificate accredited by the Authority.” Paragraph (First) in paragraph (5) of Article Twenty-Five states: “To obtain a permit to work as a guiding driver with the licensed entity in the guidance activity, the following is required: 5- Passing the training course on dealing with the vehicle guidance system specific to those licensed to practice the guidance activity.” Furthermore, the Regulation governing the specialized transport activity and the leasing and guidance of buses issued by the decision of His Excellency the Minister of Transport and Logistics Services No. (118 /41/ 1) dated 7/5/1441 AH, and its amendments, states in paragraph (6) of Article Twenty-Seven: “The following conditions must be met for the driver or his assistant working with the carrier or lessor: 6- Passing the tests of other training courses specified by the Authority.” Paragraph (5) of Article Twenty-Eight states: “The following conditions must be met for the bus driver working with the electronic guidance mediator: 5- Must hold a training certificate accredited by the Authority.” Additionally, paragraph (7) of Article Twenty of the Regulation governing the educational transport activity issued by the decision of His Excellency the Minister of Transport and Logistics Services No. (119 /41/ 1) dated 7/5/1441 AH, and its amendments states: “The following conditions must be met for the driver: 7- Passing the tests of other training courses specified by the Authority.”

Chapter 1: General Provisions

Article 1: Definitions

  • The following words and phrases - wherever they appear in these Procedures and Conditions - shall have the meanings specified next to them, unless the context of the text requires otherwise:

  • 1- The Authority: The Transport General Authority.

  • 2- Procedures and Conditions: Procedures and Conditions for the qualification and appropriation of training centers and testing centers for drivers and operation managers in land transport activities.

  • 3- Land Transport Activities: Bus transport activities, including (specialized transport, educational transport, intercity and intracity transport), and freight transport activities on land routes, including (truck transport for goods and transport of hazardous materials), and taxi activities, including (public taxi and airport taxi).

  • 4- Drivers: Drivers of land transport activities.

  • 5- Professional Driver Card: A document issued by the Authority or any authorized entity for the driver after passing the professional competency test.

  • 6- Hazardous Materials Transport Driver Card: A document issued by the Authority or any authorized entity for a truck driver transporting hazardous materials after passing the competency test in hazardous materials transport.

  • 7- Qualification and Training: Qualification and training of drivers and operation managers in land transport activities.

  • 8- Test: The professional competency test for drivers and operation managers in land transport activities.

  • 9- Entity: Any legal personality with a legal entity such as institutions and companies.

  • 10- Appropriation: A document issued by the Authority granting the entity permission to conduct qualification and training or testing of drivers and operation managers in land transport activities in accordance with the provisions of these Procedures and Conditions.

  • 11- City of Appropriation: The city or governorate where the entity was approved to conduct training and qualification or testing as an accredited entity by the Authority.

  • 12- Operation Manager: The person responsible for supervising, planning, and operating the transport fleet in the entity for freight transport.

  • 13- Training Center: The entity that has been accredited to conduct qualification and training for drivers and operation managers.

  • 14- Trainee: The ultimate beneficiary of training services (drivers and operation managers).

  • 15- Testing Center: The entity that has been accredited to conduct tests for drivers and operation managers.

  • 16- Professional Competency Test: A test that the driver/operation manager undergoes to ensure the ability to practice the profession with high efficiency.

  • 17- Professional Competency Certificate: A certificate granted after passing the professional competency test.

  • 18- Financial Consideration: The financial resources allocated to the Authority in return for issuing/renewing the appropriation or any other services provided by the Authority.

  • 19- Refresher Course: A course taken at training centers for drivers to ensure their continued eligibility and entitlement to the professional competency certificate.

Article 2

  • The provisions of these terms and procedures apply to practitioners of the training and testing activities.

Chapter 2: Appropriation

Article 4: Renewal of Appropriation

  • Subject to Article (3), the appropriation shall be renewed for a similar duration, and in accordance with the following regulations:

  • Submitting the renewal application and fulfilling all its conditions within the period preceding the expiration date of the appropriation by (60) sixty days.

Article 5: Suspension of Appropriation

  • The appropriation shall be suspended in the following cases:

    • 1- Breach of any of the conditions and requirements of appropriation stated in paragraphs (B/1, C/1, 2, 3, 4) of Article (Three), with a grace period not exceeding (60) sixty days from the date of suspension for the purpose of correction and remediation.

    • 2- Breach of the operational requirements and obligations of training centers and testing centers stated in Chapter (Three) of these procedures and conditions, which have a direct impact on the outcomes of training or testing, with a grace period not exceeding (60) sixty days from the date of suspension for the purpose of correction and remediation.

    • 3- Issuance of a judicial ruling prohibiting the training center or testing center from conducting training or testing.

  • It is prohibited to engage in qualification and training activities or conduct tests during the period of appropriation suspension.

Article 6: Cancellation of Appropriation

  • The appropriation shall be revoked -without any liability on the authority- in the following cases:

    • 1- The request of the training or testing center to revoke the appropriation before its expiration and the authority's approval of that.

    • 2- The waiver of the appropriation without the authority's approval.

    • 3- The passage of a period of (60) sixty days since the appropriation was suspended without addressing the reasons for the suspension.

    • 4- The passage of a period of (60) sixty days since the appropriation expired without renewal.
