    After reviewing the correspondence received from the Royal Court No. 51242 dated 1446/7/16 AH, which includes a letter from His Excellency the Minister of Finance, Chairman of the Board of Directors of the Non-Oil Revenues Development Center No. 6470 dated 1446/7/13 AH, regarding the draft statute of the Non-Oil Revenues Center.
    After reviewing the aforementioned draft statute.
    After reviewing the Organizational Arrangements of the Non-Oil Revenues Development Center, issued by Council of Ministers Decision No. (538) dated 1439/10/19 AH.
    After reviewing memoranda No. (3743) dated 1444/12/4 AH, No. (316) dated 1445/1/28 AH, No. (3702) dated 1446/11/10 AH, No. (249) dated 1447/1/22 AH, No. (1845) dated 1447/5/20 AH, and No. (2981) dated 1447/8/22 AH, prepared by the Bureau of Experts at the Council of Ministers.
    After reviewing the minutes prepared by the Council of Economic and Development Affairs No. (966/47/M) dated 1447/6/13 AH.
    After reviewing the recommendation of the General Committee of the Council of Ministers No. (10534) dated 1447/9/29 AH.
  • It is decided as follows:
  • First: Approval of the statute of the Non-Oil Revenues Center, in the attached form.
    Second: The statute referred to in item (First) of this decision shall, upon its enforcement, replace the Organizational Arrangements of the Non-Oil Revenues Development Center, issued by Council of Ministers Decision No. (538) dated 1439/10/19 AH.
    Third: Government agencies shall provide the Non-Oil Revenues Center with all information and data related to fees, charges, and financial dues imposed by them or by their affiliated or related entities, or by contracted or operating companies on the governmental and private sectors, citizens, and residents, along with a statement of their revenues on an annual basis.

Article 1

  • The following words and phrases - wherever they appear in this Statute - shall have the meanings indicated opposite each of them, unless the context requires otherwise:

    • 1- Statute: Statute of the Non-Oil Revenues Center.
      2- Center: Non-Oil Revenues Center.
      3- Council: Board of Directors of the Center.
      4- Minister: Minister of Finance.
      5- President: President of the Council.
      6- Chief Executive Officer: Chief Executive Officer of the Center.

Article 2

  • The center shall have a public legal personality, financial and administrative independence, and shall be organizationally affiliated with the Minister. Its main headquarters shall be in the city of Riyadh, and it may - when necessary - establish branches or offices within the Kingdom.

Article 3

  • The center aims to support the achievement of non-oil revenue targets - and undertakes all matters related thereto - in a manner that achieves economic balance and financial sustainability through the application of unified initiatives, models, methodologies, and tools for government entities, while taking into account other developmental objectives related to policies, regulations, and procedures.

Article 4

  • The Center, in order to achieve its objectives and without prejudice to the competencies of other government agencies, shall undertake the following:

    • 1- Propose draft laws and regulations related to its fields of competence, and propose amendments to those in force, in coordination with the Ministry of Finance, and submit them in accordance with the applicable legal procedures.
      2- Study and review any request related to imposing, amending, or canceling fees and financial charges, and submit them in accordance with the legal procedures.
      3- Support government agencies by studying any proposal related to imposing a tax before submitting it to complete the necessary legal procedures.
      4- Provide relevant proposals related to the Center’s competencies, including proposals related to enhancing the efficiency of non-oil government revenue collection, and complete the necessary actions in accordance with the relevant procedures and regulations.
      5- Support government agencies during the study, evaluation, signing, or renewal phase of contracts that result in the collection of any financial amounts in exchange for providing or facilitating the implementation of government services.
      6- Coordinate with government agencies to provide the Center with all information and data related to fees, charges, and financial dues imposed by the government agency or its affiliated or related entities, or contracted or operating companies on both the government and private sectors, citizens, and residents, along with an annual statement of their revenues.
      7- Follow up and review approved initiatives and programs of government agencies related to the Center’s competencies, propose necessary changes to ensure the sustainability of non-oil revenues, verify the achievement of their approved targets, and submit them to complete the necessary actions.
      8- Develop policies, plans, programs, standards, manuals, tools, methodologies, and methods related to the Center’s competencies, submit what is required to complete any legal procedures concerning them, and follow up on their implementation after approval.
      9- Participate in studying policies, plans, strategies, and initiatives of government agencies that impact non-oil revenues, in accordance with the relevant legal procedures.
      10- Prepare periodic reports detailing the results of non-oil revenues compared to goals, expectations, and recommendations, including the performance efficiency of government agencies in collecting their non-oil revenues.
      11- Provide support to government agencies regarding requests received by the Center related to establishing or amending existing policies and strategies that may affect non-oil revenues, and the Center may request relevant data to provide opinions thereon, coordinating with other relevant government agencies when necessary.
      12- Participate in studying and reviewing opportunities and proposals for exploiting government assets that will generate non-oil revenues.
      13- Conclude agreements and memoranda of understanding related to its fields of competence with relevant entities outside the Kingdom, in accordance with the applicable legal procedures.
      14- Organize conferences, seminars, and workshops related to its fields of competence, and participate in them inside and outside the Kingdom, in accordance with the applicable legal procedures.
      15- Support and conduct research and studies in its fields of competence, either independently or in cooperation with relevant entities.
      16- Represent the Kingdom externally within the limits of its fields of competence, in accordance with the legal procedures.

Article 5

  • The center shall have a Board of Directors chaired by the Minister, and membership shall include:

    • 1- Minister of Economy and Planning.
      2- Secretary of the Strategic Committee at the Council of Economic and Development Affairs.
      3- Secretary of the Financial Committee at the Royal Court.
      4- The Chief Executive Officer.
    • The President shall select a Vice President from among the members listed in paragraphs (1), (2), and (3).

Article 6:

  • The Council shall supervise the management of the Center’s affairs and conduct its matters, and shall take all necessary decisions to achieve its objectives within the limits stipulated by the statute. In particular, it shall have the following powers:

      1- Approving policies, plans, programs, and projects related to the Center’s fields of specialization, as well as the plans and programs necessary for their implementation, and addressing what is required to complete any procedures related thereto.
      2- Approving the organizational structure and organizational manual of the Center.
      3- Approving the administrative and financial regulations governing the Center, as well as other internal and technical regulations necessary for managing its affairs, provided that the approval of financial regulations and provisions with financial impact in other regulations is made in agreement with the Ministry of Finance, and the approval of administrative regulations is made in agreement with the Ministry of Human Resources and Social Development, taking into account the rules and instructions issued in this regard.
      4- Approving the Center’s draft budget, final account, auditor’s report, and annual report, in preparation for submitting them according to the applicable statutory procedures.
      5- Adopting standards, evidence, tools, methodologies, and methods related to the Center’s specializations.
      6- Reviewing periodic reports submitted to it regarding the progress of work at the Center and taking necessary decisions thereon.
      7- Approving the Center’s conclusion of agreements, memoranda of understanding, and contracts, according to the applicable statutory procedures.
      8- Cooperating with government agencies in developing and adopting the necessary technical enablers, requesting data, information, documents, and papers related to the Center’s specializations to achieve its objectives, including benefiting from and linking to databases available at government agencies.
      9- Accepting gifts, donations, grants, wills, and endowment revenues, according to the rules regulating that.
      10- Approving the establishment of branches or offices of the Center.
      11- Appointing one or more external auditors and an internal financial controller.
      12- Approving proposals prepared by the CEO regarding non-oil revenues, in preparation for completing the necessary statutory procedures.
      13- Forming permanent or temporary committees from among its members or others, entrusted with tasks it deems appropriate. The decision forming each committee shall specify its chairperson, members, and competencies, and the committee may seek assistance from whomever it deems necessary to perform the tasks entrusted to it.
      The Council may delegate any of its powers mentioned in paragraphs (7), (8), and (9) to its chairperson or to any of its members or Center employees as deemed necessary for the workflow.

Article 7

  • 1- The Council shall convene once every (three) months based on an invitation from its President, and whenever the need arises as determined by the President, or if requested by at least two of its members. The invitation must be sent - electronically - at least seven days before the meeting, and must include the agenda, the place of the meeting, and the method of its convening.
  • 2- The Council meetings shall be held at the headquarters of the main center, and it is permissible - by decision of the President or his deputy - to hold the meeting at any other place within the Kingdom.
  • 3- The validity of the Council meeting requires the attendance of the majority of its members at least, including the President or his deputy. Decisions shall be issued by the majority of the votes of those present at least, and in the event of a tie, the side that the President of the meeting votes with shall prevail.
  • 4- No member of the Council may abstain from voting nor delegate another member to vote on his behalf in his absence.
  • 5- The Council’s deliberations and decisions shall be recorded in minutes written in Arabic, approved by the President of the meeting and the members present. A dissenting member may record his objection and the reasons for the objection in the minutes of the meeting.
  • 6- The Council may invite to its meetings those it deems necessary to assist from specialists and consultants - whether from inside or outside the Kingdom - without granting them the right to vote.
  • 7- Meetings may be held and voted on remotely, using technological means, and decisions may be made by circulation among the members, provided that the decision taken in this manner is presented to the Council at the first subsequent meeting to be recorded in the minutes of the meeting.
  • 8- The Council shall appoint a Trustee from among its members or from the center’s employees who shall undertake its secretariat, prepare its meetings, and record the minutes, deliberations, and decisions.
  • 9- Neither a Council member nor the Trustee may disclose anything they have become aware of regarding the center’s secrets even after the end of their membership or employment.

Article 8

  • The center shall have a Chief Executive Officer, who is appointed and relieved by a decision of the Council. The decision shall determine his salary and other financial benefits, provided that it does not conflict with the relevant laws and decisions. He shall be responsible for managing the affairs of the center, with his responsibilities concentrated within the limits of the statute and what the Council decides. He shall undertake the following competencies:

    • 1- Preparing the center’s policies and strategies, plans, and programs within the center’s fields of competence, and the necessary standards for their implementation, and submitting them to the Council for consideration and approval.
      2- Proposing the organizational structure and organizational manual of the center and submitting them to the Council for consideration and approval.
      3- Proposing the financial and administrative regulations governing the center, as well as other internal and technical regulations necessary for managing its affairs, and submitting them to the Council for consideration and approval.
      4- Preparing the standards, evidence, tools, methodologies, and methods related to the center’s competencies, and submitting them to the Council for consideration and approval.
      5- Supervising the preparation of the center’s draft budget, final account, and annual report, in preparation for presenting them to the Council.
      6- Disbursing from the center’s budget and taking all financial procedures in accordance with the approved laws and regulations, within the powers delegated by the Council.
      7- Appointing and supervising the employees of the center, in accordance with the approved regulations of the center.
      8- Contracting with consulting offices, expert firms, and experts within the scope of the center’s activity, and according to what is determined by the approved regulations of the center.
      9- Following up on the implementation of the decisions issued by the Council.
      10- Preparing periodic reports on the center’s work, achievements, and activities, and submitting them to the Council, in preparation for completing what is necessary regarding them.
      11- Submitting proposals prepared by the center concerning non-oil revenues to the Council, in preparation for completing what is necessary regarding them.
      12- Signing agreements, memoranda of understanding, and contracts after the Council’s approval.
      13- Representing the center before the judiciary, relevant government agencies, and other entities inside and outside the Kingdom, and he may delegate others to do so.
      14- Any other work assigned to him by the Council within the scope of competence.
      The Chief Executive Officer may delegate some of his competencies or powers to whomever he deems appropriate from the center’s employees.

Article 9:

  • The center's resources consist of the following:

    • 1- The appropriations allocated to it by the state in the state's general budget.
      2- Donations, gifts, grants, bequests, and endowment revenues accepted by the council in accordance with the applicable regulatory procedures.
      3- Any other resource approved by the council in line with its competencies and without violating laws and regulations.
