Law of Preservation of Water Resources

Article (1)

  • Without prejudice to the rights established by Sharia, water sources are considered public property to be utilized in accordance with the provisions of this law and other regulations.

  • The priority for the utilization of water is as follows:

    • First: Basic human needs.

    • Second: Watering of animals.

    • Third: Requirements for agriculture, industry, urban development, and other purposes, with priorities determined in this case by a decision from the Minister of Agriculture and Water.

  • The Ministry of Agriculture and Water shall repair or fill in the wells that expose water resources to loss or cause damage to the soil or water pollution, at its own expense if they were drilled under a license from the Ministry in accordance with the instructions it has issued. As for the wells that were drilled contrary to this, the Ministry shall repair or fill them in at the owner's expense if the owner fails to repair them within the period specified by the Ministry of Agriculture and Water.

Article 6

  • No well shall be drilled, nor shall a dam or any other water constructions be established, except after obtaining a license from the Ministry of Agriculture and Water, accompanied by the instructions that must be adhered to during execution.

Article 7

  • A - Well drilling contractors must obtain a License from the Ministry of Agriculture and Water to carry out drilling activities, and the License shall not be granted until the contractor is classified.

  • B - Contractors who have been engaged in drilling activities prior to the enforcement of this Law must submit a License application to the Ministry within a period not exceeding one year from its issuance.

Article 8

  • Well drilling contractors must refrain from drilling any well unless the owner possesses the license stipulated in Article Six. In the event that the contractor has the license, they are obligated to comply with the instructions associated with it and will be tasked with repairing any well that is drilled in violation of those instructions.

Article 9

Previous Amendments
  • Anyone who violates the provisions of this law and its executive regulations shall be punished with a fine not exceeding one hundred thousand Riyals. The penalty decision may include a provision for publishing its text at the violator's expense in a local newspaper issued in their place of residence. If there is no newspaper in their place of residence, it may be published in the nearest area, or in any other appropriate medium, depending on the type of violation committed, its severity, and its consequences, provided that the decision is published after it has become final due to the expiration of the legally specified period or its confirmation by the competent court.

Article 10

  • The Ministry of Agriculture and Water may revoke the license in the event of repeated violations, and an appeal may be filed against this penalty before the Board of Grievances within one month from the issuance of the decision.
