Regulatory Arrangements of the Saudi Center for Building Code

Article 1

  • The following words and phrases - wherever they appear in these arrangements - mean the meanings shown in front of each of them:

  • Center: Saudi Building Code Center.

  • Arrangements: Organizational arrangements for the Saudi Building Code Center.

  • Minister: Minister of Municipalities and Housing.

  • Council: Board of Directors of the Center.

  • President: President of the Council.

  • Chief Executive Officer: Chief Executive Officer of the Center.

  • Code: Saudi Building Code.

Article 2

1- The center enjoys legal personality, financial and administrative independence, and is organizationally linked to the Minister.

2- The main headquarters of the center shall be in the city of Riyadh, and it may establish branches and offices within the Kingdom as needed.

Article 3

The center aims to review, update, and develop the technical, scientific, and administrative systems specialized in buildings and structures based on scientific foundations compatible with engineering rules and material properties, natural conditions and risks, and to enhance the quality, stability, and sustainability of buildings. This is achieved by identifying, analyzing, and studying the impediments and challenges facing the public and private sectors in implementing the Law on Implementation of the Saudi Building Code, and practicing professional work compatible with the environment and conditions of the Kingdom, in order to protect lives and property and preserve the national economy.

Article 4

Article 5

  • 1- The center shall have a Board of Directors chaired by the Minister, and membership of each of the following:

    • A- A representative from the Ministry of Interior (General Directorate of Civil Defense).

    • B- A representative from the Ministry of Energy.

    • C- A representative from the Ministry of Municipal and Rural Affairs and Housing.

    • D- A representative from the Ministry of Environment, Water, and Agriculture.

    • E- A representative from the Ministry of Industry and Mineral Resources.

    • F- A representative from the Ministry of Commerce.

    • G- A representative from the Saudi Council of Engineers.

    • H- A representative from the High Commission for Industrial Security.

    • I- A representative from the Saudi Standards, Metrology and Quality Organization.

    • J- A representative from the Saudi Contractors Authority.

    • K- The Chief Executive Officer.

    • L- Two members with expertise and specialization from the private sector in the fields of contracting and engineering consultancy.

  • 2- The rank of representatives from government agencies must not be less than the (fourteenth) rank or its equivalent.

  • 3- The appointment of the two members - mentioned in sub-paragraph (L) of paragraph (1) of this article - shall be issued by an order from the President of the Council of Ministers based on a nomination from the President, and their membership term shall be (three) years, renewable once.

  • 4- The President shall select a Vice President from among the members representing government entities.

  • 5- It is considered that the nominee - for membership of the council - from government entities should have qualifications, experience, or job specializations that are compatible with the work of the center.

Article 6

  • The Council is the supreme authority of the center, responsible for supervising and managing its affairs, and has the authority to make all necessary decisions to achieve its objectives within the provisions of the arrangements, and in particular, it has the following:

    • 1- Propose draft laws and regulations related to its areas of competence, and propose amendments to those in force, in coordination with the relevant authorities, and submit them according to the established legal procedures.

    • 2- Approve policies, plans, programs, and initiatives within its areas of competence, and submit those requiring completion of legal procedures.

    • 3- Approve the policies and mechanisms for publishing the code.

    • 4- Approve the standards, procedures, and models in the areas of the center's competence.

    • 5- Approve the regulations and requirements necessary for the licenses issued by the center related to activities within the center's areas of competence.

    • 6- Establish the requirements and regulations for building inspection during or after the construction phase to ensure compliance with code requirements, in collaboration with relevant authorities and approve them.

    • 7- Approve the financial compensation for services and activities provided by the center in its area of competence, which the council deems necessary to charge for, according to the established legal procedures.

    • 8- Approve the organizational structure and guide of the center, according to the established legal procedures.

    • 9- Approve the financial and administrative regulations that govern the center and other necessary internal and technical regulations for managing its affairs, provided that the approval of financial regulations and provisions with financial impact in other regulations is in agreement with the Ministry of Finance, and the approval of administrative regulations is in agreement with the Ministry of Human Resources and Social Development.

    • 10- Approve the establishment of branches and offices for the center as needed.

    • 11- Review periodic reports submitted by the CEO on the progress of the center's work and make necessary decisions regarding them.

    • 12- Approve the conclusion of agreements and contracts, according to the established legal procedures.

    • 13- Approve the center's budget project, final account, auditor's report, and annual report, in preparation for submission according to the established legal procedures.

    • 14- Appoint an external auditor (or more) and an internal financial controller.

    • 15- Approve the auditor's report.

    • 16- Approve the acceptance of donations, gifts, grants, bequests, and endowments offered to the center, according to the regulations governing that.

    • The council may form committees to which it assigns tasks as it deems appropriate, and it may delegate some of its powers to its president or any of its members.

Article 7

  • 1- The council meets at the invitation of the president at least four times a year, and whenever necessary as determined by the president. The president must call the council to meet if at least one-third of the members request it.

  • 2- The invitation to attend the council meeting must be sent at least seven working days before the meeting date, and it must include the agenda.

  • 3- For the council meeting to be valid, a majority of the members, including the president or his deputy, must be present. Decisions are made by a majority of the votes of those present, and in the event of a tie, the side with which the president of the meeting votes prevails.

  • 4- No member of the council may abstain from voting or delegate another member to vote on his behalf in his absence.

  • 5- A member must declare any conflict of interest in a matter listed on the council's agenda.

  • 6- The council may, when necessary and in urgent cases, hold meetings and vote on decisions remotely using technological means.

  • 7- The council may, when necessary and in urgent cases, issue decisions by circulating them among the members, and they must be signed to indicate that all members have been informed. Decisions issued in this manner are not valid unless all members vote on them, and the decisions must be presented to the council at the next meeting to be recorded in the meeting minutes.

  • 8- The council's deliberations and decisions are recorded in minutes signed by the president of the meeting and the members present. A dissenting member may record his objection and the reasons for it in the meeting minutes.

  • 9- The council may invite those it deems necessary to attend its sessions, without granting them the right to vote.

  • 10- The council shall have a secretary from the center's staff appointed by the council based on the president's nomination. The secretary is responsible for the council's secretariat, preparing meetings, and recording minutes, deliberations, and decisions.

  • 11- A member may not disclose any of the center's secrets that he has become aware of, even after his membership in the council has ended.

Article 8

  • The center shall have a Chief Executive Officer, appointed by a decision of the Council, and the decision shall determine his salary and financial benefits. His dismissal from his position shall be by a decision of the Council, and he is responsible for managing the affairs of the center, with his responsibilities focused within the arrangements and as decided by the Council, and he exercises the following powers:

    • 1- Preparing draft regulations and bylaws related to his areas of jurisdiction, and proposing amendments to those in force, in preparation for presenting them to the Council.

    • 2- Preparing policies, plans, programs, and initiatives within the center's areas of jurisdiction, and submitting them to the Council for consideration and approval.

    • 3- Preparing standards, procedures, and templates in the center's areas of jurisdiction, and submitting them to the Council for consideration and approval.

    • 4- Preparing the necessary regulations and requirements for the licenses issued by the center related to activities within the center's areas of jurisdiction, and submitting them to the Council for consideration and approval.

    • 5- Proposing the financial compensation for the services and activities provided by the center in its area of jurisdiction, and submitting it to the Council for consideration and approval.

    • 6- Following up on the implementation of the decisions issued by the Council.

    • 7- Proposing the organizational structure and guide for the center, and proposing its necessary administrative, financial, internal, and technical bylaws to facilitate its work, and submitting them to the Council for consideration and approval.

    • 8- Supervising the operation of the center and its employees, according to the powers assigned to him and as determined by the center's bylaws.

    • 9- Disbursing from the center's budget and taking all financial procedures, according to the approved regulations and bylaws, and within the powers delegated to him by the Council.

    • 10- Supervising the preparation of the center's budget project, final account project, and annual report, and submitting them to the Council.

    • 11- Representing the center before the judiciary, government agencies, other concerned institutions and bodies, and other entities inside and outside the Kingdom, and he may delegate others to do so.

    • 12- Preparing periodic reports on the center's work, achievements, activities, and the impediments it faces, and submitting them to the Council in preparation for completing what is necessary regarding them.

    • 13- Signing agreements and contracts after the Council's approval, or according to the powers granted to him by the Council.

    • 14- Appointing the center's staff, supervising them, and terminating their services according to the powers granted to him and as determined bythe relevant regulations and bylaws.

    • 15- Contracting with experts, specialists, and consultants in fields related to the center's objectives, according to the approved bylaws of the center.

    • 16- Submitting proposals and recommendations to the Council regarding subjects within his jurisdiction.

    • 17- Exercising any authority assigned to him by the Council.The Chief Executive Officer may delegate some of his powers and authorities to other members of the center's staff.

Article 9

  • 1- The resources of the center consist of the following:

    • A- The financial appropriations allocated to it in the state budget.

    • B- The financial compensation it receives for the work and services it provides.

    • C- Donations, gifts, grants, bequests, and endowment revenues accepted by the council.

    • D- Other resources approved by the council that do not conflict with regulations and instructions.

  • 2- All revenues of the center are deposited in the current account of the Ministry of Finance at the Saudi Central Bank.

  • 3- The center opens an account for itself at the Saudi Central Bank, and it may open other accounts in any of the banks licensed to operate in the Kingdom, and expenditures from these accounts are made according to the center's approved budget.

Article 10

The employees of the center are subject to the Labor Law and the Social Insurance Law.
