Privileged Residency Permit Law and its Executive Regulation

Article 1

Previous Amendments
  • The following words and phrases - wherever they appear in this Law - shall have the meanings set forth opposite each of them:

    • Law: Premium Residency Law.

    • Regulation: Implementing Regulation of the Law.

    • Non-Saudi: A Natural Personality who does not hold Saudi nationality.

    • Premium Residency Holder: A Non-Saudi who has obtained Premium Residency in accordance with the Law.

    • Family:  Those who are dependent on the Premium Residency Holder, including spouses, children, and parents, as determined by the Regulation.

    • Center: Premium Residency Center.

    • Council: Board of Directors of the Center.

Article 2

Previous Amendments
  • 1- The holder of the premium residency enjoys the following rights and benefits and is obligated to fulfill the duties arising from them:

    • A- Residence in the Kingdom with his family.

    • B- Visit visas for relatives, as determined by the Regulation.

    • C- Recruitment of domestic workers according to his needs.

    • D- Ownership of real estate for the purposes of: residential, commercial, and industrial, except in the cities of Mecca and Medina, and the border areas as determined by the Regulation.

    • E- Benefiting from real estate located in the cities of Mecca and Medina for a period not exceeding (ninety) years, with the Ministry of Justice and the Ministry of Investment establishing the necessary mechanisms to ensure that the beneficiary obtains a usufruct title deed issued by the Notary Public.

    • This right shall be transferable to others according to the controls set by the Committee.

    • F- Ownership of private means of transport, and any other movable property permitted by law in the Kingdom.

    • G- Working in private sector establishments and transferring between them, which includes any of his family members, except for professions and jobs that are prohibited for non-Saudis, without prejudice to the fees imposed on non-Saudis.

    • H- The freedom for him or any of his family members to exit the Kingdom and return without the requirement of a visa.

    • I- Use of the designated pathways for Saudis when entering and exiting the Kingdom through its ports.

    • J- Engaging in commercial activities, in accordance with the Foreign Investment Law.

  • 2- The Regulation shall specify the rights, benefits, and other duties, as well as the provisions governing what is stated in this article, in a manner that does not conflict with the applicable laws in the Kingdom.

Article 3

Previous Amendments
  • 1- The types of premium residency are as follows:

    • A- Permanent.

    • B- Limited duration.

  • 2- The types of premium residency referred to in paragraph (1) of this article shall have products proposed by the Council, including the financial fees deemed necessary for their collection; and they shall be issued by a decision of the Council of Economic and Development Affairs.

  • The regulation shall specify the procedures and controls related to what is stated in this article.

Article 4

Previous Amendments
  • 1- To apply for a distinguished residency, the following is required:

    • A- Submission of a valid passport.

    • B- Cancellation.

    • C- Submission of proof of the applicant's financial solvency.

    • D- Submission of a criminal record indicating that the applicant has no prior offenses.

    • E- Submission of a health report regarding the applicant's health status, confirming that they are free from infectious diseases, dated no more than six months prior to the application date.

    • F- The applicant's residency must be legal if applying from within the Kingdom.

  • 2- The committee may, when necessary, add specific conditions in cases that require it.

  • 3- The regulation specifies the procedures and controls related to what is stated in this article.

Previous Amendments
  • The center studies the claim, after completing the requirements mentioned in Article (4) of the law; to consider the approval - unless the interest dictates otherwise - to grant the applicant the premium residency, and it is issued by a decision from the head of the center, in accordance with the provisions contained in the law and the regulation.

Article 6

Previous Amendments
  • 1- The applicant - within (thirty) days from the notification of the approval referred to in Article (5) of the Law - shall do the following:

    • A- Pay the financial fee determined by the Council of Economic and Development Affairs.

    • B- Provide a health insurance document in accordance with the Cooperative Health Insurance Law and its executive regulation.

  • 2- The claim submitted in accordance with Article (4) of the Law shall be considered canceled if the requirements mentioned in paragraph (1) of this article are not fulfilled within the specified period.

  • 3- The regulation shall determine the commencement of the validity of the premium residency and the necessary procedures for its issuance.

Article 7

  • The holder of a privileged residency permit shall comply with this Law, its Regulations, and other laws and directives in force in the Kingdom without prejudice to the provisions of this Law.

Article 9

  • 1. The privileged residency permit shall be terminated if:

    • a) its holder is convicted of a crime punishable by imprisonment for a term not less than 60 days or a fine not less than 100,000 riyals or its equivalent;

    • b) a judicial decision or judgment deporting its holder from the Kingdom is issued;

    • c) the application is proven to include false information;

    • d) its holder fails to comply with the obligations provided for in Article 7 of this Law;

    • e) its holder relinquishes it; or

    • f) its holder dies or loses competency.

  • 2. The provisions of paragraph (1) of this Article shall not prejudice the right of the Committee to terminate the privileged residency permit if public interest so warrants.

  • 1- Cancelled.

  • 2- The regulation specifies the rights and other benefits enjoyed by the family, within the limits set forth in Article (2) of the law.

  • 3- Except for the rights and benefits stipulated by the law and the regulation for the holder of the premium residency and their family, all laws, regulations, and instructions applicable to non-Saudi residents shall apply to them and their family.
